View Full Version : Asshat sues my old high school for $15k since he fell in a POOL locker room

A Cumberland High School student is seeking $15,000 in damages from the town after slipping in the boys' locker room last year and hitting the back of his head on the floor.

David Hetu, 18, sustained permanent head scarring after the March 11, 2005, incident, according to his lawyer, Steven M. Rappoport, of the East Providence firm Rappoport, DeGiovanni and Caslowitz.

Hetu's right foot apparently slipped out from under him during class time in the locker room of the high school swimming pool causing him to fall backward.

He was taken to Landmark Medical Center in Woonsocket where his head wound was closed with six staples.

In the days after the fall, Hetu complained of headaches, blurred vision, and mood swings that made him irritable and impatient, according to a report provided to the town from neuropsychologist William M. Whelihan.

Results of a CAT scan two weeks after the accident found no evidence of a skull fracture.

Rappoport maintains that "negligent maintenance of the locker room area" caused Hetu's injury and the headaches that he suffered through the following school year.

Negligence, according to documents submitted to the town, include the absence of a "wet floor" sign, proper drainage, proper supervision, and preventative measures such as rubberized mats or flooring designed to absorb water.

Calls to the school administration seeking comment were not returned yesterday.

Much of what his client seeks from the town is for pain, suffering, and physical scarring from the accident, Rappoport said.

He also seeks payment of $2,214 in medical bills.

The case is being handled by the town's insurer, Interlocal Trust, and will be heard in state Superior Court, Rappoport said.

I can understand asking for medical costs to be paid, but asking for $15k out of his own stupidity? He slipped in the locker room of the SWIMMING POOL, for fuck's sake. If you don't know that it's going to be slippery in there since people take showers there after EVERY GYM PERIOD, you are a fucking moron; you don't deserve a red cent.

That is seriously fucked out. 15k will murder any funds a school could have. My old high school didnt even have a gym, little less a pool. you should see the type of water we had in my old elementary school. You could slip on $hit any second inside that bathroom.

Fuck... I gave someone a Russian leg sweep right in the middle of the hallway onto the linoleum and he landed head first. I never heard shit from that.

Actually, I know I just got lucky as fuck he was trying to be a tough guy. I ran into him a few years later and he said he still got headaches.

Serves him right for being a douche and trying to start a fight.

Sounds like it could go either way, my guess it that they will likely settle, even though unless there was something not up to code the school technically didn't do anything wrong. But still even if he wins a trial, I'd say there's only about a 10% chance he gets the full amount, especially if the actual medical bills are only $2,300 of the $15k suit.

No offense man, but I thought that was common sense lol

I nearly drowned as a kid at a water park. I was on one of those like quarter slides where its a free fall over hald way down into a 10ft pool. I'm lucky that a friends father was there to dive in after me. I was about 7 at the time, so common sense went out the window at that age lol.

Hell, I still don't know how to swim

I would think learning to swim would be something most people do... of course, I guess that would depend on where you live/grew up.

I mean, as a child, I was taugh to swim, how to perform CPR, basic water-related lifesaving (proper way to fish people out of the water and the like), and made to swim a mile every day over the course of a summer.

Needless to say, I'm a reasonably strong swimmer after that.

I slipped on ice when I was 9 and cracked my two front teeth because the school didn't put any salt on the groud.....if only I knew to sue.

As for you slipping on ice on the ground, I know here in VA you can sue a home owner if you slip and bust your ass or break anything if you fall on the sidewalk because of ice. Honestly, I think thats BS because its the cities property, but yet the citizens are required to up keep it. Yeah, why should we do anything when there is a large hole in the sidewalk the city refuses to fix...ha

Thats cool. I figured thats what had happened. I was having problems where it just kept saying "loading" in the tab that I have for CAG. For a few mins after that it ran slow. At least it seems like everything is back to normal

It would be CPS's fault, in chicago. Someone took a pic of the blood loss and it was quite a bit. But I have one of those happy go lucky mothers that didn't want to sue and doesn't believe in returns either.

Someone robbing your house can sue if he gets hurt, it happens all the time. Someone was breaking into a house and tripped on something. The home owner can go to jail now because it was biult wrong. My uncle says it best if someone is breaking in make sure once you shoot them they are dead otherwise they will sue.

Unfortunatly, killing them is probably the best thing you can do. Plus it always really helps if you simply say too "I was in fear for my life"

Of course, if you break into my home, there isn't going to be a body to be found...

I was just pointing out the fallacy of David85's original statement that the gun was legal. Not registered = Not legal. I made no mention of the incident in question and what was right and or wrong.
