View Full Version : HELP please! I got screwed on ebay...

So I successfully won on ebay a PS3 with two PS3 games: Madden 07 and Call of Duty 3. These are the items CLEARLY advertised, picture and all. However, when I receive the item, it is a JAPANESE (NTSC-J) console, and the videogames are two imported PS2 games (one is Tales of Legendia, and I can't make out the other one...I knew that not learning kanji would haunt me someday). So I have filed a claim through Ebay, and they need me to have "an independent adjudicator" appraise the item, hopefully deeming it "not-as-advertised" so I may receive some small reimbursement (although unfortunately not a full one).
My question is, how am I to do this? Should I simply walk to EBgames and have someone write in store letterhead how the item is not as described, and then have a notary make it official? I am down a couple hundred dollars and would appreciate any help you can give me. Thanks!

Did you just get the system now? That auction ended in December. Seems a long time to wait before you filed a complaint. Good luck on whatever you do.

He must of just used a stock photo for all his auctions. He states 1 controller, but also includes a picture of an additional controller. And he states 2 Bonus games (never naming them, just implying with the photo.) Whether he's an idiot or sinister, he's a crappy seller.
But WTF? As the above poster stated, it's been almost 3 months since auction close. You're just having an issue now?

Yeah, you got screwed, I don't know if you can do anything about it. The auction doesn't state what games are included. The picture is shady, but I'm not sure what holds more water in the ebay/pay pal court of law.

It does say TWO BONUS:PS3 GAMES!
If he got PS2, then yes.....a claim should be files.
I would contact the seller....if he does not refund any money, leave negative feedback. Not sure if the Japanese console is any different, but that would annoy me also.

If it's not too late. File a paypal claim stating significantly not as described and they will give you your money back. I had a buyer do that to me (and I did nothing wrong he is just an idiot) and he got his money back and got to keep his Playstation 3.

Have you filed any criminal complaints? I bookmarked a whole bunch of sites after I sold my launch PS3 with this very concern in mind. If somebody was gonna try stealing from me, I was gonna go after them hardcore.
EDIT: I'm assuming you didn't use any tricky language that is B.S. I've got no sympathy when internet posters say the buyer should have read better. That's deceit.

Definitely dispute the charge with your credit card company (hopefully you used one) and do it fast as this is almost 3 months old!

Your credibility will be a factor w/ Paypal and eBay since the auction ended almost 3 months ago.
As a starting point however, filing a claim with Paypal is your best option right now. Good luck.
If you paid with CC funded PayPal I'd call your credit card company (like right now) to see the deadline for filing a complaint. Which may unfortunately already have passed. But if your company gives you 90 days you may still be in that window.
You could give the eBay PP claim time to play out, but file a complaint with your CC before the deadline to do so is up. You have a much better chance of getting money from your CC than you do from PayPal IMO.
If you didn't pay with a credit card or they won't let you file a complaint with them now for some reason, then you just have to hope eBay comes through or pursue fraud charges against the seller and hope it scares him into a refund.

I'm sure it's just me, but I would've been very pleasantly surprised to get a .jp PS3, since it would play all those .jp ps1 and ps2 games I have no system for. ^_^

But it wont play US versions of PS2 or PS1 games.

Interestingly, ebay did let me file a claim. You are right though; I need to call my credit card company. Thanks for all your help, guys. Will let you know how this turns up.
