SAN FRANCISCO, California (AP) -- A California woman whose doctor says marijuana is the only medicine keeping her alive is not immune from federal prosecution on drug charges, a federal appeals court ruled Wednesday.

The case was brought by Angel Raich, an Oakland mother of two who suffers from scoliosis, a brain tumor, chronic nausea and other ailments. On her doctor's advice, she eats or smokes marijuana every couple of hours to ease her pain and bolster a nonexistent appetite as conventional drugs did not work.

The Supreme Court ruled against Raich two years ago, saying that medical marijuana users and their suppliers could be prosecuted for breaching federal drug laws even if they lived in a state such as California where medical pot is legal.

Because of that ruling, the issue before the 9th U.S. Circuit Court of Appeals was narrowed to the so-called right to life theory: that marijuana should be allowed if it is the only viable option to keep a patient alive.

Raich, 41, began sobbing when she was told of the decision and said she would continue using the drug.

"I'm sure not going to let them kill me," she said. "Oh my God."

Yeah, well... drugs are bad m'kay? Who knows, all "hepped up" on a "gateway drug" like "mary-ju-waana" she might start breaking into houses or eating babies.

Its funny how they call it a gateway drug.... I have never once wanted to try any of the stronger drugs out there, and have smoked weed where it was legal to do so.

I have never broken into any houses, or wanted to kill anyone, just sat back plaid video games, and went about my buisness not bothering anyone.

I also must say that the government can be a very messed up thing here in the united states, if you had gone a few days without feeding a dog, you could get charged with some cruelty laws, but if they go and take the one thing keeping her alive, and make two offsprings of her loose their mother that's alright?!?!

like how you can legally go off and get yourself killed in a war, or kill other people but if you dare to touch a drop of alcohol your in deep shit... WTF?!?

we are one of the few countries from what I hear that have laws on alcohol, but we also have the most problems with it?

That term is only used by those who don't know better. Most pot smokers wouldn't touch a stronger drug. Most coke, etc users never smoked pot, they started with pills etc.

Friends started with weed. Went to shrooms. Then coke

Wel, I highly doubt anyone would actually prosecute a case against her in a courtroom to begin with, with any real hope of winning. Still, I'm not really for or against "medical pot". However I think the positive physical effects it has to actually increase one's health (even in this situation) are essentially non-existant. In most medicinal (sp?) cases it's simply used as a relaxant/pain-killer somehting that can be achieved with a number of drugs, all of which though can easily be abused as much some pot can. Therefore, I don't see any problem with it being prescribed just like other drugs, so long as it's legal to do so.
