I bought a digital camera from them: http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&item=3823551787&ssPageName= STRK:MEWN:IT

And when I got it, it was defective. They were quick to (illegally) suggest I go to Wal-Mart and return it there. Now, when I say I want to return it to them, they became VERY rude. Now they are ignoring my email. I haven't left feedback yet, but they already left me a positive, so I am going to give them a negative. If they don't respond to my email, I will do it tomorrow; otherwise I will wait until the whole thing is over (unlikely; they were quick to respond to my other emails) and still give them a negative for being so rude. Just a heads-up for CAG.

Sorry to hear that, but if you buy a brand new item and it ends up being defective, you can't expect that person to take it back and accept it as their loss. Then again, the person should have stated no refunds or sold the item "as is" ...

Either way, they don't seem to be a real friendly seller, thanks for the heads up.

Yeah...as a seller you always have to state all your conditions. Since he didnt say anything about no refunds or returns in his auction you should be able to return it to him.

That sucks, but atleast you get teh pleasure of leaving negative feedback!! Did you pay with paypal?

I have never done it before, but look on their website and see. They might be able to helop you.

if you paid with paypal you can retract your payment within 30 days.

I've never personally done it but I know it's there, because I read through the rules and regs.

My experiences with paypal have shown me that paypal won't really do much but it is worth a try, it all depends on what the seller does

Did you pay with a credit card through Paypal? If you do a chargeback through the credit card company, the seller will lose the funds

It's a defective product that the seller won't take back. You should be able to get your money back without getting in trouble if life were fair.

no, paypal wont help you much at all.. theres a few motions they will go through, but i once got ripped off.. they asked seller for the proof of shipment, he had none, so he quickly mailed me an empty envelope and gave them the tracking #, so they assumed it was resolved and dropped the case on proof of shipment.. well about a week later, i get the envelope, its empty, i complain, and paypal says "we're sorry, you only have 30 days after the date of the transaction to file a complaint" needless to say, i was SOL.

No but Paypal frowns upon people doing that (I wonder why :lol: )

Paypal will probably send you a warning saying that if you do a chargeback through your credit card company again, your Paypal account will be terminated.

I would only do a credit card chargeback as a last resort.

Yes with paypal you can get a charge back to your account. Basically I went through the process with a company and when they failed to respond to palpal, I was automatically refunded. The paperwork you need to print out is hidden pretty damn well in their help section. I suggest you contact Paypal by phone and get them to actually "tell" you the link to download the forms, also they will then actually have a record of your complaint (also feels better talking to a live person).

I'll search for the PDF of the documents, might have of deleted them a while ago.

PayPal will likely do f***-all for you. I filed a complaint after 10 days of not recieving merchandise and they said that while my complaint was valid, they could not recover any of my money.

I sell a lot of sealed games. If they don't work, it's the manufacturers fault, not mine. I don't want to take the hit for it so in all my auctions I state "absolutely no refunds, except in extreme cases and under my discretion."

I've never had someone come back to me with a sealed game that doesn't work though.

WTF??? And this is what they told the people:
This item was BRAND NEW! Sealed in the box. The buyer said she tried 2 sets of batteries and couldn't get it to work. I told her I purchased it at WalMart; she could try to return it to her local WalMart. I also told her the BRAND NEW camera came with a Manufacturer's warranty; that she could go that route; and lastly, I told her if the camera was in some way damaged during shipping, we did ship with insurance; she could make a claim with the post office. She refused all 3 of my options for her. Demanded her money back PLUS 1/2 of the return shipping. You can see from my other feedbacks that I am an excellent seller! This has been an extremely frustrating situation! Thank you for your assistance!

This is the biggest bullshit I've ever seen in my life. Any suggestions?

I hope you at least responded to that. Trying to get feedback removed is costing the seller around $20 through square trade ( I have done it before ).
But It sounds like this seller is trying to screw you over and still have good feedback. Your best bet is to work with square trade, if you reply and work with them you may get things settled but I wouldn't aggree to feedback removal for the seller.

You can also leave a follow-up comment is his feedback if you wanted to. it would allow you to add more detail & respond to his reply that shows in his feedback.

Yeah, I responded and said I would remove the feedback IF I could return the camera and get my money back. I'll keep you updated on the situation.

If the item arrived as brand new sealed like the author described then you should take the issue to the manufacturer or the place where she bought it. After all the item was new and sealed, so why should she be expected to take a hit on the s&h? And also you have very few transactions on your account so it's reasonable for the seller to suspect that you could have just replace your broken camera with the new one.

You could ask her to mail in the wal-mart receipt to prove that it was purchased there. If she does that then I don't see any problem just returning it to wal-mart unless you get less back than what you paid for.

She didn't purchase it at Wal-Mart. She just said to return it there.

Here were the three "options" provided, none of which let her take responsibility:
1. Return it to Wal-Mart.
2. Try the manufacturer's warranty.
3. Try the post office's insurance.

The problem with the PO insurance is that it was extremely poorly packaged in a much larger box than the actual item and it was mostly cushioned by newspaper- FOR A DIGITAL CAMERA!
