Will microsoft refund money for defective XBLA games?

In this case the specific game I am referring to is "Jewel Quest"

There are serious known issues with this game.
Specifically a disastrous glitch where you loose your save!

Yeah that's right you can spend countless hours in this game
only to have everything lost!

Just so people don't think I am crazy there is discussion on
this over at the official Xbox.com forums for the game.

So my question is, this game has been out for over a year.
No update to fix the problem. Game is clearly defective
and no fun to play when you loose your saves.

My question was has anyone ever called into Microsoft and gotten a refund for a defective game? Be it this title or another.

You can try, but I think you'll have an easier time trying to get pigs to fly.

Well... technically it's not "defective" the way that term would be used.

It was made that way, it's not a defective copy that you just got.

But the combination of making a stink + a decent customer service rep can work wonders.

Does any company refund money for crappy games with bugs? No. IT does suck with digital content because you can't trade it in. Anyway doesn't seem worth worrying about it for the $5 or $10 this game probably cost you. You got a couple hours play.

Just be more careful.

Maybe send them an email and then vote with your wallet next time.
