Here is my story:
I was on ebay buying a xbox and I saw his auction then I won his auction, and I paid for the product... few week later, the xbox come, and I was happy but when I open it the xbox is different from what he put on ebay, so I send him an email asking for an exchange, he say yes so I send in the xbox....
Here is the problem:
Few weeks after I send back the xbox I got no respond, and I know he got the xbox because I got the comfirmation, so I email him and ask him what happen. He ask me to send him $16 for the shipping, and I say "No, why should I pay for shipping it's you that make the mistake of shipping me the wrong xbox, and I ask for a refund." then few minute later I got his reply, this is wht he said "ok, take english class, send me 16$".....
and now I m pissed b/c he won't give me my refund nor my xbox, and he also insulted my English (i know my english is not good, but his english is not any better then mine.) So my CAG.com Friend wht should I do to get my money back from him?

You can threaten him with filing a refund discrepency. That is if you want a refund. I say call his bluff with this threat and take it from there. How is his feedback? If it is good I doubt he'll risk negative feedback.

if feedback is that low, a negative might not change his mind. He an open a new account, and thats that. Did you pay with paypal? You can request a refund there.

Guys... This morning when I open my email the seller send my a message contain some threaten message, this is what he said, "be carefull, ill send your ass back where you came from." What should I do now, I don't want any trouble I just want my money back.

I highly doubt he intends to back up any of his threats. Did you happen to pay with Paypal? If so, talk with them about getting your money back.
Like what someone else asked, what was so different about the one he sent you than the one that was posted in the auction?
Post a link to the auction, so we can look at it.

He used the old Xbox box trick and sold it for $122. Man, that is really shitty people do that. Even his title was Perfect Xbox with 2 games, but you have to read the description to know it's a box.

Report it to Ebay and request his personal info. Keep everything you have in emails. You can try to get him for mail fraud also. It is illegal to deceive and it is clear he was doing that but in the end you might not get back your money. All you can do is report. The threat email can be turned over to the police which is what you might want to do. I would get his actual address and contact the local police for that area and file a police report for physical threats.. I know it works since I have seen it. At this point, I would go after him with a vengeance, but that's just me.
You could always get a few local CAGS to pay a visit to Lancaster, PA. :evil:

Man, what a scumbag. People need to learn to read the whole item description before bidding on things. Too many scammers out there.

Another bad Ebay experience. When will people learn? This guy must be a real piece of work to try and pull crap like that on Ebay.

Here is the Ebay item that i bid...
I know, I know, it say broken xbox, but the broken xbox that I receive didn't fit his Description. In his description he stated "Broken xbox. after i got a error, and stop playing games, i opened it up to see what it looks like. Comes with just the BROKEN xbox" but what I receive is a broken xbox with the name "Jason" written all over it, and inside the motherboard there is ABC gums (alrady been chrew gums) not to metion the name "Jason", and the xbox hdd, power supply was all mess up, even the cd rom rack, and the hd rack have been taken off, so I request for a exchange, he say ok, but when he got the xbox back he won't exchange it nor refund my money and he also threaten me like my above post stated.
(if there is any English error give forgive me, I try my best to correct it)

On to business...
First and foremost, you can dick his rating even lower by leaving him a negative, he's already apparently left you positive feedback so you have nothing to lose there.
Second it's possible people on here could all contact him with threatening messages, eventually driving him insane. You could also give us his other contact info, such as his email address or better yet, shipping address (you kept that right?)
Finally, you just need to be more careful. People with really shitty ratings have them for a reason.
Ultimately I don't see this working out for you unless you drive/fly/take a boat to this guy's residence and beat your money out of him. Nine times out of ten someone pulling a scam like that is a little kid, so you may wish to send a letter addressed to a MR or MRS and then the last name on the shipping address. Other than that chalk it up as one of life's pain in the ass lessons.

Ebay has a good fraud program. I been through it 3 or 4 years ago because some A-hole sold me a broken sega CD. It's really easy to go though. Ebay will end up paying you most of the money and ban the seller for life if the case is in your favor. Please save all the emails he sent you. Your sure to win if he's saying comments like that. Just say the word and I'll post my expierence and the steps of the ebay fraud porgram.
