Halo 3 action figures? So many preorder bonuses for that game lately.

Wish Target would list what the Core dropped to, in the (extremely minor) hope that it would be more than the $20 drop that Circuit City is advertising. Oh well, guess the Premium drop isn't too bad.

But wow, I didn't know the 80GB PS3 bundle was coming out so soon, thought it wouldn't be until September at least (figured they'd release it alongside the PSP redesign).

I don't think it covers release delays.Probably not, but then they usually don't know anything about the new release games they do receive. Every time I go to a CC and ask for the new release, they always scurry around asking each other if anyone has heard of the game in the ad, do we have it, blah blah blah. No one knows anything there. It's one of the most disorganized stores I've ever seen.

If Lair shows up in the ad w/ the $20 GC guarantee, I think I'd have a very good chance to collect.

EGM ripped lair, disappointing for what many of us thought might be a AAA game, looks like a rent. Saw it first on YTMND and thought it was fake but now it's all over the net.

I'm hoping for a Madden sale on the Wii or PS3.

CC does not give gift cards due to manufactures delays, it's in the fine print. They will however pay if it's the shippers fault, or their own stocking fault.

I know what you mean. They got rid of the few at mine who knew what they were doing. I went in to get Mario Charged and they scrambled for 5 minutes to find it. You would think that a manager of a store that has a lead item like this on sale with a $20 GC on the line, would make sure to escort it or have their best person waiting for it, so they cna put it on the shelf right away.

I still enjoy shoppng there, but I'm turning to BB more and morefor games and movies.

It's still listed in the ad so it is as far their ad department is concerned.

I tried to find Flight Simulator X but not many local BBs had it (including the most local one to me). One near work had a copy but I don't think you can PM online orders after the fact, so hopefully it'll still be around when I get the chance to get down there.

You can PM an online order after the fact, BB orders placed online versus in-store are no different. I've done that dozens of times with ordering something online and then PMing in-store.

Place the order for in-store pickup tomorrow, and then swing by there Sunday to pick it up. When you pick it up, do the PM and you're done in one trip.

Question for you guys. The official press release states the 360 price drop goes into effect on the 8th which is tomorrow. If I go out and buy my 360 from Circuit City on Thursday with that price, I can go on Sunday and get the free game right? Or does that thing only work for prices?

I took it to mean suggestions. THey picture those games in the hope that you'll preorder one of those but I'm sure that there are many others.

I'm seriously considering a holdout on CC purchases, it's the only place I shop for games. Maybe not, I still like to shop there, but the BB deal for the $10 GC for $100 purchases has me shopping there reciently.

I don't see what they stand to gain, unless Sony is adding pressure to CC to find the "leak" of the price drop.

U.S. District Court rules that the music industry cannot compel ISPs to identify users who may be violating RIAA member copyright.

RIAA, you're SOL.

That's basically what the U.S. District Court for the District of Columbia told the recording industry today in a decision (PDF (http://pacer.cadc.uscourts.gov/docs/common/opinions/200312/03-7015a.pdf)) that reverses an earlier court's ruling that the RIAA has the right to subpoena an Internet service provider for names and personal information of its file-swapping users.

The court said that the RIAA has no right to issue subpoenas to an ISP for personal user information when the ISP merely is used as "a conduit for communications" between its users. The court said Verizon is not responsible for what its users do while using the Internet, or what they do with files taken from the Net.

Furthermore, the court threw out the RIAA's argument that the Digital Millennium Copyright Act (http://thomas.loc.gov/cgi-bin/query/z?c105:H.R.2281.ENR:) provides for the protection of music files that are traded on peer-to-peer networks.

Tonight on "Tech Live," get the very latest on this landmark decision that throws into uncertain territory the entire RIAA legal strategy of pursuing thousands (http://www.g4tv.com/techtvvault/features/44735/RIAA_Hit_List.html) of alleged file swappers. On the show tonight, we'll have reaction from both sides in the case, as well as a look at what the decision means for the RIAA, ISPs, and Internet users' rights online.

Take your suit and shove it

The stunning reversal stems from a case between the RIAA and Verizon (http://www.eff.org/Cases/RIAA_v_Verizon/), which sought to protect the names of two of its users from the RIAA's stepped-up legal efforts last year. In June of 2003, an appeals court rejected Verizon's request for a stay, which sought to delay an earlier court ruling that the RIAA had the right under the DMCA to subpoena user information from ISPs including Verizon.

The RIAA contended that the DMCA gave it, along with copyright holders, the right to bypass the normal judicial process requiring a judge to review and sign subpoena requests. Instead, the earlier court ruling said that the DMCA in fact did not require copyright holders to secure a judge's approval when sending subpoenas.

The decision opened the floodgates against file swappers. The RIAA began issuing thousands of subpoenas against alleged file swappers, and began also filing lawsuits against dozens of others.

The Electronic Frontier Foundation (http://www.eff.org/) filed an amicus brief in the case, supporting Verizon. In a statement, it called the court's decision a win for music fans and Internet users alike.

"The effect of the appeals court decision is that we do not lose our privacy simply by connecting to the Internet," said EFF Staff Attorney Wendy Seltzer. "The ruling stops the record labels from taking our free speech rights as collateral damage in the campaign against the American music fan."

The RIAA, meanwhile, is vowing to press on with its fight against file swappers.

"Regardless of this decision, we will continue to defend our rights online on behalf of artists, songwriters and countless others involved in bringing music to the public," said RIAA President Cary Sherman, in a statement released after the court decision. "We can and will continue to file copyright infringement lawsuits against file sharers who engage in illegal activity."

DMCA pre-P2P

One of the cornerstones of the RIAA's case against Verizon assumed that the DMCA provided for the protection of MP3 files traded on various P2P networks, including KaZaA. The court notes that when Congress was considering the DMCA, it saw a danger in bulletin board services and other FTP applications, but not P2P applications like KaZaA or Napster.

"The Congress had no reason to foresee the application of... P2P file sharing, nor did they draft the DMCA broadly enough to reach the new technology when it came along," the court wrote in its decision. "Had the Congress been aware of P2P technology, or anticipated its development [the DMCA] might have been drafted more generally. ... Nothing in the legislative history supports the issuance of a subpoena to an ISP acting as a conduit for P2P file sharing."
The court's opinion continues, offering sympathy to the needs of the RIAA to protect its members copyrights, but adds: "It is not the province of the courts, however, to rewrite the DMCA in order to make it fit a new and unforeseen Internet architecture, no matter how damaging that development has been to the music industry or threatens being to the motion picture and software industries."

The RIAA, in its statement, said nothing about appealing the decision. If it did, the RIAA would ask the U.S. Supreme Court to review the case.

How the RIAA will continue its legal fight against swappers is uncertain. But that apparently doesn't mean it won't sue more alleged file swappers.

"This decision is inconsistent with both the views of Congress and the findings of the district court," Sherman said in his statement. "It unfortunately means we can no longer notify illegal file sharers before we file lawsuits against them to offer the opportunity to settle outside of litigation. Verizon is solely responsible for a legal process that will now be less sensitive to the interests of its subscribers who engage in illegal activity."

I looked through the site's Terms of Service, and while OTHER SITES have the following language: "We will never divulge your information, unless required by law or legal proceedings (such as a search warrant, subpoena or court order), to any third party without first asking your consent," CAG does not have such language in its TOS so (without not looking to much into e-discovery issues) Speedy may be okay. ;-)

That ruling is very old and was saying that the RIAA had no right to get the names without a subpeona. It doesn't apply to this because it sounds like an actual subpeona has been issued from a judge.

Seriously, I am hoping to go to law school, and this is one of the reasons. I shop at CC a lot, however, this is out and out asenine. They recieve more business because of this, its free advertising, and gives people a comparison of deals. The worst that CC has is that people will PM prices more, but its exactly that policy that I shop at CC. Good luck all involved, and hopefully CC will drop this suit before they experience blow back from the gaming community in general (and that will happen if the media gets involved, although that is a longshot).

Not all of those are because of speedy's threads, of course, but the point is that I'd have zero reason to go if not for this forum in general, and speedy's threads are a big part of that. It's not like online stores and Best Buy aren't all I usually need.

The irony? Because of CC's new gamer membership program, which I only learned about right here since I don't pay for any newspaper, I was just about to throw away six years of loyalty to Best Buy and make CC my main gaming store. And I buy games at BB instead of CC at around a 12:1 ratio, so it wouldn't have been a small change. Now I'm thinking twice.

Just saw the news myself, and although I know I'm only one (relatively new) member of a huge community, I offer up any and all help I can give. Hell, as other CAGs have suggested, a legal defense fund really doesn't sound like a bad idea. All moral arguments aside, it'd probably be a sound investment. ;)

While I understand that CC (& BB, Target, etc.) have a few reasons to get pissy about pre-releasing their adds all I can say is that I wouldn't spend a dime at any of these stores if it weren't for you. I haven't stepped inside a CC for years 'till I came accross your info & suddenly I've spent over $200 in the last 2 months. And that $200 spent has landed me waaaaay more games than I would've imagined possible. CC should seriously be thanking you or at least be doing the same thing on their own instead of losing track of the big $$ picture.

Alright, so I no longer shop at EBStop because of their repackaing-and-selling-as-new practice, and now I will stop purchasing from Circuit City until they drop this.

Since I don't have a Best Buy in my local shopping area, and I really don't like walking into Wal-Mart, I'm left with Target and online shopping. At least it makes things easier. :)

I'm in Naples, FL, and I've got a lot of shopping options all less than 20 minutes from my house - Best Buy, Target, EBGames, Toys'R'Us, Wal-Mart Supercenter, soon-to-be Target Supercenter, and Circuit City. Guess I'll have one less store to shop at now; everything I might want to buy from CC will now be bought at BB or somewhere else w/price match.

For many years I have been dissatisfied with Circuit City. Recently, when I visit the store on a new release day, I am often unable to locate the new release because the employees have not unpacked the boxes. If I cannot find the DVD or video game I am looking for, I search for an employee who often avoids helping me or finally pulls out the DVD or video game from a box behind the counter. This should not happen.

To checkout, I must now visit customer service, even though there are plenty of cash registers. I know that the clerks used to ring up my purchase there, but they no long seem to be allowed to do this. At customer service, the checkout process is excruciatingly slow--especially for someone who is only purchasing one item. I could understand a slow checkout for a big ticket item, but it should not take more than ten to fifteen minutes to ring up my DVD or video game. I know from experience that checkout at Target and Best Buy that their checkout process is quite efficient. As to any free gift with purchase advertised in your ad, most often than not your employees attempt to argue with me that I am wrong. At this point, I must produce your ad to show them that I am correct.

To give you an example of my latest experience at Circuit City, I went in to purchase a portable DVD player. I selected a DVD player but was told by one of your clerks that they no longer had that DVD player in stock. Nonetheless, your employee told me that there was another Circuit City nearby that had it stock, so I agreed to purchase it. I asked her to confirm that the player was in fact in stock at the other Circuit City and she said I had nothing to worry about. Nonetheless, the next day (after driving for 45 minutes one-way), I found out that the other Circuit City DID NOT have the DVD portable player in stock. I had to get a refund on both the portable DVD player and the service plan. That day, Best Buy got my business.

The highlights of any given visit to Circuit City include not being able to locate the item I'm seeking, poor customer service, and a painfully slow checkout. Thus, I made the choice a few months back to stop shopping at Circuit City because I was left feeling like your company was trying to discourage my business. So if Circuit City offered a lower price in their ad on any given week, I took my ad to Best Buy or Wal-Mart because any one of these stores would match the price, offer better customer service, and a faster checkout.

Within the last few months, I've followed the forums on DVDtalk.com and CheapAssGamer.com. I appreciated the posts that listed the comparison prices of different retailers. Because of these posts, I decided to return to Circuit City—in fact, I made more purchases at Circuit City than I ever had in the past (only because I realized through the ads that Circuit City often offered the best prices). While none of my previous problems with CircuitCity had been resolved, I continued to tough it out and keep shopping there. Within the last few months, I have purchased a 1080p DLP Television, several video games, several blu-rays, among other things from Circuit City.

However, as a consumer I have a choice to make: I could spend the exact same amount of money on these items at Best Buy, Target, or CircuitCity because no one company offers a lower price than the others. Thanks to Circuit City's decision to instigate a legal matter against DVDtalk.com, CheapAssGamer.com, and especially against the user named Speedy1961 about posting the ads ahead of time, I will no longer purchase any items from Circuit City and will encourage all family members and friends to do the same.

Due to the fact that Circuit City has shut down people who shared the ad ahead of time and for all of the other factors listed above, I feel like I can no longer give you my business. The poster in question did you a favor by driving business to your store. Having knowledge of your prices ahead of time helped me make an informed decision about how to budget my entertainment purchases. I'll still have that knowledge from the Sunday ads, but Circuit City will no longer get my business because of their attack on DVDtalk.com, CheapAssGamer.com and Speedy1961. If the ads will no longer be allowed to be posted ahead of time, I will not continue to shop at your store. I'm not the only one who feels this way toward Circuit City's actions: feel free to take a look at the various forums and you will see that Circuit City's actions have upset many loyal consumers.

I find it pretty damn funny that CC is trying to silence this act; which I'm sure stemmed from the PS3 price drop fiasco. The thing is, many of us would NEVER have purchased a PS3 at $600, so once we had word that it was dropping $100 we started justifying why it was worth the $500.

What I'm saying is that these stores didn't loose business because of the pre-announcement; they MADE business because of it. If anything, they should be praising the guys who get the info out because they build up the hype of these sales.

Also, we usually see the ads 2 weeks in advance, well within the "price adjustment" timeframe of pre-ad purchases; thus if someone wants a title they are going to pay the same whether they buy when they see the ads or wait for the sale since they'll get the money back either way.

I listened to the CAGcast tonight at work and learned about this whole CC fiasco. I think it's ridiculous that CC is trying to punish somebody who gets them business. Speedy did nothing wrong. If they don't want people leaking these ads, they shouldn't create them so soon anyways. I rarely shop at Circuit City anyways, but I'll be sure to pitch in on the CC protest. They've always had a shit selection anyways. Most of the time I can't even get an employee to ring me up. I've had a lot of frustrating experiences there.

Circuit $hitty has constantly disappointed me over the years. I have never been happy with that establishment. Their customer service is horrendous, their management is terrible, and they need to go out of business real fast. I haven't shopped there in a very long time and after reading what they have done to speedy they have guaranteed that I will never shop there again and I will tell anyone that will listen to never shop there and tell them to tell anyone who will listen to never to shop there, etc.

I'm here to offer my support in any way possible... give me an address and my legal defense fund monies are in the mail. I grew up miles from this retailer's headquarters so I've known it the longest and feel it offers more knowledgeable floor people than other retailers. Other than that I do not care for the retailer. I can rarely find anything I'm looking for without assistance and feel the level of customer service is lacking.

In this particular instance, I do not know how the free service speedy offers is any more damaging than when one of this retailer's employees saying "Wait until next week." Now I can see where this legal matter may have some footing if speedy was being compensated for his efforts or speedy has caused damage to the company but I fail to see where either are true.

On the whole, I am extremely disappointed by the fact that the same outlets that made speedy notorious are failing to report the ramifications from the notoriety. I had never heard of this until I dropped by this thread in search of notes about future advertisements.

PS - Sorry if some of the post is a little confusing but I had to attempt to write it without directly referencing said retailer as that word has been removed from my vocabulary.

Maybe because I live near Richmond, the stores get a more thorough inspection. I was by no means implying the floor staff was extremely knowledgeable. I feel as if I encounter more knowledgeable floor staffers there than at my local Best Buys. That being said I still feel that through my own research, I am just as knowledgeable or more so than most of the people who are supposed to be assisting me. Now I feel Best Buy's customer service is twice as good as that other companys.

Watch out...I heard microsoft was looking for some seedy type character that broke a rumor about a Xbox 360 Bundle in 2006....essentially a price drop if you consider all the stuff in it....just sayin'. That info wasn't "out" yet so I assume that you caused microsoft some cash by informing people to wait until the bundle comes out.

CC didn't lose anything. I'm sure Sony gave retailers a nice break to cover price matching, and was part of the calculations involved with figuring out what the price drop should be. Smaller distributors probably didn't get any kickbacks but they probably didn't offer price matches anyway. I find it hysterical because Sony did more damage to themselves over the price drop (by announcing the 60GB units were going away) than anyone. Speedy got the hype train going VERY early and gave Sony a VERY positive buzz going into E3 which they totally fumbled. (not saying it was a bad E3 for them but they were set to knock it out of the park but ended up bumbling around the rest of the week)

Speedy's posting lists of prices. If Walmart, of all companies, was unwilling to go through with it and sue Fatwallet over BF prices, I cannot imagine where CC has a leg to stand on, unless Speedy is breaking an NDA (Which is a different matter legally).

But to claim it's "wrong" because you assume CC lost "millions" (a fact I seriously doubt and would love to see any evidence of) seems a bit shortsighted.

Speedy has saved me so much money this past year and I can't even begin to explain how grateful I am. Along with many other users, I will not be shopping at Circuit City anymore. I think what they are doing is complete bull****.

How could Speedy have broken an NDA if he doesn't work for the company? Whoever sent him the ad might have broken one, but I can't see where Speedy has any obligation to CC.

It's not exactly an NDA, it's more like trade secrets or employment confidentiality agreements. I work for a print/mail company and we're covered by a lot of different laws (HIPAA for the medical info we print and SOX for the financial statements) based on what we're printing. We also do things that aren't covered by any specific law but could still get us sued and fired if we revealed it (we print some cable and satellite TV companies' bills and every now and then a machine operator notices the bill of a famous person who's really into pay per view porn for example).

I don't know how speedy gets the ads, so it's entirely possible he didn't do anything wrong specifically (although he almost certain deliberately revealed information he knew he wasn't supposed to have) but someone along the chain did. It may have been someone inside CC, it may have been someone at the ad company,it may have been someone at the print company. or someone else in the chain. Any of those people could lose their jobs and be sued for breaking their employment confidentiality. Circuit City is simply starting with speedy and going down the chain until they find who's responsible.

A similar situation happened at MTGsalvation.com

RE was sued by Hasbro (MTG's parent company) because he posted leaked information well into advance. They had to file suit against him to flush out who was actually performing the leaks. I'm assuming CC is going to be doing the same situation to find out who the rat is within the company. The end result was that said poster of the information couldn't post anything that Wizards did not publicly announce. So I don't think these adds will be returning by Speedy :(.

Thanx for the fix. At times, I do attempt to engage some of them in a conversation just to remind myself that my research was worth it. I do not engage them and tell them that they are wrong... I like to share with them what I have learned and see what it is they know so the next Joe Schmo hopefully gets a better rep. And it's funny to watch their faces when they realize you know more about the product than they do. But most of the time, I want out of there w/o any encounters.

By making them lose even more money, all because of one person that, while doing something helpful, knew he was doing wrong and accepted that when he began to do this. Just because I don't support the childish motives of some of the people on these boards does not signify that I do not appreciate the site. Stop being immature and look at the big picture.

It hurt Sony, which in turn hurt Circuit City due to the pressure. CC lost millions of dollars, likely. What speedy did was wrong.

how did this hurt Sony? We get the ads two weeks early. Let's say we didn't. I bought a PS3 and 2 weeks later it dropped in price. I take my receipt in and get the difference back. Same net result as if I waited two weeks.

Before Speedy came along I subscribed to a site that posted the adds a week early. It was only a few bucks a month. I just tried to find it with a few different search engines and I'm not finding anything. I used it to pick up a Toshiba 52" at Best Buy that was $$$ off, plus I used a 10% off coupon and a year no financing offer. So, me knowing about the add a week in advance saved me an extra $200 and a year no financing. I was pretty happy.

Anyways, I remember reading last fall in I think it was the Wall Street Journal that the big department stores were all pretty pissed about adds leaking weeks early - and how important it was to them to keep the 'Black Friday' adds under wraps until Thanksgiving. If I remember correctly the article mentioned CC and Walmart were going to do their best to prevent this from hapening again this year. Maybe they believe Speedy is the one they need to stop? I'm sure they have been looking into this for months before they got involved... maybe they just decided that the time to put an end to this was now... before the holidays.

If you did not know the PS3 was going to drop $100 in two weeks would you have bought it? Most would not have, many did knowing that they could get the free controller deal, then come back a week later and get the $100 price match. It cost a fortune.

Now your are correct, the only way it could have effected Sony is if CC gets a refund on the price difference in sales from Sony. Meaning their cost on the PS3 is lowered for instock models when the pirce drop occurs. I don't know how CC deals with vendors. When I worked at CompUSA many years ago, we had a deal with the vendor on refunds for when MSRP is lowered on all units in stock when the distrubutor/vendor/manufatures lowers the MSRP.

I don't. I care because it was bad when they fired all the people and did a rehire, that was a horrible thing, unfortunatly it was a good business decision. They have to make a profit to survive. I care becuase we have already lost the CompUSA near us, the closest place to get computer parts is now Fry's 45 miles away. The CompUSA was closer and much nicer, but it's closed. NOt only do I lose out, but many people lost their jobs. I think that jobs, even if they are not mine is worth fighing for. It appears that this is what CC is doing, trying to stop the losses. I don't agree with their methods, but I hope they work it out for both parties.

Well, add me to the 'boycott CC' line. I was already contemplating not shopping there after the ridiculous way most of the stores handled the MS Point Card sale a few weeks back.

I'll be looking for a new TV in a few months, and I guess I can narrow my search a little.
