Don't worry Cheapy about Metroid Prime and Metroid Prime fans...I also think it's not quite up to the hype. It's all a matter of personal taste, of course.

This show was, in a word, crazy.
Cheapy, I think you're going to get a lot of hate mail again concerning Metroid Prime now, just because you revealed your anemic time count in the original, even though you've played more now. You say it's overrated, but you really had to have been there when it came out to really understand why it got such great reviews. Combined with the fact that there was a ton of skepticism about it going in.
And Wombat, for playing 3 hours of being kidnapped by mysterious strangers. I congratulate you on your cunning good sir. You played one heck of a wicked Chess Match!

Listening to the CAGcast atm. About the subpeona... the only logical reasoning I can come up with is that Circuit City or Sony ultimately lose out on profit whnever ads are posted ahead of schedule. Once the customers see this ad ahead of time, they'll most like hold off on purchasing items to be put on sale. So less people would purchase the ps3 before the sale once more are notified of of this price drop ahead of time.

The following is the letter that I sent to Circuit City tonight regarding this action. Feel free to post and repost this anywhere anyone feels may be appropriate.
I mean every word of it, too.
"Hello,
I am a forum member of a website known as Cheapassgamers.com. I wanted you to know that the only, and I do mean the ONLY time I step foot into a Circuit City is when I see an ad or a list of clearance items on Cheapassgamers.com. Because of this site, and again, ONLY because of this site, I drive 20 minutes twice a month or so simply to go buy the things that I see are on sale, or come with a purchase incentive of some sort.
Now, as you have filed legal action towards cheapassgamers.com, you have lost me as a customer. For life. Period.
This is not an idle threat, but a statement of fact.
Should you see some negative press over strong-arming a website and a forum member who only serves to boost your sales among one of your most highly -sought demographics, and should you drop said action, it will still be too late. I have concluded that you are unfit to receive my money.
I won't sit here and make false claims about how I spend $300 dollars a month at your store. I did buy a $1200-dollar HD-TV to go with my new XBox 360 when it came out, but truthfully, I doubt you will miss my business all that much in the grand scheme of things. I'm not naive. What I am, however, is a gamer. And while we gamers may be cheap, usually more out of necessity than not, waiting for you to drop the price on that title we've been on-the-fence about, we are also proud.
We are proud, and we will not be bullied.
Along with the pride that I feel in writing this letter, however, I also feel sadness. I was angry at first, I admit, but now that has given way to the sadness I feel when I realize that I will miss your store. Not just for the deals, but also because it was a little more of a grown-up electronics store than Best Buy, which is closer to a theme park. Crowded, busy, bright, gaudy. I liked that your stores had carpet for some reason, though I could never exactly pin-point why. I bring these things up because I hope that someone there understands that this is not a decision I make lightly, because in the end, I know that this really will hurt me more than it hurts you.
I will be posting this letter on Cheapassgamers.com, not because I wish to incite others to follow my example, but because we are also a community. And the other members of my community deserve to know that they are not alone in the anger and sadness that they too, will no doubt feel over this most egregious course of action that Circuit City has taken against two of our own.

Cheapy, I wouldn't worry about your Halo 3 playing in the short term, anyway, with the kid coming so soon. Your wife will be home with what sounds like some very generous maternity leave (not being in the U.S. of course). You won't have THAT much to do and should have plenty of time to game. Of course that will all change when she goes back to work, so enjoy it while you can :lol:.
I pine for the easy, carefree days when my wife stopped working a few months before the birth of our first kid. Looking back on it we had SO much free time then we were utterly spoiled. I now have 3 kids with a 4th due in November. I can't imagine what married people with no kids do with all their piles and piles of free time.
Glad to see you liked Metroid more than you thought you would. I played through quite a bit of the first one but never finished and I barely played the second at all (nothing wrong with it, I was just playing other things at the time). I am going to force myself to start MP3 day 1 and complete it before starting any other games though.

Cheapy, glad you're doing the right thing with the Speedy thing. I'm glad that I'm participating in a community that is 'stand up.' If you were to roll over on Speedy, I'm sure that I wouldn't be the only one who would be pretty disappointed with the site.
Why don't you consider hosting outside of the USA? In the future, you could avoid these frivilous US lawsuits. Something tells me that you might be able to get some advice from Ms. Cheapy on this front. You could incorporate in Barbados or something. CAG, Inc. has a nice ring to it.
Wombat--at my office, we've gone through a couple of personality tests, the Myers-Briggs Type Indicator (MBTI) and StrengthFinder. Disc is REALLY old. I can't believe that anyone still uses that. StrengthFinder is the newest one, and the one that I think can be most useful. It focuses only on positives within your organization and the different types of strengths that everyone brings to the table. It's based on the strengths that are identified in successful people all over the world. More research based, and with many more possibilities of how you are rated. It rings truer because there are a variety of differenty dimensions which you can have strengths in.

MBTI is kind of like Disc, it kind of pidgeon-holes people. Fundamentally, it's a bit too 2-dimensional to really capture the nuances of someone's personality. It has 16 different types (I'm an ENFP).

I noticed one person's letter to CC said about they only go for the clearance games...I wouldn't say that to them. I seriously doubt they care about you as a customer if you say you only go for stuff on clearance or sale. Best Buy publicly said that, so I'm sure other stores "think" that privately.

Very classy effort on Speedy's behalf. Very classy.
As for the PSN, I don't play online much, but have played Warhawk and Home betas. Both were mostly seamless (Warhawk dropped me 1-2 times out of several dozen games, and both drops happened right as I tried to join a game in progress, rather than during a game). Home worked just fine as well (shame, then, that I feel it will be a complete bomb, those anticipating it will be amazingly let down by how boring and flimsy it is, and the fact that Home will be largely moot once better interactive features - game invites from the XMB or ingame - are implemented into the XMB.)
The biggest issue with the PSN, IMO, is found in the PSN store. The updates are severely lacking. They should be able to compete with XBL head-to-head in terms of demos, and they aren't. Demos are, without exception, later than their XBL counterparts (or they don't show up at all). They should be able to compete with Wii's VC head-to-head in terms of PSX downloadable games. They only have 12 games total, and only 1 new game (SOTN) has shown up since early June. Worst of all, it set a new pricepoint, as all PSX titles but SOTN are $6, while SOTN is $10. The PSN store is, hands down, the most disappointing aspect of the PSN right now.
Lastly, you'll have to forgive my knee-jerk reaction, there are a number of rumors out there about why GTAIV is delayed, some of which implicate the PS3 version, and some of which implicate the 360 version. I don't know that it's fair, even in speculation, to entertain only one side of those theories. Nevertheless, I do agree that this fall will have plenty of good gaming action without GTA.

I admit, I wasn't fully considering all legal angles for the FreeLoader, I just jumped to the conclusion that since Nintendo didn't slap it down immediately after it's release, it was legit. Congratulations Wombat, you can now be a kept man like Cheapy! A little advice on making the decision, I know she likes her current job, and I understand loyalty is important, but she should go work for the new company. If her current employer valued her that much that they were willing to pay her as much as they are now offering they should have ponied up earlier. The new company appears to understand her true value and are willing to recognize it with the upfront offer, while her current employer appears to recognize that she was worth it all along but wasn't willing to pay her what they thought she was worth until somebody else was. Get your money while you can.
As for the CC, I would be more than willing to pay some money to a CAG defense fund to fight this subpeona. If you set something up Cheapy you can count on a lot of support. I respect greatly that you are willing to spend your own money to help and to protect a CAG and I would happily spend some of my money to help that fight. I intend to buy many things I was on the fence about using the site. I had been holding onto about $1000 I had earmarked for some gaming merchandise but just haven't pulled the trigger on. I will be spending it through the site shortly to get you your backend. I would also be willing to paypal $100 of that directly to you to help pay the lawyer fees.
Good luck Cheapy and keep your head down speedy, don't give them an easy target, I think CC is the type that would probably teabag your corpse if they nail you.

Unless he works for one of the companies I don't see what they can do in this situation since he's only posting ad information early which can't imagine really effecting their bottom line that much. If anything speedy's ads have caused me to go to the store and buy stuff I wasn't planning on picking up while I was there. They should give him a PR job for chistsakes.

I'm a practicing attorney in Florida, and what I do know is that for Circuit City to have a cause of action against Speedy, they must demonstrate that his posting of the ads has caused them some sort of harm. Unless Speedy is a CC employee and his disclosure of the ads violates an employment agreement, I really can't see where the harm is coming from. I do not know what legal theory they are suing under, but unless there is some sort of privity of contract between Speedy and CC, I don't see how they can stop him. I agree with whiptcracker, sometimes I read speedy's postings and I go to CC to take advantage of deals I otherwise would not have known about. So in a way, it could be argued that Speedy is helping CC a great deal. Given the popularity of CAG, CC is likely deriving a great benefit from Speedy. I do not subscribe to a newspaper, nor do I frequent CC's website. Without Speedy's postings, I would have no knowledge of the "Sunday deals." I would imagine there are many others like me out there. Oh well. If CC wants to stop Speedy and lose business, its on them.

Shopping at Circuit City is a nightmare anyway. There's never even anyone at a register. That store has become so ghetto, there's hardly any customers in there; I fully expect to see tumbleweeds drifting by whenever I go in for some clearanced games.

1. It works. Try it if you haven't already. I think I've been using the plural to get here since I joined the site in 2004. You're going to nit-pick my letter for that? Go to Hell.
2. To the guy who said that I might not have mentioned that I only go there for the sales, I clearly state that I spent $1200 there on an HD-TV, and also, that I'm not naive enough to expect that they'll miss my business. If you're not going to read the entire letter, or are simply interested in taking my quotes out of context, please don't bother commenting. Another way to put this might also be, "Go to Hell."

Hey cheapy, about the face training game, I heard the way they're getting people to play it is that they claim doing the exercises will reduce wrinkles. Not sure if that's right but if it is, then I can see that game becoming popular with older folks.

I really don't think Sony had something to do about it. Number 1, CAG is quickly becoming a favorite among all gamers' gaming websites, so Sony wouldn't be smart to piss off CAG. Number 2, CC is upset by this because they lose a week of hundreds of retail dollars. Even though it actually made people want to come into their store for a change. Especially after recent sleeziness performed by said company (AKA firing employees and asking them to come back at lower wages).
I set foot in Circuit City when Mario Strikers came out to get MS points, and after this, I doubt I will ever do so again.

As a general rule I don't listen to podcasts. I have too many CDs that don't get the attention they deserve.
However, the CC mention in the headline caught my attention and I decided to give it a listen. I hope Speedy is able to maintain his anonymity in the face of Circuit City and/or Sony.
It'll be very interesting if it turns out that this pressure is coming from Sony via CC. The same Sony that saw fit to drive Lik-Sang out of business. MS has a bad reputation that they largely deserved back in the 90s. Now it seems like Sony may well be trying to take the corporate bully crown for itself.
Regardless CC is spineless. They're either caving into Sony's demands or have decided on their own to further alienate customers when they're already getting their asses kicked by Best Buy, Wal-Mart and Target. I don't like any of those stores but from now on, barring some sort of great deal (free $20 game when you buy Forza 2, etc) I'm done with Circuit City. I'll be in there to buy cheapass clearance games and that's it.

cheapyd's wife doesn't have to be in bed during the month previous to the birth of the child, she doesn't has to rest in bed all day, only in cases of high risks pregnancies that is advised, hope everything's fine with cheapy's kid,right, eh.
I am saying this cause my wife has been pregnant 3 times, so.....and she is a teacher in the public school system, and everytime we went to the doctor, we always asked if it was advised for her to rest,and the doctor said that it is highly advised that she stay active until the date of birth.
So if there is no risk in the pregnancy of mrs. cheappyd ....there is no need for her to stay in bed all day in the last month of the pregnancy.
By the way, It's nice to see wombat getting in the action on gaming events, hell u were seated next to cliffy, that is quite a thing, actually!

Right on - having the same extensive experience I was going to post the same thing. "Bed rest" is for complications and high-risk pregnancies. Now, it may amount to the same thing, however, as women tend to get very tired during the last few months. My wife did nothing but sleep towards the end of the first one (though we did go for some long walks when she wasn't tired to help get things going - she ended up being nearly 2 weeks late and then being induced). That is because she had no other responsibilities (with her second pregnancy she was too busy with the first kid to sleep much ;)). So besides taking care of her a bit more than normal when she is awake, Cheapy, you will probably have EVEN MORE free time to game than normal! For a short time, anyway, before you start taking over baby duties ;). Enjoy it while you can!

and cheapy, as long as you're supporting of mrs. cheapy while she's on maternity leave and getting closer to the pregnancy, i doubt she'd mind too much if you played halo 3. i know i wouldn't mind if my hubby (when i find said mr. right.. ;)) played games as long as he was there for me, too. of course, i may say that becasue if i were home and supposed to be taking it easy as i was getting ready to have a kid, i'd probably be playing games... :D

there u have it, it's not my home, but in the latin society is of common use that kind of toilets, some come in a separate toilet for that use only, in my house there is one, but we never use it, I kind of dont like the thing, and if there is a way to convert one toilet into a bidet, that is how it is called, it can be bought in a home depot kind of store and can be installed on the regular toilet , it is not as fancy as the japanese ones, but it does the job....me personally have never used one, and I am telling u guys in the latin homes is highly used.

i sit before you all a fervent hater of the wii and yet i cant stay quiet any longer. why the hell is nintendo sleeping on a goldmine with these goofy ass mii's. you all talk about mii's and how cool they are and they go on and on about how much you can customize them so why the hell dont they give you more mii options and mii games.
case in point why not create a mii online wrestling league where you can use your mii dress them up , give them moves and compete in tag matches and singles matches in an online league and even make it where you can win belts and defend those belts and win prizes by beating people( like downloadable content or wii points and other such goofy shit).
and you dont have to just do wrestling why not branch out into other sports like racing or football or basketball all where you can win prizes.
and for the life of me in all their commercials why the hell do they always show those same annoying ass asian guys who knock on random doors and wow they actually let them in to play games.......its stupid and annoying.
theres a perfect song nintendo could use and its by bjork "army of me". keep the song how it is or have her change it to army of wii's or mii's and in the commercial show a single mii walking then show some other ones walking and then do one of those mii parade dealys and they could even go so far as to have a contest where you can get your mii used in the commercial.

Well, in regards to number 1 you can just look at all the shit sony's done since the ps3 came out and you can't really call them smart. remember when they tried to blackball kotaku for posting their info about home before the official announcement? And that wasn't done by some low level employee that was Karraker or however you spell his name.
I too will not be shopping in circuit city again, their stores always seem dirtier than bestbuy anyway.

Jeebus, that is quite brilliant! I never honestly thought about Miis but now I can see how that'd be a ridiculously big hit. actually, CC is going after Speedy by demand of Sony and Microsoft. Best Buy, Target and Wal-mart are also believed to have joined the fight. Ccity is just leading the way.
Im Se7enwolf, the guy who leaked out the full page ad of the PS3 price cut right after speedy. I sadly have lost my job over it at the request of Sony. I was in a 2 hour interview/talk with Lose Prevention of CCity headquarters and have actually gained alot of interesting info about whats going on behind the scenes in regards to the leakers. Apprently they have been after Speedy for awhile now before even the PS3 leak.
I have already e-mailed CheapyD about all of this earlier.
Sony was so mad by the leak that the guy said "They want someones head on a stick for this" and that Sony was losing a big amount of money over the leak and was forced to drop the price a week early.
Also Sony, microsoft, other companies and retailers will be going after not just the leakers but also sites that post leaked info such as ads or full mention of the sales. This includes sites such as 1up.com, Joystiq.com, Cheapassgamer, Kotoka.com and others. onces not included are sites like IGN, gamespot and offical magazine sites since they do not post the ads or the leaked info, but only a rumored regards in response to talk over the internet.
Also apprently Sony also threatened to pull all support from Ccity chain if they did not comply with them on their leakers.
Speedy they believe works at a printing plant which of course many already assumed.
One last thing. employees who work at big retailers such as Best Buy, CCity and even printing plants are to sign a confidentiality contract stating not to leak out any information or upcoming sales to the public before the planned release date. Though this contract is sketchy about things because it excludes close friends and family.
I was working at the 3rd top store of Ccity so I had very earily access to sales ads up to 3 weeks in advance because the ads are printed about a month ahead of the actually sales date.
So keep in mind that its not just Circuit City behind all of this, it is many companies and retailers cracking down on this.
Oh and one last thing. Stores do no make anything on video game console sales. On computers they only make about 5% to 15% on sales and at most on tv's, they only make about 25% on sales which is a rare and high number. stores such as Ccity and best buy make their money on accessories, small merch, services and sales.

I find it odd that Circuit City is the company that has chosen to lead the attack on Speedy. Their own price-matching policy negates next-week sales. People can buy now and match later... as opposed to the other stores where they might lose a sale this week because people are waiting for the ad price.
Anyhoo... Cheapy, you should really try Track and Field. The running controls are mapped onto the analog stick, so it's much easier on the hands. No cramping, although I have slipped off and bumped the Xbox Guide button which lost me a race. I saw a Mad Catz arcade joystick controller I was thinking about getting. It's probably be great for this game.
And as far as Snake being in Smash Bros... What rating will they give to have Snake walking around with his hands full of Kirby and Luigi nuts all day?

Usually I agree with everything on your show however I do not agree with u guys on one particular issue. Every website and podcast I listen to has shrugged off the GTA IV delay as if it were nothing. I have heard on many news sites that people are simply shrugging off the delay because GTA IV is just a sequel and not an original IP like Bioshock, Rock Band or Assassin's creed. These are games that are original respectively and seem to offer more interest than sequels to some but stating that this (the delay) is "a good thing" since there is so many games coming out is rediculous.
Would you guys (Cheapy & Wombat) simply shrug off & eat the fact that Halo 3 would be delayed until April 2008? Would any hardcore Halo fan? Would a person who has preordered and paid in full for the game that has been delayed not until the end of the year, but rather 2nd Fiscal quarter of 2008 just shrug off the fact the game she/he is anticipating just shrug it off? I am beyond pissed off at the delay not because it is a delay as much as it is the duration of the delay without a definite release date.
The fact that there was no reason given either really other than it is "technical" doesn't help. Just want to know ur side guys as well as your possible reaction if they did the same thing with Halo 3 out of the blue like they did with GTA IV.
If you got Served CheapyD (Which I am actually quite shocked to hear) how will you appear in their court if you live in Japan? They gonna fly u over? I'm a bit Confused.

Could someone post a summary of the Circuit City subpoena? I downloaded the CAGcast and it won't work. :( I even used a download manager to make sure it wouldn't be corrupted. I tried both iTunes and WMP and neither will play it. WMP says the format doesn't match the file type. Do I need an unusual codec to play it or something?

Although I have no personal use for and do not actually "use" speedy's threads/these forums that often for their actual intent (although I always have fun reading them) as I no longer really have money to spend on games, I have to say that the fact subpoenas got put out is absolutely tripe, asinine, garbage.
Speedy has done all the people of that follow CAG a great service and should be lauded. not vilified. He has not done anything wrong. If these companies don't want to have their ads posted early, here's a shocking idea: don't post them early (note: i know this isn't a pragmatic/viable solution, just a common sense one)!
It's almost funny how closely this parallels to journalism. A good writer never reveals his source(s). In that vein, speedy shouldn't have to ever reveal where/how he gets his ads early. No matter how "damaging" (*rolls eyes*) his posts may be to a company's profits, he has every right to dispense any and all information available to him at HIS OWN discretion.
And honestly, how many sales do these giant...uh, so-called "corporations" (thinks of Target and laughs, as he is currently working at one) think forums impact? To hardcore gamers, the news will spread like wildfire, regardless of where it is first presented. Considering that a growing contingent population of gamers is more casual/un-informed in comparison to the past, most of this news will *hardly* have an impact on them (not to diminish the value of CAG here, of course =p) And among the hardcore gamers, his information promptly gave them business whereas they otherwise would have had NONE. They should be thanking him.
And finally, hopefully before this stupidity becomes more serious for those involved, remember they are subpoenas and not yet formal charges. Hopefully, these comapnies' woeful ignorance will be exposed soon enough, and we all know where the court of public opinion will prevail on this one.
Here's to hoping common sense and justice prevail...unfortunately with the current state of America these days, one can never tell. Let's just all remember, no matter how much the wolf huffed and puffed, he never was quite able to blow the house down.

Wombat, go to network settings and disable media server connection and see if that fixes your problem, I had the exact same thing and I did that and it started to work.

I used to use a program called Vindigo on my Palm Pilot that listed all the public restrooms in NYC, and you could find one based on proximity to your location. Did you know there's a free public bathroom in the Plaza Hotel? Of course, I just went to the bathroom before I left my apartment to avoid any unfortunate situations, but you never know what's gonna happen. Since my wife had to pee every five seconds, I got familiar with all the decent public washrooms in Manhattan. Banana Republic, usually.
Good toilet story? Our apartment in the West Village was so small, I couldn't sit straight on the toilet without banging my knees against the wall. So I learned to sit at an angle, a habit which was pretty tough to break once I moved into a house with a real bathroom. My wife's pretty small yet she did the same thing, don't know why, and to this day I still catch her sitting diagonal on the can even though she could probably stick her legs straight out and still not touch the wall. True story.
And I think this post wins the award for "Too Much Information." Glad to share.

But seriously, it was exciting to hear about Wombat's invitation to the inner circle, hanging out with Cliffy and playing the newest of new Halo 3 builds. Cheapy seemed genuinely impressed, as well he should have been. Congrats also to Mrs. Wombat for finally pulling down the salary she deserves.
I also have to give props to Cheapy for going out of his way to get an American Wii, going back and giving Metroid Prime another shot, and, most significantly, admitting that he was mistaken in his disdain for the series. That takes huevos. Glad you're enjoying the Wii more now that it's speaking your language. I'm sure I speak for many CAGs when I say I'd love to take you on in Strikers Charged, if you can abide the friend codes.
The subpoena and the whole Speedy1961 situation is surreal. I can't believe they're really taking this course of action, especially after Sony took a PR bath after the whole Home/Kotaku blackballing thing. Do all these companies think their customers won't find out about this? Chances are, if you're savvy enough to have been using the information Speedy was providing, you're certainly tuned in to what they're doing now. Label us devil customers or whatever you want, but you WILL lose our business.
Shame, too. Since BB killed the GGC and Circuit City started offering the best deals, they could have easily positioned themselves as the game retailer of choice. I was even considering purchasing a 360 there to take advantage of their new gamer discount card thing. No longer.

In yet another sign that Circuit City is behind the times here comes the time honored tradition of getting your lawyers involved when all else fails. This whole fiasco is merely a smokescreen to cover the fact that Circuit City did a lousy job or protecting their secrets and now that the cat's out of the bag here comes Circuity City fishing for scapegoats. What can they possibly gain from this that would make all the bad PR worth the effort?
Woe to the people who thought this was a fine idea without thinking the consequences all the way through while at the same time provoking a tidal wave of backlash from the CAG community. Woe to Circuit City if they truly feel that this was in their best interests. Woe to us who without needing it have received in earnest more than enough reason to say you will never see our harded earned cash again.

I also had this problem. Here's what helped.
1. Had the PS3 on a switch below my router. So the connection went from cable modem to router to switch to PS3. I put the PS3 on the cable directly from the router.
2. That improved things somewhat, but I still had occasional disconnects, so I made sure the router had UPNP on, and turned on UPNP in my network settings on the PS3. I did NOT turn off Media browsing, but I've read others suggesting it.
That seems to have done a great job of keeping me connected. Knock on simulated particleboard wood-like substutite, I haven't gotten disconnected once in Rainbow Six Vegas since I did that.
Other things about my setup:
- This is an ethernet (wired) connection.
- I am assigning an IP address to the PS3, not letting it choose its own settings, etc.
- My router is a SMC Barricade 7004VBR 4-port router, probably 5 years old now, no wireless on board.
In the future I might put the switch back and see if UPNP is good enough to keep things running smoothly. I'm having difficulty usng a wireless box for another device under my TV.

As far as I know, Circuit City has taken no further action towards CAG.
I'm assuming my lawyer would have contacted me if there was any news.
If I email her to see what is happening it will cost me $150.
