View Full Version : The best way to get out of a ticket

I just got pulled over Monday and got ticketed and figured I would share some carnal knowledge with you all to spread the love.

Let me give you some background so you can know whether this is good advice or not. I am 26 and am a somewhat aggressive driver and have been for 10 years. In my early days I got pulled over ALOT, but since I cannot remember all of them I will just stick with the 8 times I have been pulled over since I started college in 2000. 8 Stops, 4 citations, and 0 convictions. I am an attorney but just so as not to jinx myself I should disclaim that I get my bar results back Tuesday. Wish me luck. None of this should be considered legal advice in any way and is only practical advice offered from life experience.

The real trick is to not get the ticket in the first place. DO NOT argue with the cop, DO NOT tell him you were not (insert violation here) because this will just piss him off. Know that often times police pull vehicles over not to give the driver a ticket, but to find out whats going on (drugs, DUI, warrant, etc.) Before he approaches your car, DO buckle up (you should be already but if not, do this as soon as you see him pull out or put his lights on), pull over (to the right of course) in a place that makes the cop feel comfortable where he has alot of room to stand by the driver's side of your car. Turn your ignition off and put your hands on the steering wheel, and don't reach for your registration and license before he asks you to get it because people reaching for things they cannot see makes cops nervous. Say your sorry, tell him how poor you are (student, saving for engagement ring, blah blah blah) and politely ask him to give you a break. Be tastefully persistent (politely aggressive) because you really have more to gain than you have to lose. I say "tastefully" because you really dont want to make anything but a good impression on the cop, persistently asking for a break isn't going to get him mad so long as you're not obnoxious. The goal here is to get a break but if you can't dont go so overboard so he remembers you and wants to stick it to you. Be forgetable.

Whether you get a citation or not depends upon alot of things but most important is the kindness of the cop, second is probably your people skills/power of persuasion. Sometimes its unavoidable.

If you get a ticket you, in a timely manner, plead not guilty (no matter what) and send in your ticket, and often times a check as a deposit.

Roughly one week before your court date, GET A CONTINUANCE. Too early and the cop may still show (he will be able to re-arrange his schedule ahead of time), too late and you might not get it. One week is perfect b/c the officer's schedule is made and, sonofabitch, he worked his schedule around a hearing that got continued! Now he has to re-schedule and its a pain in the ass and the chances are he will not show up to the second hearing date. Call the Magistrate and tell them you will be on an out of town vacation. Cousin getting married in FLA always works for me. Use the words "my attendance would be unduly burdensome", this doesn't really give them much of a choice and they pretty much have to grant it.

The continuance is important becasue the 4 out of 4 times I requested it, the cop WILL NOT SHOW!!! WHen the cop doesn't show this helps because with the cop sitting right there, the magistrate might not want to give you a break and piss the cop off.

Assuming you got the ticket (sometimes its unavoidable) show up dressed in a black, navy, or grey suit with a white shirt and red or blue tie and shaven, basically dress like you would for an interview. You will get called in to see the Magistrate and if you've followed my directions so far, the cop will not be there.

It will start with the majistrate saying something like "It says here you (insert violation). Whats your side of the story?" or "Why should I give you a break?" Say something like "I am not here to argue with you, your honor, and the last thing I would want to do is depreciate the seriousness of the offense, but I am just here to ask for the benefit of the doubt. IMO it could have gone either way and I am just asking for some leniency." Obviously you want to tailor these general statments to your facts but you get the idea. DONT be combative and argumentve, DO be apologetic and remorseful. This should work and has worked 100% of the time for me. Good Luck!

With your reckless driving ways and the fact you are too 'cool' to wear a seatbelt (seriously why wouldnt you buckle up? Its not hard and not like you have to move around your car while driving) youre one car accident away from not having to pay any bills or tickets ever again.

the only time ive been pulled over the cop didnt give me a ticket. it was early in the am and i told the guy i didnt realize i was speeding since i just got off from work and was tired and hadnt realized i was on the gas that much. he said watch your speed and i said ok and that was it.

That's why I'd always go the speed limit whenever possible. ;) I definitely want to avoid tickets.

I realize that most of you were just messin with me, but for what its worth I always wear my seatbelt and never drive recklessly.

Ramstoria, note that "recklessly" means very careless and "wreckless" as you spelled it (not a word) would mean I've never been in a wreck (<--with a W).

Actually I have never been in a car accident in my 11 years of driving. *goes to knock on wood*

Drive for 11 years and see if you can not get pulled over once.

0 points on my license, $0 paid in citations, perfect driving record, my insurance rates are cheap ass hell, and 0 accidents. I'm obviously doing something right. I wish more people would have those stats.

I admit it though, I have a bad habit of driving fast. I have a need for speed, but not at the expense of safety.

The best way to get out of a ticket is to be female and possibly start crying, from what I've seen.

The one time I got pulled over I was pretty flustered but very polite and the cop just gave me a warning.

I suppose they're good suggestions (I hesitate to say 'advice' since it's not in an official capacity).

I've only been pulled over once in my 9 years of driving (I'm almost 25) and it wasn't even my fault, the officer saw me, apologized, and apparently mistook me for someone else...and I was off. My insurance rates are rock-bottom too, so I'm extremely happy to stay within the speed limit, occasionally going 4 - 5 miles above the speed limit on I-95.

Try eight times in three years (I've also been followed twice when I wasn't speeding, but whenever that happens, I just pull into some random driveway and pretend I live there). And I just turned 20 like a week ago. Only 4 tickets, though. One warning. The rest just let me go. I guess I'm lucky, though, since about half of those could've potentially resulted in DUI arrests.

Any racial profiling going on? I'm white been driving for 12 years and I have one ticket. I saw a 20/20 special about how minorities are targeted for routine stops and ticketed at a much higher rate then their "white" counterparts. Anyone have stories to share to prove this?

Depends on the neighborhood. I grew up in a latino/black neighborhood and used to get pulled over a lot (but got few tickets since they didn't have anything on me). But when my family moved to the 'burbs in my late teens, I never got one since.

Asking for a continuance 1 week prior is a good idea, just make sure it gets granted.

Some of the municipal hearings I've been in for speeding tickets, I've never even seen the officer show up. The municipal court judge didn't even mention it, so I assume it wasn't an issue. However, I did get a defferment on my ticket, so I assume I essentially pleaded no contest.

I wasn't nervous or anything and the cop said "Damn,are you glad I stopped you because you don't even seem nervous!"I was like WTF?ok.I got pulled over for having my windows too dark.The legal is 33% and I have them at 14%.Shitt....I guess that means I have to have my windows down...

My gf lives in Austin Tx. When it came to cops and race, she didnt pay much attn.

When you see someone pulled over by 1 cop, 99% of the time theyre white.

When you see someone pulled over by 2 or more cops, 99% of the time theyre a minority.


She started paying attn and saw it was true. Theres always a good racist cop story going on in Austin.

In all honesty I wanted to be a cop and Im glad I didnt go down that path because it simply isnt worth it to pull someone over for a legit reason and they end up being a minority and be called racists etc etc never pulling over white people.

It gets old hearing people preach and bitch when a minority gets shot or tazed by a white cop.

Regardless what a cop says or do, if you follow their instructions/orders 100%, your ass lives to see another day without getting hurt.

Try running or fighting with a cop, you deserve every f'n lump you get.

People need to learn how to pick their battles a little better.

Better advice is to not break the fucking law.

Why is it so hard to have people take responsibility for their own actions these days? Instead we wanna find loop holes and ways to no be responsible for our own fuck ups.

95% of the time the cop knows whether or not he's going to give you a ticket before he/she even gets out of the car. The other 5%, if you don't act like a jackass and you have a clean driving record, you'll probably won't get cited.

I would NOT recommend asking for a break. Cops hate that. Especially if you keep asking over and over. Doesn't matter how polite you ask, it's still annoying. I would argue that as opposed to the OP's, "...you have more to gain than you have to lose," isn't accurate, because if they decided to give you a break before they got out of the car, but then you start asking for a break, then they may just give you a ticket out of spite.

Hey Will, I definetly understand where you're coming from. It is better advice to not break the law. But sometimes people like to drive over the speed limit because they think it's too low, or they are late, or they like to drive fast, or whatever. When you do this, you risk getting a ticket for it. Understood.

What I don't get is what part of trying to talk your way out of a ticket, or going and speaking to a magistrate or judge about it not being "responsible for our own fuck ups" as you so aptly put it?

obviously the only good way to get out of a ticket is to start swerving really bad then drive off road, jump out of the car and run around in circles yelling about killer bees in the car. Obviously.

bah all these people complaining about everyone should go the speed limit, must always be on time, never have to deal with traffic, and drive like old women. I occasionally drive from Philadelphia to Pittsburgh, its around 300 miles. My best time is around 4- 4.5 hrs, if I drove the speed limit it would take me over 5 hours. Now 30 plus minutes doesn't seem like a lot, but when you are driving by yourself a decent distance you want to get to your destination ASAP. Also you need to travel with the flow of traffic, which often goes faster than the posted speed limit. I guarantee all you people in your Ivory Towers of Speed Limit Driving go with the flow of the traffic even if its faster than the speed limit, and for those who don't you are being the ones who are unsafe.

Full disclosure, I am a speeder, and i have never been pulled over, knock on wood. Plus I have a secret ace in the whole excuse if I get pulled over, so I am covered either way.

Legal tint isn't dark enough to do anything. You can see right through it and it doesnt block hardly any light.

The trick to this is go to the doctor and tell them your eyes are sensitive to light, and get them to write you like a tint perscription. Just go in their office squinting like hell like its bright in there. Then you can have your windows as dark as you want.
