How long should I wait before I dispute charge?

So I bought a Metal Gear Solid 4 Limited Edition on ebay. Seller claimed it's in mint condition in the description. But when I got it, the front and back cover of the art book is mess up, Metal Gear Saga Vol. 2 case is broken, the limited edition of the case is also mess up and totally not in mint condition.

I contact the seller, no reply. So I filed a dispute with PayPal. Now how long should I wait before I escalate to a PayPal claim assuming the seller don't respond?

Just wait 2-3 days if, the seller doesn't respond just escalate.

Well, now I just need to send it back to him to get my refund.

Would USPS delivery confirmation work fine with PayPal?
