I don't think that will happen. Whether he did it or not, this case is obviously going nowhere from the prosecutions perspective so I can't imagine the judge would deny the motion.

This has already cost Eagle County and Colorado a fortune. At this point the judge is probably receiving great encouragement to cut their losses. A civil suit will be less expensive from the state and county's perspective.

Shame the case had to be dropped, though I think they do have 10 years to try again if they should please to do so. And the civil suit will go foward I'm sure, and has a better chance of suceeding actually due to the burden of proof isn't held as high. Am I the only one who thinks his comments made him sound even more guilty somehow? I mean c'mon he now realizes that she didn't think it was consensual and believe's it apparently. Consent generally isn't a black and white subject unless alcohol or drugs are involved, even then it shouldn't be.
