its not modded. just a firmware update. but nothing modded.

Specifically, look at rule 10.
1. XBMC is still a modification as it completely changes the system functions and is not an official 'firmware' from Microsoft.
2. The 250GB Hard Drive is a modification.
3. You cannot sell it preloaded with movies, music, or games.
