View Full Version : Sent me the game...but doesnt look like the photo?

OK, I recently ordered Zone of the Enders 2 from a guy on eBay, I looked at the photo (here (http://i8.ebayimg.com/04/i/001/26/0d/bb28_1.JPG)) and thought "wow, great shape" so I ordered it. Well, it has a big blockbuster sticker on the disc as well as sticker residue all over the case. The auction said nothing about that...

So what can I do? Am I stuck with it, or should I ask for a return?

you ought to ask for your money back, he probably took the image from someone elses auction because he was too lazy to take the picture.
do link the completed auction in case for any further advise.

You should ask for a refund especially if that was the picture in the auction he provided you with. Do you have the link to the auction still? It might be easier to advise you if you look us to that too.

Yeah, that picture must be one from a previous one he sold because the one in that picture is in perfect condition, and from what youre telling us, it is nowhere near perfect condition.

Try contacting the seller and see if he will be willing to replace it with one that is in better condition for free, and if he is unwilling to, then you can file for a claim that item was grossly misrepresented from the picture given to you in the auction. I mean he should have just put a stock photo if he wanted to use a generic photo, instead of using a picture for a completely different copy of the game. But its up to you.

Yeah thats what I did, I just asked him if he could replace it with one that looks like the photo.

Thanks for your responses guys. And yeah, I have replacement PS2 cases, but the disc...that was a deal breaker. I mean I cant just take the sticker off...it will surely screw the game up, if not...mess up the way it looks. Not to mention I shouldn't have to go through the trouble. Oh well, maybe he will be nice about it...

2. Go to Gamestop.com. Search Zone of the enders 2. Type in your zip code, and attempt to find one locally around your house. IF NOT: Head into Gamestop, and ask if then scan their systems to find a local Gamestop that might have it. Buy the game and do a disc swap. Return the game to another Gamestop. When they ask why you are returning it, say "Oh, I didn't like it! Too boring..... Lame Dingo Erret (or whatever his last name was) etc." Remember that your only looking for the game only (cause as far as I know, the manual and artcover are in good shape). Thats it.

Only one problem with that, Gamestop hasn't accepted discs with rental stickers on them for years. So if he tried that, they would know immediately that it wasn't purchased from them.

and ebay has a thing about the item not being represented right is against their rules. check into it.

I would never buy anything from this seller. He copies pictures from other peoples auctions and uses them in his own. He recently copied one of my listings. I reported him to eBay, but they didn't do anything. The item stayed up and it was sold. Take a look at his other listings. All the pictures have different backgrounds. Then check completed listings for similar items. You'll find the same pictures were already used by different sellers. for example:

Ask the seller for a refund first, if he doesn't respond or say no, say you'll file a claim and notify him that you are aware that his image was stolen, which is against eBay policy (might scare him into giving into your demands). If he still refuses, file a claim and escalate it, that's the easiest thing to do.

Those rental stickers are not easy to remove and may damage the disc (since the data is almost right under the artwork).

It should be a pretty easily resolved dispute. Plus nowadays buyers seem to be able to get away with anything on eBay, so I say file it.

Allright, Ill give him until tomorrow to respond and then Ill tell him that Ill file a dispute unless blah blah blah, and then we will see. Thanks guys

Man, Im still waiting on this guy to respond. Ive sent him three messages now. I decided to give him the benefit of a doubt because I found out he is a CAG and has a pretty high iTrader score (44) but still no word. I wonder what the deal is? Maybe he will see this thread and reply to me finally.

I think 1 week is kind enough. He has enough feedback that a negative wont do much but at least you could try to dispute and get your money back.
And yeah, he seems to steal lots of images for his auctions

He isn't much of a seller If he does that. He should have at least mentioned it had stickers on it or took a picture of the actual game he was sending you. I hope you work it out.

In your position i'd start a dispute in Paypal's resolution center. If he doesn't reply or refuses to satisfy you with an offer of decrease in sales price or a refund with return, i'd then escalate it to a claim in a few days.

Describe the situation to paypal. They are usually very good about it. If an item is materially different than advertised in my experiences paypal will issue a refund.

The paypal reolution center has a tutorial and it's very helpful. The guy is probably ignoring you to see if you will just go away. In my opinion you've gone through a very good faith effort to try and contact him so i'd just open the dispute with paypal and then a claim a few days later if he doesn't cooperate.
