Okay i dont know if i should call the 800 line to complain or not. I went in Walmart and they had TONY HAWK 14.99 in front of the THUG2 game I got one and they said 49.99 im like whooo the ad says right there 14.99 and they said the sticker is in the wrong spot. Well i went back 2 hours later and that same sticker is in front of the same game. Should i call up the 800 line to complain or let it pass

Just let it pass, especially since shelf stickers contain product numbers anymore, they've got an adequate defense.

yea but sticking a price in front of a wrong game and leaving it there isnt that called False advertising. I could see putting in the wrong place sunday but when people tell you its in the wrong place and they refuse to move it then that is something.....
We also had a sale here for a scale for 12.49 and it wasnt the scale they showed after complaining Got another scale for 50% off. so it does sometimes help to complain

I agree to just let it go, but I do think they should take the wrong price down.
Unless they explicitly stated in an ad that the game was that price they're ok. And if you press the point there they can always just say "yeah, it's that price, but we reserve the right to sell to who we want" and then have you removed from the store while they take the sticker off the shelf. It's not false advertising since a shelf sticker isn't advertising, so your only choice, really, is to let it go.

My mom was in Circuit City and she found a DVD that was $14.95, but had the 1 scratched off or something. So she said that since it said "$4.95" they had to sell it to her for that price....and they did.

Yeah its different if the sticker on the game/product says one price and rings up another. I had this happen to me yesterday. I picked up the Underworld special addition and it was tagged 14.99, but rang up 22.99 and I got it at 14.99.

Ive had the same thing happen to me with a psone game at wal-mart a long time ago. but i did get it for the lower price too. just try taking it to a different sales person.

I just did it with Advance wars 2 for the gba at best buy. It ranged $19.99 but the sticker on the panel had it for $4.99 :).

It depends on the situation. Something put in the wrong place means nothing. If there's no way of showing it was a mistake or misplacement (like, the price is stickered on the item), then it has to be sold at that price.

If the sticker clearly states that THUG2 is $15 or there is $15 on the packaging they are required by law to honor the price unless they have already posted a correction.
If it was in the wrong rack, in other words THUG is $15 and they just happened to have THUG2 in that rack, that's not their fault.

While I do appreciate what D2S is saying, as a consumer let me say,
BAIT AND SWITCH
It's an illegal practice and they should be held liable. As a store you can't lure customers to the cash register and then suddenly switch the parameters of the deal you're offering. Of course Walmart is an 800 lb Gorilla so you won't even get the time of day unless you are a card-carrying class action lawsuit lawyer.
My advice, unless you're trying to make a point on principle, it's not worth it.
D2S - when you see him coming, just call your manager :wink:

That happens a lot to me at my Walmart. They put stuff on the wrong shelves a lot. I often have to look at the little sticker thingy on the shelf and identify what game is for that price. Contrary to what some people are saying, it is their fault if they put it on the wrong shelf. It's the employees responsibilty to put the correct game on the correct shelf. If they run of out room, thats what the back is for. They are not responsible for matching the price though, because the sticker clearly states what game the price is for. However, if they stickered the actual game, I mean the singular game, right on the cover, with that price, I'd take it to the manager. Or the 1-800 number. So if its the first situation, don't bother taking it up, those people are just morons. If its the second situation, follow it, because the people are still morons, but this time its on their dime :wink: .

Not true. A few years ago, I was in Kmart, and they had MS Flight Simulator marked for $19.95. It rang up for $49.99. They said they put the wrong sticker on, and took it away.

Well, I had a similar experience awhile back at CC. They had stocked all of the Zone of the Enders 2 games where the ZOE1 games were to go. In front of them was sign that read $19.99. I simply asked if they would honor that price as all the ZOE2 games in the store are behind that price tag, they said yes, no problem and they then removed the incorrect signage.
When I worked at Target, it was a huge deal to stock the proper item in the proper place behind the proper tag, otherwise, we were told to honor the mistake and promptly correct it.
If that Wal Mart stocked all of the THUG2 game in the wrong spot behind an incorrect price, and refused to honor it and then failed to correct the signage, then yes, I would make a big deal about it. If they don't want to honor it, then that's poor customer service and if they don't fix their mistake (as they had failed to do 2 hours later) then it needs to be brought to someones attention.

Albeit it is pretty unethical (especially if done intentionally), no, they don't have to give you that price. Most stores, if they understand their bottom line, wll do the right thing and give you that price though. I know I do at my store.

They aren't required by law to sell it at that price. Legally speaking an advertised price or even a sticker price is only a quote. It's not a contract between the store and the customer. Quotes for a price don't have to be honored by the seller. Don't believe me, ask your own lawyer.

keep going up the chain of command. i find that if you dont like the response you get for someone, talk to thir manager. eventually, they will give it to you for the stickered price just to shut you up and get you out of the store. i find the squeky wheel gets the grease. try dressing professionaly, if you look like you just walked out from the street, they tend not to want to help you, if you dress professionally, they tend to think that you are someone important and they will tend to pay attention more to what you want. dont take no for an anwser......

There is a difference between a price tag placed on the item and a shelf tag. Also every state has different laws on this.

False advertising would be putting the price in an ad and not honoring it or something to that effect. A misplaced item isn't false advertising. And just because the person working there didn't look to move it right away doesn't make it wrong either.
Labels in every store tend to have SKUs on them for the item, that way you know which item that sticker was intended for. Often items are mistakenly placed in front of the sticker for a similar product with a different SKU/model number. It's not like it was a sticker on the THUG2 box - if it was on the box, then they should have to give it at that price.

The stickers on wal-mart shelves clearly identify the item they match to and the barcode. This is not bait and switch and you have no real grounds to get a price change on a clearly different product that was accidentally stocked in the wrong location by some poorly underpaid nightshift employee.
Now, if the sticker was for the item you were buying or actually on the package, Wal-Mart would honor the price.
People try to go too far for a deal sometimes and end up making places like Wal-Mart change their policies (and not to our benefit). I remember when you could take literally anything back to Wal-Mart, no questions asked. People abused that and now it is much harder to return items..

tell me about it. my sister got a item at walmart last satuday for 22 bucks walked out to the car drop the recept someplace between the store and the car. She then found out the thing wouldnt fit on the wheel of the car and tired to take the item back, but they wouldnt take it back cause of no recept and it was only a matter of 5 mins tops

Don't get off on a tangent here, lady. There was nothing wrong with this situation on Wal-Mart's part and someone suggested complaining until they got sick enough of hearing it to give you what you want. That's weak beyond belief and the sad fact is it works a lot of times. I could name a bunch of other stuff that's bad in this country too, but it would waste a lot of everyone's time since it wouldn't pertain to the topic at hand.

Many companies are getting smart- just like consumers are with websites like this.
The customer is not always right- especially when they are the bottom feeders that are not providing money for the bottom line. Companies exist to make a profit, and without that profit, employee's get laid off. Like an earlier post stated- it's capitalism.
If you don't like it you could always go to a maxist country somewhere...... just make sure you tell them that you expect to live well and are only doing it for cheap and free stuff.....

i think america is sick of getting jerked around for their hard earned money. if i take time out of my day to drive to store and then try to purchase something and then the cashier tells me the stickered price is wrong and wont sell it to me for that price, i would be very angry, wouldn't you???? we are all sick of this crap, if the store can't keep up with the pricing stickers, than it should be their loss.

Also Im pretty sure there was a barcode on there with numbers below it, if the numbers dont match the numbers on the game, then there is no false advertisement involved end of story, no matter what you do you will not get the game, because this is what a manager would go to if it ever got up that high trust me I did it before, and I was wrong, even if they stocked it in the wrong place there is absolutely nothing you can do. Deal with it
