You guy all know what e-reader games are right. I thought so. Well I put some e-reader games up for auction and heres what happens. Now I just pasted the text from the emails that she sent to me so read them from the bottom to top to read it in chronological order. All of the words in caps are hers and I did not do those. She actually sent them to me that way. I'm noe sure if it will transfer to this post but she actually did some words in like a size 20 and in red color. Just another example of another stupid ass gamer.

i wouldn't refund a penny of it. do you have a link to the auction? it is not theft if you said e-reader games, since they are. did you say in the auction that you need an e-reader for them to play? i am not saying that you had to put that, but it might have helped out some of these stupid people.

I dunno, I kind of feel bad. I mean the odds are that she was buying these for her kid. She was probably so proud of herself that she'd be able to give her child not one but EIGHT GBA games for christmas, boy wouldn't they be surprised! And on such a tight income too, who would've thought that the wonders of ebay would've have provided such a great and magical christmas for a little child in a poor family!

Your auction is perfectly clear, and your shipping charge was only a dollar, to boot. I'd send her another email explaining that these are games, encoded on cards, that can only be read by the e-reader, as mentioned clearly in the auction text.
You have to admit, if you had never heard of an ereader, you would be pretty confused by these cards, not expecting them to actually have playable games. I am not forgiving the bidder for being rude, obnoxious, and ignorant, but just trying to see it from their perspective.

Thanks for the support though. I didn't even bother to look at her FBs. I already determined that she was bs from her email. What's funny though is that I totally would have refunded her money (minus shipping cost though, of course) if she had asked politely and in a respectable manner. I have worked out refunds with people before and I know I'll end up doing it again and that's fine as long as it's addressed in a professional manner.

I sold a Frito Lay's Spirit of Obiwan mailaway figure and the buyer whined it wasn't made of crystal... doesn't she know something like that would never be made with the kind of toy safety law we have?!

I'm 99% sure the guy has to mail your item back to you if he does a charge back. How long ago was this? Have you asked him to mail your item back? If he doesn't do it talk to a postal inspector about filing a mail fraud charge, I'm not sure you can, but I'd definitely look into it if I were you.
Crap like this makes me want to start accepting money orders only...

I wouldn't mind switching over to money orders only as well but it really hurts your sales. It seems that money order only auctions typicall go for 66% - 75% of the amount that Paypal auctions go to (from what I have seen when comparing certain items like DDR games or Beatmania controllers)

I'd say you could have been clearer in your auction, but I certainly don't think you did anything wrong. I may not have considered people wouldn't realize an e-reader game isn't a normal cartrige myself. (Seems like common knowledge to me, but I guess there are always clueless buyers.)
I mean you have the picture right there. What did she think she was looking at? Shiny foil packs with super flat cartridges inside?
Took a look at the feedbacks and looks like you left positive after she paid? That sucks. I always wait to leave feedback (as a seller) until the buyer leaves feedback for me. Some don't agree with that, but it's the only way to semi-protect yourself from unreasonable buyers.

Your auction is perfectly clear, and your shipping charge was only a dollar, to boot. I'd send her another email explaining that these are games, encoded on cards, that can only be read by the e-reader, as mentioned clearly in the auction text.
You have to admit, if you had never heard of an ereader, you would be pretty confused by these cards, not expecting them to actually have playable games. I am not forgiving the bidder for being rude, obnoxious, and ignorant, but just trying to see it from their perspective.
I agree with exactly what you said guessed. He made it perfectly clear, there is a picture with what she was getting and if she was ignorant on what she was bidding on, well there's the internet for starters to do some research or to go to a B&M store and check it out, or then again she seems capable of e-mailing him so you'd think that if she wasn't sure on what she was bidding on she could have at least e-mailed him and asked him. Also in her e-mails, she constantly keeps saying that they are GAME BOY GAMES, which technically they are but in the auction they are clearly stated as E-reader games.

Sometimes I wonder if ebaying is even worth it. You get smacked with listing fees, final value fees, and paypal fees. And for every good buyer you get, you get some moron like this woman.
I think you're in the right, the games are clearly e-reader cards. I don't think ebay will find any merit with her complaints.

And to the guy who got ripped on on the $225, if it wasn't that long ago you could file a claim of mail fraud against em and also email Paypal about what happened.
A while back I won an auction for Windows XP for 100 bucks, never got the disc, and Paypal ended up getting our money back. Although they did take it away again but that's because our bank got the money back too.

It is apparent this person did not know what he was bidding on. He was also rude. Howevere as a seller on ebay you will run into people like this every now and then. If your plan on selling on ebay for any length of time you may adapt new ways of dealing with people like this.IS the negative feedback he left you worth it?Sometimes it's easyier to give them a refund and avoid all the aggravation. Nobody likes to threatened with negative feedback.
It's simply a matter of customer service . Being right which you are = negative feedbacks.Remember when you sell on ebay you are the CEO.At any rate don't lose and sleep over this.

I hate when people ask to end auctions. Even worse is then you have an auctions with no bids and a buy it now and someone asks if they will bid, you will end the auction early for them. I once had a game up for sale, starting bid $12.99, buy it now $14.99. They asked if they could bid $12.99 if I would end the auction early because they needed the item for a gift. I told them I would not end it early (especially because if someone else bid, maybe it would even go above $14.99). If they really wanted it that badly, they could have paid the $2 more and used buy it now.

She refused to accept that and fought and fought with me. I explained that when someone goes and buys a "new" car the moment they get home with it first they still refer to it as new because it is new still. And therefore the game I sold had literally been used once and the instructions had no marks . This was as mint as you could get without the wrap.
I ended up having to give her a refund or be exposed to negative feedback... what a joke sometimes.

Yea, you were definitely in the wrong. Its been played, its no longer new. You can say nearly-new, mint condition, played once... but not new. I'd even recommend not selling a game as new even if its never been out of its holder but had the shrink wrap removed.. all its going to cause is complaints and neg. feedback.

I cannot believe this has been debated this long. If I went to Gamestop and bought Viewtiful Joe and it happened to be their opened (display case) game. The shrinkwrap missing..... They are selling me it for new price and consider it new. it even falls under their new game rules for the sale.
Then When I get home I have a new game as its new to me. Whether it has been out of that case or not I consider the game new. As in my example its a new car at least for a few weeks if not months after you get it. You dont walk over to the neighbors and say hey look at my used car, do you?
Also the game didnt just appear in the case. The case was not built around the disc. The game was put into the case and then shrinkwrapped. so every game is not new then correct?
If everyone here wants to start living by the definition of the english dictionary so be, it but american definitions/interpretations are much different. This isnt even my thread. I was making a comment and showing my story (which I refunded her money etc) to show that not all ebayers read or even look at pictures.... how this happens I have no idea. But thats what happens.
I am not debating (until provoked) whether I was in the wrong or not. It was opened but new. Me touching the sides of the disc for a total of 1 minute dont effect the condition of the game. What effects it is the shrinkwrap and wear. I stated that in the ad. My ad had been taken care of some time ago. the point is people dont read.

Its easy to tell the difference, new is not used, used is having been played, ever, even for 30 seconds. Your girlfriend tried the game out, it was in your console, its been played.. it is not new. I can't believe you're having trouble with this concept.

No I will say it again. I understand everyones point of view... I corrected the problem and she was extremely happy with the result.
I am also pointing out that would refer to it as a new game when talking to someone about it. Just like a person who buys a new car.
I understand that by definition and technically I should have stated "slightly used",or "like new". I didnt and thats that. i refunded her a large portion and all is well.

I have to agree with everyone that when I see something listed as new, I expect it to be factory sealed. I have seen auctions where, like your auction, it was stated new but the picture showed an open item. It gives me the impression that the seller is somewhat dishonest somewhere in the description, and even if I was looking for a like new item, I probably would not bid on that auction.
I purchased a "new" book off half.com, but it was used. A book is a harder case, since they're usually not sealed. I knew it was used because the guy who sold it was telling me how he was hesitant to sell it because it had really helped him out in school. So upon hearing that, I was a little pieved that his description was misleading. There were signs of use in the book too (pencil underlining). The point of this story is that there a people that think like new = new, while a lot people feel there is a significant difference. (That's why new and like new are totally different categories when you list things.) New is like you bought it new from a store, and an opened item doesn't go under this (including the cases of display copies, i believe).

You were wrong. New is sealed like said by everyone else. Sure you only played it once but can you prove it? NO! If its sealed there is little to debate but I have games 3 years old that are mint and i could say its New but its not. If you want to use your car example you prove our point yourself. If you buy a car, as soon as you drive it out of the place it isnt considered New anymore, if you went to trade it in somewhere else are they going to give you as much as you paid for it NEW? No. This is because you have owned it and have used it. Therefore its new to you but its being used by you, as soon as you go to change ownership its used!
The game being put in the case has nothing to do with it being new or not. Shrink wrapped is also different from truely sealed. The fact is that if the game is sealed it proves it is new and never owned by anyone else. You can return pc games sealed but by law you cant(unless defective) return it once its out the package. Why? Its not new anymore and even if you say "Hey i didn't burn it, why cant i return it?" there is no way to prove that you didnt just like there is no way to prove your game hasnt been played for hours upon end.

Agree with Weedy. New means it is sealed, not opened, and warranty / registration has not kicked in. What I hate in eBay is the following...
"New, but opened to make sure contents were inside."
Huh? WTF? How do I know you didn't just burn the fucker and now you are selling it as new?

Ok- just for everyone's clarification-
New equals = Not opened, never used, factory sealed.
Used equals = if it does not meet all of the above, it is used, period.
Future shop tried to sell me a $150 Thurstmaster when I had a coupon that allowed me to buy the joystick, one game and get a game for free
(back in 1996). The manager tried to give me a re-sealed F-16 (model)- I said hell no, I'm not taking that used one, and took a brand new one off the shelf- he was pissed because he knew he was losing money but there was not crap he could do about it. Basically they were being dishonest trying to give me a used product resealed as new- they were trying to be unethical.

Ok once again I have always agreed I was wrong about the listing. Never once have I said I wasnt. This whole thread proves my point about people not reading. What I am saying is the word new can be understood a few different ways.
If you had a helicopter fly the damn car from the factory exit to a dealership they wouldnt give you what you paid for it!! They are in business to make money. Do they sell it for what they paid you for it? Nope. Thats a terribly example.
Plus lots of cars are technically used when you buy them... I mean did you test drive it before you bought it? If so then I would like to have you ask the salesman to give you a few grand off now due to the car being used... he would laugh at you, or be nice about it, but the end answer would be no. Its not going to happen its still a new car...

I will restate this for the last time in this thread. My used game and my ebay example had NOTHING to do with the fact that it was NEW or USED. It was the point of someone not reading.... Just like some dumb ass is not going to read this reply of mine, and make another comment on how I was wrong. Lets see who that lucky winner is shall we?
Playing a cd is not going to hurt the cd or the information if you played it for 1 minute or 1 million minutes. It has still been used and I understand that. I did not list it under the category of "NEW" I listed it in the "used" games area. I said in my ad it was new two words later I said it was opened, and explained my reasoning backed by pictures. I did nt state it as new in the title. Big difference.
What I tried to clarify is that some person didnt just play the crap out of it and get their hands all over the thing. Throw it around in their bookshelf and pile of games then try to pass it off as new. I wanted to explain this comparison. That if you opened a "Factory sealed / shrinkwrapped" game and but them both behind your back and picked one they would look,smell hell probably taste the exact same as mine.
so how many times do people have to tell him exactly what he's trying to tell you? damn, lay off the guy. He was wrong, he admitted it, and you're still giving him grief. WTF?

You guys are all way too nice to stupid ebayers. When I sell, there are never any refunds for any reason what-so-ever. I give an accurate description of what I'm selling, take a picture and that is that. If you bid on it, then you're stuck with it.

Used equals never not opened, and never factory sealed....
on top of that the game was opened before the game was sealed so nothing is new by that definition. You guys all want to get technical. Its like what came first the rooster or the egg?
your example in comparison is not the same as my listing. I never said it was sealed. I never reshrunkwrapped it. I never hid my pictures..

The registration and warranty... How the hell would any company know when you bought that game? I mean do you think they would honor an ebay receipt anyway?

ok I lied ( I do sell on ebay) but I should have waited a few more pages of replies to my post before I said that just to further piss people off.
Now I know why Jimmie Mac used to do this to people its great entertainment.
