View Full Version : QUick question. IF the mailman broke my door could i make them pay....

okay it was real windy here saturday and the mailman put a Box of ebgame games between my front door and my screen door. Lucky the wind didnt catch the door, but if it did could i make them pay for the damage... What is werid is usually i would just get a note to pick up the games if the box was too big to fit in the mailbox.... I called the main office and told them please dont do it again but they acted like it was no big deal

I'd think they'd have to pay if you made a stink about it. They didn't deliver it to a mailbox or to the recipient themselves, so it's basically like tossing the parcel into a sewer. It doesn't matter that said sewer happens to be your front porch.

like i said before about the game that was a pure and simple accident . it could of happened to anyone, i myself have dropped some o f my mail when i was getting it out of the box to my car and it was only a 1.99 game and at least they said they were sorry it happened. This on the other hand is a few 100 buck door i just didnt know how common it is for them to jam stuff between your doors

I doubt you could make the mail man pay. Seriously if I was your mail man I would not want to deliever mail to you. You have way to many problems / complaints.

I wouldn't push the issue. My mailman is a total badass. I saw him kill and field-strip a doberman that attacked him. He looks through the mail and eats food samples. If he doesn't like you, he'll piss in your mailbox. He eats envelopes and shits stamps. If your mailman is anything like mine, I'd suggest to let the issue lie.

I'm relatively positive there is a federal law to the extent of absolving the postal service of liability in damage caused by the normal attempt to deliver mail.

However, if he put the box behind your screen door, and the wind later caught said screen door and broke said screen door.. you'd have trouble holding them responsible. Its a normal, accepted method of delivery, and they can consider the damage to be an "act of God".

I'm not sure, but I can say it's happened a couple times to me too.

It's happened to me once or twice. Usually they just leave it in front of the door instead of between.

Folks, it is called the discretionary function exception to the Federal Tort Claims Act ("FTCA"). And, yes, in general it means that the Federal government, including the post office, is not liable for acts involved in delivering the mail. This includes things like negligently delivering a package bomb.

Lol any mailman that would do anything on my property would get pwned by my dad. This actually happened before, it was a snowy day, and our mailman was going about 20 MPH over the speed limit in a neighborhood. He skidded on some slush from the melting snow, and smashed into our mailbox. Now, this wouldn't have been so horrible if my Dad wasn't the finance manager of PA. The worst thing was is that the guy tried to bribe my Dad not to tell his boss, which is my father's employee. Ahahahahaha this happened to two other people, but they didn't report it. The thing that really pissed me off was that he stole some of our mail which consisted of Bills, OXM demos, and other stuff...
