could every store be sellin halo 2 after this blunder? ebgames did this with project gotham 2 like 3 days before the street date b/c iirc wal-mart violate the street date. i even stay have the seal on pgr 2 that said "do not sell until 11/19/03.

One store breaking street date does not give other retailers free reign to sell the game. All it does is open the original store to quite a large fine.

I don't work retail, but I thought that once one store broke street date, other stores in the same locale could also sell the item.

^^This is true. Local. I couldn't call my EB and be like "Hey, someone's selling it in Idaho, gimme the game!"

at gamestop we can break street date, but it has to be someone in our area, your gamestop thats near one of those street breakers might be able to do it... but until someone sells it around sacramento we cant :(

i used to work for the store that broke the date, Meijer. they are a bunch of idiots that run the store, trust me....its a large chain of stores with the same "mom and pop" mentality.....

The funny thing is that the person probably won't get the game until release date anyways. I find this CRAZY. I mean it ended the 4th.
Ships the 5th (hopefully)
2-3 Priority (7 or 8th they'll get it) if all goes well.
Now, does this warrant a $200+ more price tag....NO. However, I would sell the same damn thing.
I wonder how much the LE disc will go for??? Just the 2nd DVD that comes with the LE....nothing more.
I feel I'll get more than $5 for it....if I ebay it.

I seriously doubt MS or anyone else would sue a retail outlet for breaking the street date. Litigation costs money and time and it's stupid to waste it on something like this. Their next release may just happen to arrive late from the publisher, though.

I don't think a lawsuit is needed. I believe there are stipulations in their contract which detail fines for such infractions.

If games follow the same rules as videos/DVDs (and I'm fairly certain they do, just not 100% certain) then it doesn't matter if one store broke street date. That does not give any other retailer carte blanche to begin selling product early. What would likely happen is the one store breaking street date would be reported and future shipments would be set up to arrive on or after the day of release, rather than a few days before hand. There would be no fines involved, at least not any you could seriously pursue legally.
If another store decides to break street date because 'that guy down the street did it first!', they would be subject to the same punishment. And yes, it's pretty lame punishment. However, a store that chronically broke street date on product might have a tough time finding a distributor.
And once again, I'm not 100% on this. Just how it was when I was in the video business.
