Pretty much, any game that retails new for $9.99 or less, or any outdated sports titles are excluded. That's what I've come to look at the list as.

That looks a lot like the last exclusion list that was online at EB, which is now a bit out of date. They added a bunch of games to the list after they took it down from the web site.
