View Full Version : Why are beta discs not sellable here?

If this is the wrong forum, please move it, but I didn't know where else to put it. It's not really about games in general, it's more feedback on a rule than anything.. anyways..

For games currently in beta, I can see why, sure.. but why are old, non-working beta discs like Halo 2, Socom 2, Project Snowblind, etc. not sellable? It's not like you can play them anymore, the most you'll get is a title screen and a "server not found" or something. It kinda sucks collector wise, because dude has a Halo 2 beta disc and I wouldn't mind having that in my collection just for the hell of it. They're as useful as a coaster, so why can't we sell the old, non-working ones?

Well I figured that for currently active betas, but it applies to old, nonfunctional ones as well?

I would think that the betas dont have a limitation on when the "do not sell" verbage runs out so it continues on even after the disc is non functional.

For most betas, it is against the EULA about even being transferred to another party. This just prevents any legal wrangling that may take place.

If we're going by the "do not sell" token, what about Sonic? Full game, sure, but the "Do Not Sell" is still there.. well, "not for resale", but it means the same thing, more or less..

I know for functional betas, I've been told that they're not sellable.

For non-functional/expired betas, Casey informed me that Cheapy says they're OK to traffic in, since they're no longer functional and just collector's items. Which makes sense to me, since if they don't work, they're not usable anymore.

For most betas, it is against the EULA about even being transferred to another party. This just prevents any legal wrangling that may take place.
The EULA might not be applicable anymore if the beta period is up for it, which would be when the title is released. Depends on the wording in the EULA, I'd guess.

I agree with you in principle but you are sorta splitting hairs. Betas almost always include a "no change of ownership" clause so its easy to lump them all together as something we dont traffic here. Yes, there are a few games/demos/etc that also say "do not resell" but having to track down each and every one and stop it would be a clerical nightmare.
Stuff falls through the cracks, hell even modded stuff DOES get swapped around here if the two parties act with speed. The Mods do their best to keep it to a minimum which keeps the possiblity of trouble to a minimum.

If you are banning all "no change of ownership" items you have to ban all Japanese videogames, plus many European and American games.

Selling store credit and gift cards would also be banned, because they are nontaxable "game dollars", and can ONLY be exchange for games at their respective store.
