CHINO – A deputy appears in a home video to order a man to his feet, then shoot him as he tries to stand. The man, an Air Force security officer just back from Iraq, was hospitalized Tuesday with wounds to his chest, ribs and leg, relatives said.
The FBI was investigating possible civil rights violations in the shooting, said Thom Mrozek, spokesman for the U.S. attorney's office in Los Angeles. The San Bernardino County district attorney's office also assigned investigators to the case, a Sheriff's Department spokeswoman said.
Senior Airman Elio Carrion, 21, was a passenger in a Corvette that led a deputy on a short, 100 mph chase, authorities said. Carrion, airlifted to Arrowhead Regional Medical Center in Colton, was in good condition, hospital officials said.
Amateur photographer Jose Luis Valdez told The Associated Press that he shot the video after the car crashed into a wall in front of his home Sunday night. KTLA-TV aired the videotape early Tuesday, then distributed it later in the day.
In the 40-second video, Carrion appears to be on the ground telling the deputy he was in the military and was unarmed.
After the shooting, Carrion asks the deputy, “Why did you shoot me if you told me to stand up?” Valdez said in a telephone interview conducted in Spanish. That exchange cannot be heard on the video.
The FBI was asked to do a forensic analysis of the tape, sheriff's department spokeswoman Cindy Beavers said, adding the audio is unclear at times and it's difficult to determine who was speaking.
“I think it's critical this videotape is reviewed closely. ... We want to know the exact dialogue among the parties,” Beavers said. “It would be unfair for us to make any kind of judgment now without knowing the facts.”
Law enforcement agencies generally allow officers to use deadly force when they believe it's necessary to prevent death or serious injury to themselves or others, said Tom Griffith, a professor at the University of Southern California Law School who specializes in criminal law. Actions such as fleeing from police are not by themselves justification for using deadly force, said Griffith, who had not seen the videotape.
“One thing we know for sure: a person's wrongful actions ... normally don't justify the use of deadly force,” he said.
The deputy, whose name has not been released, was placed on paid administrative leave, which is routine procedure after officer-involved shootings.
A woman who answered the telephone at the Carrion family home in Montclair said the airman's parents were headed to the hospital and nobody at the residence wanted to talk. Nobody answered the door later in the day.
The incident began when the deputy saw the Corvette speeding at 100 mph through a residential neighborhood, Beavers said. Following a chase that she said lasted about five minutes, the car skidded and slammed into a block wall in a middle-class neighborhood of large, single-story homes with tile roofs.
The dark and grainy videotape shows Carrion on the ground next to his car, talking to a silhouetted officer who is pointing a gun at him. Carrion is supporting himself on one arm and his face is brightly lit by the officer's flashlight.
There is some hard-to-hear conversation back and forth, but Carrion appears to be trying to reassure the officer, telling him he is unarmed and in the military. He repeatedly says, “I'm on your side” and adds “we mean you no harm.”
At one point, a voice is heard saying several times, “Get up.”
Carrion says, “I'm gonna get up.” As he rises, the deputy fires at least four shots from close range, and Carrion collapses, crying out in pain.
“Shots fired! Shots fired!” someone shouts.
Witness Joanne Scholten said she saw the deputy yelling obscenities at the airman and ordering him to get out of the car. Shots rang out after he told the man to get up, she said.
“It seemed he lost his cool,” Scholten said of the deputy. “We were confused about why (he) did that.”
No charges have been filed against Carrion. Luis Fernando Escobedo, 21, identified by authorities as the driver of the Corvette, was arrested for investigation of felony evading and was being held at the West Valley Detention Center in Rancho Cucamonga, Beavers said.
Carrion's 19-year-old wife, Mariela, told reporters her husband came out of surgery Monday and said: “They shot me for no reason.”
She said Carrion and Escobedo were at a party at the home of Carrion's parents when they left to go to the store. Carrion was supposed to have returned Wednesday to his unit, the 2nd Security Forces Squadron, at Barksdale Air Force Base in Shreveport, La.
Air Force spokesman Lt. Frank Hartnett said Carrion worked as a security officer at the base. Carrion joined the Air Force in January 2003 and recently returned from a six-month tour in Iraq, Hartnett said.

This airman is from my base and I know about this quite a bit since my office works directly with the local media. He has actually had a real good career in the military and won some awards. People who I know who have worked with him have said he is a reall good guy. Personally this pisses me off and I hope he gets a big paycheck all he was doing was what he was told

To me, that is the most important part of the story. The guy who got shot wasn't even the driver. If the police department there is as bad as the ones around here, the cop who shot this guy will get a commendation. I also liked the part about the cop being put on "paid administrative leave". That's also known as a vacation.

It's a fantastic, quick read. One of the chapters is on just this. To briefly explain, many counties have outlawed high speed chases. For one, a very large percent of them result in bystanders getting injured, but also, what happens is the police officer in the chase gets hit with a tremendous load of adrenaline during the pursuit. By the time the chase ends, the officer(s) is usually extremely worked up, often without even realizing the effect. The human body does very poorly handling the decision-making process at this point almost shutting down and acting without reason. Of the major riots in the las 20 years instigated by police brutality (such as Rodney King), they all began at the end of a high speed chase.

First of all, the Airman wasn't the driver. You have no idea if he was trying to get his friend to stop or not. He could have been completely innocent.
If the driver hit and killed a child, then the cop shot the passenger for no reason, I'd still be pissed.

If someone jacked your car you'd be cowering in the corner of your dash I call BS on that one. WTH are you going to do as a passenger if the car is going 100 mph. If you try to overpower the driver you are going to cause a crash. Now your second scenairo which has absolutely nothing to do with being in a speeding car is different. I would try to overpower the guy since me fighting with him won't inadvertantly cause our vehicle to crash into a barricade. Add to all of this that the airman was drunk I don't know about you but being drunk kills my common sense and ability to make quick correct decisions

Ok, here's the problem with your argument. All the cops knew about Rodney King at the time was that he was speeding and leading them on a high speed chase. They didn't know he was high on PCP and/or drunk, and they didn't magically know that he was going to commit future crimes.
All they knew was that he was breaking the law by speeding and evading the police. Apparently you see things differently, but I don't think that just because he tried to outrun the cops and got caught, that suddenly the cops had carte blanc to go medieval on his ass. The problems that he has had since the incident don't justify the beating he received years ago.
I'm not saying it was racist. As another poster noted, I think it is more of an adrenaline thing than anything else. But regardless of how much of a assbag King might be, he didn't deserve to get treated like that.
This incident in Chino is far worse as the cops shot the guy 3 times! You can see that he isn't resisting at all and he sure as hell didn't reach for anything.

Do you know how many cops get shot on traffic stops? And of those do you know how many of them get shoot because they trusted the person they were stopping even for a second?
Let me tell you fuck tards a little story. My dad and is partner were on a routine traffic stop....the person they stopped was a 62 old lady whos name i am not going to mention......figuring...its just an old lady neither my dad or his partner were not on guard for anything...my dads partner strolled over to the drives side and ask the lady for her license and reg.....at this is the time my dad looked down and started filling out a traffic report something your suppose to do after the encouter...but figuring its an old lady what the hell.
Then......BOOM. Dad looks up sees his partner lying on the god damn ground with his stomach splattered all over the grass. That old lady... shot him with a god damn magnum...killing him almost instantly.
So fuck you guys...you guys dont know what the fuck police officers have to go through everyday. Every second that they work some nut job could pull out a gun and start blasting away...you never know who the hell is crazy. So give him a break...if he thought he was reaching for something....then he had all the right in the world to fucking shoot.
God damn it...i am so sick of people who work the hardest fucking jobs getting no respect at all. Fireman...Police Officers...Army Medics. Those people risk their god damn lives everyday for absolute shit pay so that you can feel a little bit safer at night.

I saw it this morning on MSNBC and its not quite a clear cut as what it seems. First off, its difficult to tell WHO says get up. If it wasn't the officer that fired the shots then it changes the situation quite a bit. There were two people in the car, and despite only 1 cop being on tape, there had to be many more officer. Now, what if another officer was ordering the other suspect to his feet and the one who was shot stood up think he was being told to stand up? The officer who had him at gunpoint may have thought he was lunging for the gun, everyone is different when drunk and its not like this officer would know how this guy is when drunk. Also, unlike what someone said, the officer was only about 1-2 ft away from the suspect, not 10. There's isn't much time to react when someone's only 1-2 ft away.
I don't know about the situation but what I do know is that its kind of sad how quick people are to judge the police. All anyone ever does is sit around and complain about police, calling them pigs, etc. but when you have trouble, what's the first thing you think of? Calling the cops. Then, if they don't get there soon enough, people bitch about that. Its a thankless job that all people ever do about is complain.
I could get into why lawyers are in a similar situation but that's a discussion for another day.

Amen. After being in a 100mph high speed chase everyone is ready to lynch the guy. I dont think he should walk away scott free, or not get sued by the victims family personally. I just dont think this cop should be ass-raped in jail by cons he may or may-not of put away because of one mistake.

First of all, it's not just America, so I don't know why you keep insulting every American posting in this thread (you apparently haven't seen the news whenever a soldier of any nationality in Iraq kills a civilian). And it's not a question of "knowing" anything. You don't know what the cop was thinking at the time either.
The reason people get worked up about cops shooting people is because cops are supposed to be the protectors of the peace. Which does not include shooting unarmed citizens. That's what criminals do. You're absolutely right. We'll have officer's just opt out when they feel their adrenaline get too high. If that means no one's left to arrest a suspect then guess he gets a freebie. Then, for the officer's that do make it through a situation without raising their adrenaline, they will have to arrest a suspect at a minimum of 10ft. They'll toss the cuffs to the suspect and they will cuff themselves and everything will just be hunkydory. :roll: What world are you living in?

I think the key to what he was saying is in regards to if their presence is not required.
Hell in the pissant town I live in, if you get pulled over for a minor, failure to signal...etc, violation you have atleast 2 cars at the scene. With another 2 or 3 that drive by. So at that point, someone has got to have a better picture of the scene or atleast be able to compare the versions of what happened.

Similarly, there are far less complaints filed against single-officer cars. People may want a partner, but when you are by yourself, you take more time, you don't go rushing in, you are more cautious and likely to wait for back-up.
A few years ago there was an assassination attempt on the president of south korea. The person approaches the president, accidentally shoots himself in the leg, raises his gun, shoots, missing and killing the president's wife. the bodyguard draws his weapon fires, missing the gunmen and killing an innocent boy standing nearby.
How long did this all take, 20 seconds? 30 seconds?
It took 3.5 seconds. Movies and television have warped our perspective of how quickly we react, how our bodies instinctively take over, acting in manners there is no previous experience or precendence on which to draw from. The far majority of police officers will never fire a gun in the line of duty. It's not a videogame, you are not detached in the moment andd often not even acting cleary and rationally. That hardwired part of our being that thinks about nothing but survival and self-preservation begins to take over.

My dad and is partner were on a routine traffic stop....the person they stopped was a 62 old lady whos name i am not going to mention......figuring...its just an old lady neither my dad or his partner were not on guard for anything...my dads partner strolled over to the drives side and ask the lady for her license and reg.....at this is the time my dad looked down and started filling out a traffic report something your suppose to do after the encouter...but figuring its an old lady what the hell.
Then......BOOM. Dad looks up sees his partner lying on the god damn ground with his stomach splattered all over the grass. That old lady... shot him with a god damn magnum...killing him almost instantly.
So fuck you guys...you guys dont know what the fuck police officers have to go through everyday. Every second that they work some nut job could pull out a gun and start blasting away...you never know who the hell is crazy. So give him a break...if he thought he was reaching for something....then he had all the right in the world to fucking shoot.

They don't get carte blanche but they do get a little bit of a break. It varies in many jurisdictions between either 3rd degree murder or voluntary manslaughter. Either way the relevant legal phrase is "heat of passion under sudden provocation" or, as its more commonly known, heat of passion. You don't get nearly as severe of a sentence as 2nd degree murder.

Seriously though - at most I'd say the officer should have fired a disabling shot to the leg - not 3-4 rounds to the torso. I've never been shot but I'm thinking one bullet would be enough to get my attention. Althought I'm still not even sure this warranted a firearm altercation - two raps with a night stick and this wouldn't have even made the papers and the airman would be back home right now.

You're right, it seems, to us, that the kid didn't mean any harm but the situation looks a lot different sitting on our couches at home watching a green tinted, nightvision video. The nightvision part is crucial, there was obviously not much light in the situation so it looks a lot different with nightvision than it will in the actual situation.
Personally, I'm waiting for the FBI experts to examine the video to determine who said what and when they said it before I start making any assumptions about the cop burning in hell (as some of the people have wished upon in this thread).

Personally, I'm waiting for the FBI experts to examine the video to determine who said what and when they said it before I start making any assumptions about the cop burning in hell (as some of the people have wished upon in this thread).
I'm willing to make assumptions right now. If you make mistakes in the course of your job that end up with an innocent party getting shot in the chest 3 times, you deserve some repercussions. At least job loss.

The airman was just a passenger not the driver. The cop was like 10 feet from him and he was unarmed a night stick would have worked just fine
exactly or pepper spray. He did say fuck you to the cops though that does not warrent 4 bullets in your body though. It sounded like the cop kept telling him shut the fuck up after he shot him. I think the airman was a little drunk or high, by the way he sounded.

They don't get carte blanche but they do get a little bit of a break. It varies in many jurisdictions between either 3rd degree murder or voluntary manslaughter. Either way the relevant legal phrase is "heat of passion under sudden provocation" or, as its more commonly known, heat of passion. You don't get nearly as severe of a sentence as 2nd degree murder.

If you actually read ther thread, you'll notice that Jlarlee and Grave personally verbally attacked me first. I was just making my side of the arguement, which was that:
A: The passenger wasn't completely helpless in the 100mph chase.
B: That this probably wouldnt of hit the news if he wasnt a Iraq Vet., or he was anglo saxon.
C: That the passenger was no more an american hero than the cop before this incident.
D: That the cop (Though he wasnt in the right) was panicking after being in a 100mph chase and should be accounted for.
E: That we should take into consideration that the cop puts his life on the line every single day.
F: That only moments were taped.

How about a guy who comes home to see his wife cheating on him. He's emotionally crushed in .5 seconds flat, it is next to impossible to disengage, to calm down and act rationally - does he get carte blanche?

Wearing a uniform does not give you the right to shoot an unarmed man lying on the ground.
My point isn't to be taken as a defense for killing someone. He still did that, he still lives with that the rest of his life. I was more answering the question of how this could happen, and how any one of us, in a similar situation it also might happen to. The reaction of posters that this cop is some monster may be accurate, but it also strongly points to human instinct. None of us have enough information right now to condemn him or give him a free pass. But I think it is rather silly to outright call for immediate and swift retribution for outrageous acts of violence against an unarmed passenger. At the very least, the process and procedure broke down and needs to be revised to prevent this from happening and less so remove this one cop from duty.

Revised? Why? It seems to work when it's followed. Unless a significant number of high speed traffic stops end in unarmed passengers getting shot this is strictly this cop's fault. If he's incapable of keeping his head in a tense situation, what the hell is he doing in a uniform?

ok lets get this straight, just because somone says he's an air force officer you're going to believe them? Especially after running away in a car chase? Most people who criticize the officer don't realize how the tension rises in a situation like that. The officer was dumb, he should have just laid on the ground. That's obviously the safest choice because they officer will not shoot you for staying still. However getting up indicates action.

Wait, unless you heard something I didn't then he did what he was told. If a cop has a gun pointed at you and tells you to get up I don't think you're going to stay down assuming he'll shoot you if you follow his orders. The kid even told him he was getting up.

All the officer needs to do is prove that he felt his life was in danger. If he believed that the airman could have injured him in any way...he'll more than likely recieve psych evaluations and two weeks unpaid leave.
Now, the community may put pressure on the department to get rid of this guy. However, it'd be a really tough case to prove that the officer shot the guy for no reason. Even with video.
Either way, both sides lose. The department comes off looking awful and a young man is hospitalized for something that could have been avoided IF, and only IF the proper techniques were applied.
Most departments across the US are starting to train officers for this. I had to take several ethics classes, most of which teach you how to handle a situation similiar to this.

There are some GLARING problems with this case:
1) It states in the 1st post that he lead them on a "SHORT 100mph chase". Short & 100mph don't go together!!!!
2) The driver was let go with ZERO charges filed! WTF!
3) Anyone who ever got pulled over while speeding was "chased". How the hell can the officer get to you without chasing you??
What this tells me is that these were guys that were just speeding.

according to some of the airmans coworkers his friend was proud of his new car and wanted to show him how fast it could go. Honestly I know I have been there done that. I can see why the cop would think the ride was stolen driving in that manner

It almost seems like there's more to the story. I think RedvsBlue made a good point when he said another officer could have told another guy to get up, and the airforce guy thought he was being told to get up.
Ehh...I dont know, I'm pretty torn on this right now.
