View Full Version : RIAA Says Ripping CDs to Your iPod is NOT Fair Use

This is unbelievable. The RIAA must be stopped or someone needs to completely rewrite copyright law in light of new technologies. I can't believe that they can actually take this position with a straight face.

You know what.. Do RIAA employees go home at night and spend their entire evening reading the FAIR-USE agreements that come with every F-ing thing we buy nowadays? They must, because they are certainly getting this rewrite inspiration nonsense from somewhere.
And what constitutes my "fair use" of the songs I've bought for myself. The original artist's notion of trademark law, or some third party agency pressing me not to listen to my music on an iPod?
The RIAA and Jack Thompson and EA should all get together on a small barge and be systematically nuked.
Did I take that too far?

The quote at the end is the best:
"P.S.: The same filing also had this to say: "Similarly, creating a back-up copy of a music CD is not a non-infringing use....""
Yet most cds are copy protected to prevent (or at least more trouble than its worth ... Sony I'm looking at you) you from doing this simple act.
Hopefully this will be the point where the "powers that be" figure out that the RIAA is bat-shit crazy, and stop listening to them.

The powers that be in this situation would be Apple. Granted, they make more money off people buying songs on iTunes for their iPod but ripping CDs to the iPod is also an important component that I have a feeling Apple would not be too happy about it being forced to be removed.

The RIAA is an organization way past its "Sell By:" date... as well as using CDs to distribute its wares. It's the last gasps of the 21st century Luddite*. Instead of bitching & moaning, they should be utilizing the technology to its advantage.

I totally agree. Apple is making a fortune through iTunes and the RIAA is pouring millions into a losing cause. The cat is out of the bag.

yeah i did my marketing report on apple and i came upon an article in mac world saying the RIAA is trying put pressure on apple to raise its price for songs from .99 to 1.99...i thought at that point this could not get an lamer...and than this pops out and makes that even look silly.

This just in:
RIAA Claims listening to cd in car to be in violation of copyright laws.
^Duh, obviously. We should own a seperate copy for every instance in which we want to listen to it. One for the house stereo, one for your computer(scratch that, that's illegal. Cds should never come into contact with computers. Ever), one for your portable, one for your car, and one for work (as long as anyone who hears it buys a copy for themselves). This is fair, and the RIAA is all about fairness. I mean, we're taking food out of these artists' mouths.

Yeah, the RIAA is just pissed they didn't think of it themselves first. Theoretically, if the RIAA were the ones who developed the ITunes structure (exactly as Apple has made it), they could significantly reduce costs and increase profitability since there wouldn't be any overhead except for the actual Ipods themselves. CDs would be irrelevant (they're already that way for me at present - I only use DVDs for my burning) and it would cut out any expenses paid out to middlemen CD manufacturers/distributors. The money saved here would be used to line their own pockets. Even webstreaming concerts would be more profitable as they could charge it using a PPV format like most modern pay-pr0n sites. Right now, that's all the RIAA is doing - acting like a petulant child who can't get his way even after throwing a tantrum.

You know what people need to stop doing? LISTENING TO THE SHIT THAT MAJOR LABELS PUT OUT!!! If you love MTV, American Idol, Geffen, the Grammys, and fuckin' Scott Stapp, then if you copy CDs illegally it is your own fault, and you should be punished - not for pirating music, but instead for ENJOYING SHITTY MUSIC.
If you really want to stick it to the RIAA and the rest of the corporate music industry, don't even pirate their music. Try thinking for yourselves and enjoy the fact that the freedom of the internet allows access to literally thousands upon thousands of brilliant independent artists who will GLADLY give their music to you for FREE. THAT's what will really hurt the RIAA.

For the remotely techno savvy, whatever the RIAA does is fairly inconsequential. You or I can continue ripping and encoding cdsk, downloading work arounds and what not. This ends up hurting and alienating the honest consumers who just want to listen to music on terms that do not equate them to being hosed.
And frankly, the further off the deepend the RIAA goes, the better in the longrun. Public opinion has been loosely behind them and their rallying cry against pirates. But if they start calling the large population who rip cds, whether it be itunes or eac, pirates the backlash will come that much sooner and be that much more severe. I cannot think of any other industry that has such venom towards its customer base.

Man, after all this crap I could care less about copyright law. I have no respect for it at all due to this shit the RIAA has been putting out for years. I just don't care anymore, and it is thier fault! If they had gone about the whole thing in an orderly and sane manner then I might have some respect but who gives a crap anymore? Make them sue us all! Copyright law is not a law I still abide by.

LoL, he mentioned Tetris. Yeah - a Japanese company (nintendo) stealing IP from a Russian programmer who has no way of reprisal because he lives under a communist system, so he gets so crazy about it that he stabs himself, his wife, and his 10 year old son - that pretty much sums up how well I think the current system of IP rights works.

For a little background, the RIAA is jumping on this bandwagon now because people were selling iPods on eBay filled with music. Well, that's illegal. Duh. But they're trying to take it a step further, which is too far and too wrong. I'm all for the RIAA trying to put an end illegal downloading and bootlegging, but this actually violates my rights. And it hurts.

Yeah but that iPod is effectively locked up at that point considering you can't get songs off of an iPod and iTunes will automatically delete any song on the iPod that doesn't have a matching song on your computer.

Is it just me or does anyone else suspect that the RIAA takes these types of ridiculous stances so that when the courts finally mediate it, the midpoint settlement will be more in there favor, while looking like they've conceeded more?

There are workarounds for that, though. THere are ways to transfer the music from the iPod to the computer's hard drive so it can be added to the iTunes library and retransferred...and the RIAA should be well aware of that at this point.
This story is just disgusting, really. It's not like the RIAA is going to prosecute people for using MP3 players, and it's not like the threat here is going to change anyone's behavior. All it does is make the RIAA look bad...again.

The RIAA reminds me of PETA. Remember when PETA passed out the bloody KFC buckets and "Unhappy Meals" to kids at elementary schools without the parents permission? Their point wasn't to educate... that's something they'd actually have to wait for when the child can think for themselves. They used scare tactics on children so they'd have an adverse reaction to their own parents.
"No mom, we can't go to KFC. They hurt chickens."
This whole thing by the RIAA sounds like it's simply there to put fear into the uneducated (and by uneducated, I really mean the un-computer-saavy).

I have the setting in iTunes on manual so I can freely transfer songs to my iPod from my library. My iPod is only 40GB but my hard drive is way bigger. I don't even know what would happen if they tried to synch up...

Not entirely true - that's only if you have the iPod and the computer synched. You can also manage the files on your iPod manually, it's just like another playlist in iTunes.

I'd say that the PETA people were on marginally firmer ethical ground because at least they were telling the truth. A farmer's kids know where meat comes from.
On the other hand, not only is the RIAA investing in scare tactics against the uneducated, they are lying outright about consumer rights.
