Out of all my 6 years on eBay and trading, I never had this problem..until now.
I sold Call of Duty 2 (PS2) on eBay. I shipped out on Feb 3rd with delivery confirmation. It was accepted at the PO and was sent to Jersey Facility on Feb 4th...

There has been no information for the past 2 weeks. Buyer emails me regarding where is the package. I gave them the tracking number and have done my part of the job by packaging and shipping the item out. Unfortunately, I'm not the one delivering it so I have no control or know where the item is exactly.
Buyer has filed a complaint with PayPal and since I attached the tracking number with the payment, PayPal automatically responded to the claim for me with the tracking number to the buyer and it says this..
The seller has responded to the claim and PayPal has notified both parties by email. The buyer has 5 days to decide whether to cancel the claim.
Please keep in mind that buyer and seller participation is essential to the claims process. Prompt communication helps us effectively and fairly manage disputes and claims.
My dad works at the PO and asked the supervisor and they stated that since there is no insurance, I cant file a claim (which I already knew). So right now, its a waiting game as to when the package is delivered or if it indeed infact..lost.
Question is..do I refund the payment?

You know, something funny is going on with the USPS the last week or so. I sent 2 packages out last Monday (the 13th) and through yesterday both were in the same condition as yours - simply "accepted" at my location (actually re-reading your post I see mine hadn't even gotten as far as yours - having left a 'facility'). One of the 2, however, just added "received in Philadelphia" today (Tues 21st), but not yet delivered. I would have expected both to have been delivered last Thursday, and certainly by Friday or Saturday. They were both first class.
The buyers have not said a thing to me in either case though.
I've had priority mail packages take as long as 3 weeks to be delivered. Sometimes they just get lost in the shuffle, but very rarely ever do they actually get lost for good - though I suppose it has to happen sometimes. I would give it a good 3-4 weeks though before being certain it is lost.
But, I agree with the poster above - you are certainly not obligated to give anything back. But it might make sense if it is a small amount and you want to make the customer happy for good feedback. He might just neg you even though it isn't your problem. Maybe you can refund the game cost minus shipping or something.

He didn't buy insurance... not your fault true, that is what the insurance is for. you did your part. the post office didn't do theirs. the buyer shouldve bought the insurance to cover his purchase.

Is that PayPal's policy - they side with the buyer when USPS screws up? How sucky.
Well, the one that said it got to Philadelphia now says it was delivered this afternoon. I give a grade of C- for USPS for taking 8 days to deliver 1st class mail (even with the holiday - it should have gotten there before the weekend). The other one, though, still just shows "accepted" at my local PO - it has arrived at no facilities yet... It is possible the game was actually delivered already but not scanned upon delivery (which has happened to me a few times). But the buyer hasn't said either way, and I ain't asking them :D.

All PayPal needs is a tracking number. And when they filed a claim, PayPal automatically responded for me with the tracking number information to the buyer.

Its optional (they can request for it) even though there was no price. I think from now on, I'm going to add insurance option regardless.

This doesn't help now, but in the future, I would include the option right in the shipping area. It is kind of hard to see there.
Anyway, all you can do now is hope it arrives.

Yea, I'm going to include a price for insurance regardless of auction to protect myself.
I think if it says not delivered they still side with the buyer.
It says enroute. So you never know. I'll just let PayPal takes its course. If PayPal sides with buyer, I guess I'll take the hit. But if it eventually shows it was delivered, I wonder how I can claim the payment again if PayPal sides with buyer.

just wait it out...i had packages take up to a month to finally get where they are going...the first time i refunded after 2 weeks and then 2 weeks later it arrived..

It does not matter if they have the tracking number, if the tracking number does not say delivered they are giving the money back to the buyer.

Paypal almost always sides with the buyer for almost any complaint... That's why I've had to abandon a couple of paypal accounts, because buyers tried to get their money back when they didn't buy insurance :-(

Yeah, it has to be delivered for you to win the dispute.
A lot of people on EBay think that if the buyer declines insurance, it is the buyer's problem if they don't get the item. That may be true from a standpoint of just with EBay and not Paypal, but for Paypal if the item isn't delivered, the buyer can get their money back very easily.
I offer insurance as an option as well but anything around $25 or over automatically gets insured (I raise the shipping fee $1.35 to cover it and include insurance in the shipping price).

I'd wait and hope the item arrives in the next 5 days, if not wait and see if it does finally reach the destination then harass PP about it.

Looking at your auction OP, I read "Insurance to the package is optional (if offered)...", yet when I scroll down to the bottom to see if insurance is indeed offered, it's not. So technically, you're not offering the buyer insurance. I'd just keep your fingers crossed that the package materializes on the buyer's doorstep within a few days, but for future reference, make sure to always offer insurance in your auctions.

Take the hit and do the right thing. He's your customer, if he didnt get it, then do what your would expect the seller to do for you.

I'll prolong it and hope the packages arrives. If PayPal decides to remove the payment, I'll contact the seller and notify them that if the package does arrive, I expect the payment for the item and that I'll be checking the tracking number often to see if it was officially delivered.

If the package does arrive you may even be able to appeal to paypal.

Youre absolutely right. However most people will use the Pay pal chargeback loophole. As far as pay pal is concerned, its up to the seller to make sure it gets to the buyer. If it arrives after they give him the refund, you can go back in and get ahold of pay pal to show the delivery and they should reverse the reversal.
Well one of the two packages I sent via 1st class mail last Monday (the 13th) arrived yesterday (the 21st). The other still just shows "accepted" at my location, not even progress to a sorting facility. The buyer queried me about it today but they seem satisfied with the DC for now so they haven't requested money back from PayPal yet. The good news is that of the 2, this is the one that DID pay for insurance, so I'll be OK either way. I've never had to do a PO claim for insurance, but I imagine it is pretty easy if their own DC tracking shows it never gets delivered :D. But of course we need to give it another 2 weeks or so first.
The thing is, I don't usually get DC when the buyer pays for insurance, but because of all the PayPal horror stories I've read on CAG I have decided to get DC all the time now. In a way it is better "insurance" than the actual postal insurance :D.

PO workers claim that you can tracking insurance slips. Technically you can..just not from our end. We cant go to the usps.com and track using the insurance confirmation numbers. This can only be done internally through the Post Office. This is even stated that you can not use insurance slips as tracking. I think I should print that out and shows the dumb workers at my PO and show that and stop giving false info about that. My dad who works at the PO even said you cant track using insurance slips.
This is one of the reasons why I now require insurance.

I think I might have to do the same as well. But I prefer to just make insurance and option. Doesnt cost or hurt me to include it into the auction. I have changed the templates for all my auctions to include insurance as an option.

So as long the condition is stated as exactly and described to its fullest extent, there is no problem. I can understand stating it NEW and there are scratches or damage to the manual or case. But whatevers.. all my customers have been very very satisfied.

Welp, PayPal sided with buyer and has deducted payment from my account...now I'm just crossing my fingers that it arrives. I have already informed the buyer that I'll be checking the delivery confirmation to see if it was delivered and that if it does, I'll be informing PayPal.

USPS is stinking the place up right now, it's not just you. I have customers who are still waiting for 1st class packagaes that were shipped the 5th to arrive. Is there anything we can do class action wise to make them take some fucking responsibility for their system? Is UPS even feasible for single video games?

There is nothing we can do except wait. Its probably shoved under somewhere. Just cross your fingers.

Not unless buyers will pay $11 - $13 for shipping for 1 game. I shipped a Gameboy Color game UPS a few months ago, the weight was less than 1/2 a pound and shipping was almost $9!

Well as a buyer myself i bought an item on the 14th of feb. i contacted the sell after about a week. insurance wasn't offered but he said he would do some checking on his end after he got home from his vacation in a couple of days. so i waited a few more days he contacted me said there was nothing he could do but asked if i would give it a couple more days so yes i gave it a couple more days then still nothing. he sent me an e-mail today and said he would give me a refund if it did not get here by the 5th. before i responded i went to check my mail and low and behold there it was. i only wrote this so that you would know that there are a few ppl out there that have some patience. i'm still new to ebay and this site so sorry if this just doesn't help.

My package that I mailed 1st class on Feb 13th finally got delivered on Feb 25th. It has been a slow month for USPS.

This package has been a month since being sent. Tracking number still shows that its enroute. I have sent packages from trades and they have arrived already.

He has emailed me twice, saying "Where are my dvds? its been 18 days ive been patient but i;ve had it. And dont give me that tracking number I just want my dvds"
I told him if the package really is lost i would give him a full refund, but media mail can take a while, media mail is slow and cheap, i suggested next time he use another shipping option like priority(which is fast and expensive) and i havent heard from him since. After checking his feedback, i regret leaving feedback right away heh.

you thought wrong. Ive been doing it for years, i do it on all the dvd tv seasons i sell and it works perfectly. BUt media mail is slow sometimes. It usually takes about a week, but with my luck the one package that is taking forever is going to an impatient buyer that likes to drop negs.

I don't ship media mail anyway. So do you just put delivery confirmation on it, or some other tracking?

A package that shipped on the 8th from California just arrived today. There really must be something going on with the postal service.

Well, I just checked the tracking number and my package was finally delivered. It was sent on February 3rd and delivered on March 14th. Since the buyer filed a complaint with Paypal and PP favored the buyer since it wasnt officially delivered, they took the money out from my account and refunded the buyer. Now, since its delivered, I have to find a way of getting the money back either complaining to Paypal or having the buyer send me the payment. If not, I'll have to file mail fraud.

I'd call up paypal and file an appeal. Or you can talk to the buyer first to see if he will just re-send the money.

You are 100% guaranteed to lose the money and the game. It has happened to me before. The problem is also if someone at USPS didn't do their job and scan in the delivery confirmation also, you are screwed.

Yep. They base their decision on the status of the tracking number.

Called up PayPal. They reopened the case and made an appeal. Its on review now.
