View Full Version : Ebay, half.com ethics. I have a problem

I relocated this from the Vs. section.
On the 13th I ordered quake 4 from a seller. After waiting a week I sent him an email, just asking if it was shipped, no rush. He said it was "returned in the mail". Likely story. He said he would ship it out that day (the 20th). I finally got it on the 29th and it was postmarked the 27th. It was also sent in a mailbox with stamps...like he couldnt find the time for that 2 weeks ago. Anyway I figured that was fine as long as the product was ok. It was listed as "Great condition" it looks like a retarded infant with sandpaper fingers owned it. It seems to have gotten stuck in the dvd tray so he must have yanked it out. I had a friend buff it and the deeper scratches still remain. It plays ok but seems to have longer load times than my friends (my 360 has no issues). I am also worried that these scratches will cause the game to fail at a certain point since I only played the first level so far.
Anyway I emailed the guy with a test. I told him I didnt get the game yet and he replied that it was sent back to him again and my adress must be wrong...I verified it with him the last time and never had trouble before. But the thing is...he told me he will ship it again on monday so hes obviously lying to me. He lied about shipping it....even when I have it in my house! And he lied about the condition...should I just file a non recieved item? I would like to just return it,,,but I have a feeling this guy will just take it and not refund my money.

he has 607 FB with a 98.7 positive. And some of the negs are returned with no refunds.
he doesnt do a whole lot, but enough...My guess is, he screwed up his disc and maybe it had trouble at some point and he said "Oh well I will put it up as "like new" on half.com and somone will buy it and not say anything. Personally I try to be as honest as I can. I really dislike the idea of doing this since I dont even want a game so fucked up. But if I let on that I got the game I get the feeling that half.com will take his side even If I ship it back with tracking.

did he use delivery confirmation? if not, just file the did not receive option and half.com should take care of it, because you sure as hell aren't going to make any progress on the "condition" argument.

Nope. he just used stamps...and took 2 weeks to do so...and now after my friend used his store industrial buffer. it doesnt look as bad (the deep scratches are still there though and I would never accept a disc in its current condition).
I just dont like the idea of ripping somone off...but I sure as hell would rather do that then have him turn all this around on me and leave me with a loss.

For him lying multiple times even when you received and he said he'll ship, I would file a "non-receipt". He has no proof. I would never of accepted the game. If you did send it back and he didnt refund you, you could file for mail fraud. This will make him cry and crap in his pants if he got a legal letter stating that legal actions will be taken if not resolved.

This is a little confusing for me... you say you don't want to lie, yet you lied already and you're pretty much planning on lying again.
What bothers me is that you never specifically discussed the disc condition with him. For all you know, you could have told him you weren't happy with the quality being misrepresented, and he would have given you the money back. But now that you've sanded the disc (twice?) and lied to him about not receiving it, I don't think it's right to just go ahead and file a complaint that you never got the disc. You most certainly did get the disc.
And you can't read too much into the fact that he's lying to you. After all, you're lying to him, too. You can call it a "test" or whatever else you want, but that doesn't change the fact that you're both doing the same thing.
Yes, it sucks that the disc is all jacked up, but you should have taken the proper measures the first time. I'd chalk this one up to experience, just let it go, and hope that you don't have any freezes during the game. Or you could technically rip the guy off like you're suggesting, which isn't at all fair to him since you never gave him the opportunity to fix the problem.

You lied about not recieving the item and already altered the condition of the disk by buffering it, ethically I think the only thing you can do is keep the item and leave negative feedback stating that the item didn't arrive in the condition stated.
Don't file a non-receipt claim when you did get the item. Unethical and mail fraud.
He's dumb not to use DC, but he should need that to protect himself from fraudulent/cheating buyers. Don't go there.

I agree on not filing a non-receipt claim. Sure you did get a bad conditioned game but you DID receive it. If he has that many transactions maybe he has you confused with someone else who really did give him the wrong address. Be honest and tell him about the condition. If he doesnt fix it cant you do a chargeback or something like on ebay?

I don't know, but it sounds like you got the game and are worried about it being ruined, if you want to scam someone go to Walmart and buy the game and return it saying it was off the holder and got scratched up. At that point let them take the loss.

sure why not drive up the price of goods for everyone. hey while we're at it let's abuse return policies, so they are eventually taken away.

I never got any replies back from this guy. And now hes got a negative that states "Game Advertised perfect - arrived all scratched. Seller would not reply to email" So looks like im going to have to shaft the bastard...Hate to do it..but oh well.
