Necrozilla - the long story short version is, I think they hit a LOT of people who have content on their systems that they shouldn't. I know my son has been telling me he has been license transferring his friends' DLC onto his Xbox, meaning he's getting the DLC and not paying for it by accessing someone else's account (which is a violation of the TOU I'm sure). Since you can't have DLC that you didn't originally download for your Gamertag, thats a violation of the TOU.

If that's the case, I will be very angry. They should have punishing people before it got six years into the console cycle (came out in 2005, right?).

I had no idea it was against the TOU. I know that's not an excuse, but if they had punished people within the first couple years, I wouldn't have been doing it.

Zune Insider has practically endorsed sharing the Zune Pass with friends.
@mike.m that is doubtable at best. Lets say you have divorced parents you download your content on dad's xbox and play on mom's Xbox. that would hardly be stealing. Most likely after reading some kotaku comments this relates to a exploit involving modded profiles.

Not if you are using the same Gamertag. The point is if you are getting content that is not connected to your Gamertag.

@leylines - I did an update. MS has made a statement about Marketplace Theft specifically, so yes, it is very likely that license transferring has gotten a lot of people banned.
