1. No, for a phantom you basically download it, don't save the credentials on your PS3 and then the resells/host change the password - Then the resells download the game 2nd

2. It is permanent assuming you don't need to get a different PS3 and possibly even HD (I am not totally clear on if a HD upgrade will work or not, I think it is dependant on which PS3 model you have...)
For sure if nothing changes on your PS3, then it is permanent (so long as you don't relog into the phantom account - and also, you have to leave that account on your PS3)
