SK loses case; ordered to destory all copies of TooHuman, X-Men Destiny, & UE3 coding

They were ordered to pay Epic ~$4.7 million, re-call and destroy all copies of Too Human/X-Men Destiny, and also ordered to destroy any and all code they made using the modified Unreal Engine 3.

I don't remember my business law class very well and had to check Wikipedia, but I'm guessing they can and will appeal this decision. Not sure if that will mean they'll still have to pull the games though. They appealed the original decision in court of original jurisdiction and this is the district court decision. They can appeal this decision in the appellate courts, which is basically their last chance (highly unlikely that the Supreme Court, which is the next and final level of courts, will hear this case).

I was just about to post this. I wanted X-Men Destiny when it first came out, but it got terrible reviews. I picked up a used copy at GS today for $20, because I didn't want to not be able to get it later on down the road. They also had new copies for $40, and Target has the game new for $60, all for PS3.

I don't know if there is an out-of-print thread anywhere on CAG, but Tatsunoko vs. Capcom for the Wii is out-of-print now as well due to Capcom's license with Tatsunoko expiring.

Too Human, definitely. Game was an instant classic.

Too Human really wasn't all that bad, so I'm definitely going to go pick up a few copies of it for possibility of future co-op fun.

Wasn't SK the one's who said they had to SCRAP what they did on "Too Human" with UE3 code because it was such a pain in the ass to use given Epic's scant documentation on it at the time.
I remember reading comments around like "beta-testing for Epic" or simiar comments.

That's what this lawsuit was about. SK claimed that they couldn't use UE3 due to the bad documentation and had to create their own engine instead. Epic countersued that the engine SK "created" stole code from UE3. According to the ruling, Epic were the ones telling the truth.

notice how SK were the only ones saying that while everyone else in the industry shipped many, many games on the engine.

Honestly, will likely never know the truth of this matter... Much of SK's case was thrown out by the judge and they where/are in no position (aka pretty much broke by all accounts) to put up much of a fight.

That said they got no one to blame but themselves on this... The lawsuit was a horrible idea to begin with as I doubt Epic would have ever sued on their own.

Destiny, I have not played and likely never will...

Too Human, on the other hand, I will always have found memories off. Though it certainly has its flaws its not nearly the bad game that people on the internet make it out to be... Just know that it has a steep learning curve which leads to allot of deaths due to having no real tutorial and whatnot.

As for Destiny or Too Human ever becoming worth something... I highly doubt it. Too Human did sale a million units an I really doubt SK will survive long enough to have the money to pay for the recall.
