Not bad. Was reading some of the sellers reviews and it seems they've resealed some of their games. Still, good deal if you don't mind it not being factory sealed or brand new.

Just return it. It's really easy since you have choices of how to return it (drop off, pick up, etc.). Microsoft's online store has it for $27 with free shipping if you don't wanna wait for a deal.
