Was ready to buy it, then I read this neutral feedback:

"the disk was slightly smudged with hairline scratches when i opened it".

So I pass.
 
Every now and then ebay has some good finds. I recently bought a hardened mw3 for $64 shipped. Elite code was used but founder status card wasnt.
 
buy.com will stand behind their products. I think I'll go in for one as this looks to be the only MW3 deal out there...unless Amazon has something up their sleeves to bring it down to 37.99
