it went up to $39.99 a few days ago, and went up again today to $49.99. If it does happen to drop back down I'll probably preorder it, but I'm guessing the frys store will have it for $39.99 or $37.99 on release.

still alive ($49.99 is crossed out, it's 37.99 when you add it to cart). I'm going to end up waiting to see if EBgames has it for $40 when released because I have a big credit there... Frys store will end up having it for 37.99 the first week anyway (probably, like most games).
