I was by no means defending GameStop, but Rhino Games--which, as KungFuOpera pointed out--does accept games that have been opened as new if returned in the last seven days--even the copies that they have gutted for display.

The reason why the new games are unsealed is because there needs to be one "display" on the store floor. So one game is gutted and the case put on the store floor. When you buy the last copy of a game, you get the gutted, "unsealed" copy. Your copy is still new.
