Amazon Third Party Sellers Selling Damaged Goods

Has anyone else noticed recently how more and more third party sellers are advertising "Brand New Sealed" games, and when the game arrives, there was no mention that the case has been slashed and the shrink wrap partially ripped off. I'm getting pretty sick and tired of buying games that are advertised as Brand New then coming in this kind of condition. Some of these are gifts. How the hell am I suppose to give this to someone? At least a few sellers have the decency to mention their games are slashed to hell. What complete BS.
Just file a claim and seller will have to refund you.
I have done this each time its came like this, but I am just sort of sick of having to do this repeatedly with third party sellers on Amazon as of recently. It just seems to be more and more of an occurrence and it makes me more and more angry having to argue with them over the condition of the game and then a couple of them expected me to pay for the shipping back. I would file a claim, but seeing how most of the games are low in price, I don't want to waste my limited dispute claims with these games. It's just irritating, thats all. T___T
Not to defend that sort of listing, but if the game is still mostly sealed (as long as it's the original packaging, of course), it's still brand new.
That's true, but if it has a huge gash going down the center of the case and into the cover art, they should probably mention that too. : (

Oh, I didn't catch that part. Yeah, that should be mentioned.

Another note:

I prefer that nicks in the seal be stated, too, but if the game case isn't damaged, I'm okay with a game being listed as brand new if it's in an original seal that has a nick or two. Not totally related to your OP, but I suppose I could give a bit of background to my position on your specific issue.

If the shrinkwrap is just a little torn, in like a corner or something, I am normally okay with that. But most of the games I've been receiving recently looks like someone just felt like stabbing the game multiple times with a pocket knife then reselling it. So not cool of them to not list something like that.

Most of my stuff has been in pretty good shape with only once or twice being bad and it wasn't too bad getting them to take care of it.

I have a lot of issues with the way Amazon items are listed, but I've never received a brand new game that was anything but. I find that the smaller sellers are much more cautious about how they treat their customers than the big sellers with automated listings, so I've probably avoided most of these issues.

To be perfectly honest, it's the idiots that waste my time and intentionally miscategorize their items ("Brand New!!!! Disc only, no book, no box, poop stains.") that annoy me more than anything else.

Renaissance 2K you are correct. This happened with me and God of War 2 (PS2) that I bought off of Half.com. I did not know that the case was not with the game although the book and special disc was with the game in sleeves. This was depressing and I honestly only witnessed this with a copy of Summoner (PS2) I bought from EB Games which had a case (non-game case + no manual) but the game was cheap. It was a decent game but it was annoying at times.

Anyway, I had issues with Amazon for a Nintendo DS (screen had a few issues with the stylus) and of course it says 'brand new'. However, I received a Nintendo Wii which had a parental lock but the system was in excellent condition though second hand. I usually get games and/or books. I am recently am getting videos but still I do not like the $3.99 ($4) shipping but still I think you basically have to see what people say in their reviews also to help you make a better choice about a buying a product from a seller although you do save money.

Yeah I bought a cheap Condemned 2 off some thirdparty Amazon w/Prime. The shrink wrap was actually fused to the cover and about half-way through opening I realized I was pulling the case apart. I'm guessing heat damage? Game played fine.

Normally it's easy to avoid the cheaters but in my case I bought a barebones black XBox 360 Elite that was stated as "possibly" needing "repairs". It had been opened, was missing its serial number, and was so FUBAR it was ridiculous.
