A recent Sun Herald article stated that an 17-year-old underage teenage girl was photographed topless for The Guy Game, and is now filing a lawsuit to prohibit the sale of any copies that use the girl's image, voice, and name. Since the girl was only 17 when the footage was shot, it renders moot any consent she may have given, according to a lawsuit filed Monday in Travis County District Court. According to the lawsuit, the plaintiff has suffered embarrassment, humiliation, and wishes to attend college, work on her career, and become active in her community and church.
A judge granted a temporary restraining order prohibiting Microsoft, Sony and others from selling any of the games which used the girl's image, voice and name. The game was developed by two Austin software companies.
The defendants include Topheavy Studios, the Austin corporation that developed the game. Other companies that were sued included Gathering of Developers Inc., which designs, develops and markets video games; Sony Computer Entertainment America, Inc. and Microsoft Corp.
