bit more info there. Basically they claim they weren't able to appeal to the env't hearing board in response to the DEP's orders and violation citations. Instead MFS claims the orders were issued and they weren't able to do anything about the DEP's actions.
My feeling (i.e. hope) is that the whole case is thrown out. The DEP employees were basically doing their job. Now, the timing of some of the requirements (filing an order Friday, deadline Monday) were certainly questionable, but overall the actions they took were within the scope of their job.
