I bought a TE MVC 2 stick online new, one of the buttons is not registering, only problem is no stores within the 50 mile radius have it in stock.

Yeah, if there is no more to replace it, they issue a refund.
I had the same problem last year with a 360 Quick charge kit that wouldn't charge the battery. Once they checked to see there were no more left, I got a refund for it.
