Help with a possible trade gone wrong and feedback?

Without naming names, I sent paypal payment for a game and this was the description I was given "No Visible Scratches in original case". When I received the game it was scratched all over and came in a slim very used black case. Trying to contact the person to get a full refund and ship the game back but I am getting the run around. Who can I contact and should I leave negative feedback or neutral if I actually receive the refund?

Tell him you're going to dispute it with PayPal if he doesn't agree to a refund, as they almost always side with buyers, assuming you didn't send payment as a gift. Depending on how he handles the problem, give him the appropriate feedback you feel he deserves (negative for being a punk or neutral for taking care of you).
