How should I settle Paypal dispute?

If you guys took a look at the picture, which I didn't inspect carefully enough, you probably see what the problem is. The guy sold me a regular edition PS2 RE4 game in a gamecube tin box that says special edition. Secondly the games are in horrible condition, scratched up like crazy.

I explained the problem, let him know I wanted to return the games for a refund ($46.09 - $3.09 to cover his ebay fees). At first he seemed to agree but then he changes his mind, first asking if I'm up for a partial refund. I tell him I really want the money to bid on an actual RE4 special edition. Then he gets kind of mad and tells me to escalate it on paypal and that he shouldn't have to bear a loss (I'm guessing he's talking about shipping, but I'm willing to ship the games back at my cost too so we both lose some $)

So I escalated the case, saying I didn't get what was described in the auction - that the guy placed a regular edition game in a gamecube tin and called it the Special Edition and basically the difference in value of the two games is too big.

He put up a partial refund for $20. My question for those who have dealt with paypal - will paypal side with me or will they not see the difference? I really don't want the games but $20 back is better than nothing - if they end up siding with him. I'm kind of worried that they'll side with him just because he has all that feedback.
 
Personally I'd take the $20, even with a full refund you're going to have to ship all that shit back with Delivery Confirmation, then contact paypal after it arrives for a refund.

Here's what I would do. I would request the seller's contact information and then attempt to give him a call. Yes, call him. It eliminates the "paper trail" which is important later. Talk to him and say that the return that you are offering is far better for him than if Paypal decides to side with you on a dispute (which is true). If he bites, then proceed with the refund, if not then start a Paypal dispute.

Feedback matters little to Paypal. If you start the dispute tell Paypal that items received were not as described. Say that the games were scratched and unplayable and describe the RE4 issue that the game you received wasn't as described. Yes, your stretching the truth here but you do want your money back, don't you?

Paypal's process you will need to send the games back on your dime, but you will receive a FULL refund, including your original shipping fees. One risk is that paypal will charge the seller a $25 fee for making them settle the dispute. However if they cannot recover the $25 from the seller, they will take it out of the money that they refund to you.

I'm guessing that the seller won't want his paypal account frozen for the dispute process and will just agree to refund your full payment after you talk with him on the phone.
 
PayPal will side with you, tell them that the item came in a horrible condition (scratched up like crazy) and it wasn't the correct item to begin with. I'd take a full refund and nothing else.

Also, don't ever bid on games with such a moronic listing:

First off: You are not wrong. You didn't "fail to look hard enough" at his pictures.

The RE4 pic is far away, small, and dark. Not only that, you shouldn't have to know that "red = GCN version". The seller says it's the limited edition tin and it's the PS2 version, so that's what it should be. It's up to the seller to know what they're selling. They clearly stated misinformation if they're claiming that RE4 is complete as a PS2 special edition in tin, because it's not.

FYI: Don't call him, he's probably just as crazy and stupid as his typesetting leads him to be.

Notice he only seems to take Paypal? The $25 fee (which I can't confirm) that Dominion was talking about would never be an issue for you with someone like this. High quantity of sales + Paypal only.

File a Paypal Refund Request simply stating the item was not as stated in the auction. If they want more details, explain that RE4 was not the limited edition version for PS2, but was the regular edition in a gamecube case. That sentence alone will be enough for Paypal to understand it wasn't the item you intended to buy. Don't even mention the scratching, you should definitely go with the "wrong item" route, it's much more concrete.

With that said: $20 back if you get to actually keep everything is a pretty good deal. If you get to keep the games and $20, that would probably be the most beneficial for you. If you feel you've been ripped off and want justice, then file the Paypal request and send the games back, they'll side with you.
 
I have been through many paypal disputes on both sides(100% positive on ebay on over 3500 transactions), and could pretty much guarantee that you will win this one. Like other posted stated, claim a couple didnt play at all, and that the limited edition was the main reason you bought this lot and that it is not as stated. Paypal doesnt care about feedback, or the amount of fees they collect from a seller when investigating a dispute. They are pretty good about getting to the bottom of situations. Another option is to try to get seller to up the refund amount, try to get 30$ back and keep the games, seller would probably agree just to save the trouble of the dispute. Also, be aware that with a seller of this integrity, a dispute will probably kiss your 100% positive goodbye, but it really doesnt matter. I don't really care what a buyer's feedback is as long as it is not completely horrible, and I think most sellers/buyers understand that some people are just unreasonable.
 
You would win this. Paypal doesnt give a rats ass about the seller and they would just make you ship everything back at your own cost.
 
Based on my experience if the seller is a big enough ass paypal will refund your money without telling you to ship the item back. I bought dvds that ended up being bootlegs and paypal ruled in my favor as I was able to prove they were bootlegs and told me to discard the fraudulent items.
 
im wondering because I got into an issue today. I bid on an item 4 days ago.. didn't really pay attention. Seems like he had the pic of a stock box of the game. Turns our a few days later (today). I noticed I won the auction. Now he sent me an invoice and and I asked if he could quickly mabye send me a pic with his cam. He was acting all grumpy/mad/angry.rude and sent me a pic.. hopefully it "is" of the game and not off the net. anyways jsut wondering.. what happens if he purposly damages the game and sends it? since technically he never had a picture of the game on the ebay auction.

Lets say he purpolsy damages it cuz hes mad at me.. and i get it wrecked.. what then? would I win a case in a dispute.. or have to end up paying more.. I never been in a ebay issue before, usually I see the game and it's ok.
 
Paypal will side with the buyer almost all of the time. If you don't get what you expected just file the dispute and don't bother contacting the seller. You're just wasting your time. Go through the Paypal process and you'll be okay. If you say something to the seller, that'll give them an opportunity to empty their account and you'll have a harder time getting your money back. Do send back exactly what you received though to make sure and stay on a level playing field. Just make sure you stay honest throughout.

The issue I have is sending it back.. since I'll have to pay for shipping.. Also i should have checked his feedback.. he some good stuf but a lot of negative and bad too. He even said "feedback system is bullshit! People on here don't know how to use it properly!"
 
First mistake was buying anything from someone who lists in all caps. Second mistake was buying all that for $46 online when you could have gotten almost all of that in a GS or EB or GC for about the same price (and quicker resolution for any problems).
 
The all caps should've warned me. But $46 for what I thought to be a RE4: Special Edition, Bards Tale, and (a bunch of games that I could sell back or trade) was a good deal for me.

I went with the $20 refund. I was seriously thinking about having paypal make the decision - I was pretty upset and wanted vindication. But like zionoverfire mentioned, accepting the refund is easier than going through the whole process of shipping back the games.

What was the auction description? If everything sounds alright, you shouldn't be worried. He might've gotten angry because you asked for the pic after the auction ended. To him it might look like you're trying to back out.

And about him purposely messing up your game, I don't think most ebay sellers care that much to do something like that on purpose.
 
thanks for the info jngx and well atleast you got something back.. mabye $26 is worth it for what you bid for?

as for my issue, I'm gonna pay him and see what happens. He seems like he wants me 2 trust him, so I'll try it out and see what happens. As for PP complaints.. I suppose it would be pricy for you to return the stuff.. which is why I "try" to bid on things where it says "I will pay for shipping return too"

I haven't had an item yet that I wanted to return. But it sucks to see this happen to another gamer. 1 reason why i dislike ebay.. you can never really see what your getting vs in person seeing the item.
 
yeah, I could live with it for $26 (it almost equates to buying stuff I didn't want at EB sale prices + a used resident evil 4 that I could've gotten at CC for $10). I'll probably bundle them as freebies when I try to sell other games - the condition of the discs are just that bad, I would feel guilty selling them individually.
 
damn man.. i feel for you.. hope that guy gets some bad luck hitting him soon.. like someone steals his paypal account and jacks his cash.. mabye then he'll know how it feels when he sees 10 grand taken out from his account LMAO!
 
What is wrong with posting in all caps, all my listings are in all caps, and I have 100% positive on over 3400 transaction. I always go out of my way to make the buyer happyu, and fail to see what all caps has to do with it. I do it to save time when typing descriptions. Please PM me with response, as I will probablhy forget to check this thread again.

I think it is because most people deem typing in all caps as unprofessional as it is often associated with the dumbass buyers that e-mail 24 hours after the auction ending with e-mails like "WHY ISNT MY GAME HERE YET" or "WHEN AM I GOING TO GET MY GAME".
