I have the answer to our frivolous lawsuit problem.

Its simple.

Person A sues person B over something and they lose person A has to pay the court costs, the legal fee's of both themselves and person B. And person A has to pay person B double the amount they were trying to sue them for to begin with half of that amount going to the local public school system.

Atleast that way people would think first before they trip and decide to sue someone because they fell in their parking lot. They would have to make damn sure they had a case that was valid enough to be actually fought over.

So what if they had a valid case against someone and lost, they should still pay twice the court costs?

How is suing because you got hurt on someone's property frivolous? If a parking lot is badly maintained and you get hurt because of a hole, why shouldn't you sue?

*If* the parking lot is badly maintained, sure.

We've had people complain because they tripped over the curb, painted bright yellow, and sprained their ankle - and, of course, Walmart pays for the medical bills to prevent the lawsuit. And yes, I said "People" - this has happened on at least three occasions that I personally know of.

It's like that story of how someone was in the process of robbing a house, tripped on the way out and sued for injury. Now as stupid as that seems, if you trip in someone's yard because of hole they haven't filled, isn't that negligence on the part of the property owner? Never mind that he was robbing the place, it could have happened if he'd been there selling magazine subscriptions.

Nothing against you, but in my opinion, that's total bull shit. If I want to place land mines in my yard, I should be able to. Don't trespass in my yard and nothing will happen to you. In fact.... *goes to put trip wire across sidewalk*
