Need advice with ebay buyer opening case

I was hoping someone can help me on how to proceed. The buyer opened a "not as described case". I clearly stated the items are not guaranteed, as-is and no returns. The buyer said none of the games work, in my listing I said only 3 of the 5 worked ONLY in my ps2 (ps1 games) and they are not guaranteed due to condition. Should I even try fighting this or just refund buyer? Here is the closed listing -

Ask the buyer to return the games. You can charge a restocking fee at that point, but I'd say just let it go. Alternatively, give the refund and let them keep the games.

Sellers are required to have a return policy on eBay, from what I recall. The "as-is, no returns" listings really don't mean anything.
 
Thanks, I was just thinking of telling the buyer to return the games for a full refund, just because it seems like no matter what you say, the buyer always wins. I just don't feel like dealing with the aggravation. But if I did dispute the case, and if I lose, does the buyer get to keep the games AND get his money back? If that's the case ill probably just refund. Thanks again.

Once eBay/PayPal sides with the buyer, the case is closed. So yeah, at that point they keep the games.
 
OP,

Your "as-is" preface really means nothing in the eyes of eBay despite it being well intentioned. At this point your best option is to go into the case and select the option "return for refund". It is up to you if you want to pay for return shipping but at least this way your guaranteed to get your items back.

In order to get a refund the buyer would have to show proof by means of delivery confirmation that he returned something (their is no way to prove he actually returned what he purchased unfortunately). Sometimes buyers don't want to deal with the aggravation of returning something so they just let the case expire.

However if you just escalate the case their is no guarantee you will get your items back and you may lose your money as well. Their is a small possibility that eBay would allow you to keep your funds and just refund the buyer out of their pocket but that isn't a win for you as far as they are concerned.

And remember nothing protects you from receiving a negative or low DSR's so stay polite
 
Return for refund. That's your best option. It really shouldn't cost him more than $5 or so to ship them back.

After you get them back, you can sell them as a second chance offer to someone who really wants them.
