This seller has some great "buy it now" prices on a few titles:

Fight Night Round 2 (GC) for $30.95 shipped (This is what caught my attention, bought 1, 2 auctions still up)
GTA:SA for $25.95 shipped (3 auctions up)
+ a few other good deals

Edit: It's not a scam. After a series of e-mails, he actually refunded my payment and told me I can wait later until he gets more feedback. I repeat, it's not a scam.

Edit 3/24: Looks like it may be scam, he shut down his e-mail address. I don't know why he would go to such great lengths to convice me it was legit, refund my money, than pull the rug on everyone. I'm sorry for whatever role I played in this.

He's batting 9 - 0, no negatives so far. How many feedback does it take to convince you??

Yeah, there are definetly some good prices on those, but I'm with thingsfallnapart on this one. After getting scammed once on ebay, this seller would need to have more feedback until I would consider buying one of his items.
9 feedbacks, i dont trust him.
Not only that, he's only sold 3 items. The other 6 feedbacks are for purchases he made.

$31 shipped for DMC3 new is a damn good deal, but the fact that he's selling mulitple copies of everything makes me wonder what deal he got that he's trying to make profit on...
He's batting 9 - 0, no negatives so far. How many feedback does it take to convince you??
yeah, but only three are from him as the seller and they were both for cheap older games. Selling new release games brand new for that cheap seems a bit off. I would need a lot more feedback from him as a seller to trust it.

I sent the seller a question about this. It is very suspicious considering everyone knows how much games cost for the retailers. Unless these are stolen I can't see how they could make a profit. I would love to get two games on there cheap.

Its probably legit...he could have gotten lucky with the Gamecrazy misprint ads on a pricematch (which at least accounts for the FightNight price).

Look at the things that he's sold previous. A couple of used games for cheap. All of a sudden, he's got these brand new, just released games for cheap. That's suspicious. Not saying this is what this guy's doing but a lot of scammers will sell a couple of things legit just to pad their fb a little and then do the big scam.

EDIT: Also, shipping's $3.95 but it doesn't specify how he'll ship. If he claims to ship media mail it could take over a month for it to get to you. By that time, if they're not legit, they'll be long gone.

Here is the sellers response to my concerns:

Hi,
I appreciate your concern. I am not really sure what i can tell you that will put you at ease. I can tell you I got an excellent deal and they are in very limited quanities. Not everything new, i have just not everything listed yet at this point. I guess what i would tell you is wait 3 or 4 days and watch my feedback rise. I can promise but in reallity that is not worth a hill of beans. i would love to earn your business but really there is nothing i can say so I recomend watching my feedback over the next few days and then making up your mind at that point. As for them being bootlegs I can tell you 100% sure these are the real deals and are not asian imports but again that is just my word. i have up to 40 of each and as few as 1 of some so just wait a few days

This is why you look into the feedback of the seller before bidding. I would bet a good amount of money that no one gets these games if they bid.

not only that, he states he has up to 40 of each item!!! that would mean he has more in stock than my local game shops!

yes but i am a local game shop and i got in 50 copies of dmc3 and san andreas when they first came out. sometimes my distribution just has a very good price of certain games (san andreas was $27 each if you buy at least 25 and thats when it first came out!.) i cant say whether he has a real store or not but it can happen if you go though the right channels

Aryss, I'd reply that one thing he could do to put you partially at ease is send you a pic of the actual item.

Although if he is a scammer, it would obviously be pathetically easy for him to just scan a few similar eBay auctions and grab someone else's pic. Although I think it would have eBay's little camera icon on it if he did that right? Or he might just say he doesn't have a digital camera. (Which could be true, of course.)

His e-mail to me

hi
I can not scan all this inventorey it is impossible. If you are that concerned I will be more than happy to refund your money no problem. I do not have a digital camera but i do have a scanner, i can scan what ever will fit on a scanner stood up long ways with your game or movie or box set included. I certainley cant scan everything i have. I will leave it 100% up to you if you want to back out of the deal just send me the item # and i will refund your money. Also if you are wondering these ARE NOT bootlegs or cheap IMPORTS from asia. Not exactly sure what i can do here to make you happy except to oofer you a way out. It is up to you

What do you think guys? Should I take him up on his offer and ask for a refund? Or let this hang?

He could be legit but it is strange. I am very tempted, not everyone is a scumbag in the world. It would be a shame to pass it up and then find out it is a good deal but I am still thinking.

Maybe he got lucky? I was sitting on 22 steel battalion guides a month or so ago, selling them for 25 bucks a piece on ebay. Not the same exactly, but ya never know.

I decided to roll the dice and purchase an xbox game. I've bid and won items from sellers with far less feed back(0) and and they've held up their end of the deal. We'll see in a few days if he's legit.

At least give the guy a chance to prove he isn't a scammer by shipping the item to you. If you had doubts, you should've communicated with him prior to buying the game...

That is just too much inventory for him to be trying a hit and run scam
for whatever reason, he is able to dump items at below cost, if this was 5 years ago, if there were less than a dozen items and if his feedback was at 0, then buyer beware
i wouldnt worry

I just got another e-mail from him. He said he could send a refund now and I could pay him later next week. He made it sound completely legit. At least he has me convinced .

He is responding quickly and clearly. I have more than enough in emails to go after him if something happens. His Paypal is verified which will help too. We'll see what happens.

Update: He just refunded me my extra shipping costs in liek 15 minutes. I think he is legit at this point, just crazy.

Only weird thing I saw is that in the Dragon Ball Z Saga, the description for the GC game says this game's for GC only, and the PS2 one says this game's for PS2 only.

He could just mean that copys for the specific system, I dunno, it's just stated kinda oddly.

Well, pulled the trigger on Fight Night Round 2 for the Cube. Too bad I didn't have more Paypal cash to take advantage of the $1 shipping on additional items. Will post when received.
So it's not a scam, good! Isn't it kinda risky letting you get the item first, then pay later?
That's not what I meant in my OP, he said I could wait until he gets more feedback. I'll still have to pay him first.

Edited my post to make this clearer

I am tempted to pull the trigger on Super Monkey Ball Deluxe, but I think I am going to wait and see on some of you other guys first.

You know, you can't criticize people for not having a ton of feedbacks on ebay. Everyone has to start somewhere.

Really, though, if this guy is selling them at those prices, well, they must be stolen. Those prices are lower than wholesale, in a lot of cases. There's no way someone would be willing to take the losses for no reason.

His prices aren't THAT low... I almost bought Fight Night Round 2 GCN a few days ago... some guy sold about a dozen of them for $34 each shipped. This was only $3 less...

so is anyone buying fight night round 2(gcn) for any reason besides super punch out? seems like everyone wants it for the cube only for super punch out and wouldnt care less about the super punch out extras(FNR2)

OK, what do you guys think of this? I noticed that this guy already got feeback from a FNR2 for XBOX, a day after the auction ended. And he claims to only ship on Wed, Thrus, and Fri. I'm a skeptic! I hope I get my FNR2 for GCN b/c yes, like the rest of you I want to play Super Punch Out!

edit: I guess people may be giving him feedback before receiving the item. That happenned to me today, too. B/C he's got another positive from an auction that ended today. :?

OK, last post tonight.. Invoice came from T Lang (in Bostic, NC). Paypal went to Ken Merck, and the item was listed in Illinois. Is there a certain amount of time that you have to allow for shipping before you can file a dispute? :(
