Should this guy be fired?

Okay, I was at EB picking my pre-orders of GT4 and MVP Baseball 2005 and I can tell within a few minutes that he was a huge Yankees fan. He was boasting that he wasn't going to sell MVP Baseball to Red Sox fans because Manny Ramirez is on the cover. He was even asking the guy ahead of me and myself if we were Red Sox fans to make sure. I just made the joke that I'm from Ohio and didn't really have anything to say in terms of baseball.

If I wasn't in a hurry to get home and play GT4, I would've wished him luck in keeping his job if he came across a Red Sox fan today. Should this guy be fired for making these kinds of remarks that could hurt their sales of MVP Baseball?

I didn't really react to what he said just thought it was stupid to be saying it around the store, which makes me think that he was pretty much by himself.

I think that the poor grooming and social habits of the video game store employees near me far eclipse this guys high school attitude.

These guys are paid to be idiots, seems like he should get a raise.

I don't think he should be fired, becuase he was probably trying to be funny. Of course, I think the manager should lecture him a bit.

Its hard to tell from this story alone. I mean if this was all in a joking mood then definetly not because at least he has some personality (unlike most of the grumpy assholes at my local EB...) but if he was being smug and serious where he wouldn't sell it then yeah he'd need a disciplinin'

No. Every Red Sox fan should not only not be allowed to buy MVP2005 but they should also get a swift kick in the nutsack on the way out.

Not really, I'm sure he was doing it just to try and be funny or whatever. He'd prooably never refuse them the actual sale and I doubt any Red Sox fan would physically drive to another store just because the register monkey is a loud mouth yankees fan (they seem like they are everywhere anyhow). Maybe he deserves a a quick slap upside the head from his manager or whatever, but seeing how it was most likely a harmless/unfunny joke I don't think it would require him being canned.

He wasn't at all joking from what I could tell. He seemed serious about it, since he was even asking me and the guy in front of me if we were Red Sox fans. He even had a friend there that was with him on it, so it could've been a joke, but I couldn't really tell.

doesn't matter what he said, when Oct. rolls around he will be balling like a little bitch.

All Stars teams don't win championships. If they did, the Yankees would have beaten Arizona, Florida, and Boston.

Agree'd

get a life!! and quit calling for peoples heads everytime they give an opinion. its ridiculous that we live in a time where something as stupid as saying your favorite team calls for a repremand. we are supposed to have free speech, but i wonder anymore. now every sentence ends with "but thats ok" so no one gets offended. do you really think that everyone is ok with everything? hell no!! why bother talking to each other if you're just going to agree with everything and say "but thats ok". have an opinion and stick by it people. i applaud the clerk for his remarks!!!! bravo!!!! :D :)  :p

Yea i say we fire him and then take away his first amendment rights.

That'll teach that basterd to use his freedom of speech. He should know better than to pull some of that shit in Soviet America.

You DON"T have free speech.
Not at work, while representing a company. Meeting the guy out front and bs'ing about ball games, fine. If you're *ever* going to be 'politically correct' [ie, trying not to offend people], it's when you are supposed to be 'serving' them and representing a company.

More accurately, you have freedom of speech [all that means is the GOVERNMENT won't kill you or jail you for speaking out against it], but you do NOT have freedom from the repercussions of speech.

What's the difference between "I won't sell a game to a Sox fan because I hate them" and "I won't sell a game to a black/Jew/woman because I hate them." Free speech? Yes, it certainly is. He can say that all he wants--but he wouldn't be doing it at my store.

Should he be fired? Probably not.
Should he get a lecture from the boss? I would say so.

Obviously 'how' he said it would come into play, and we can't tell that from mere text descriptions, but still.

Do priests curse? I'd bet 1/3 of them, maybe more, have said 'dammit' or worse when, say, in a car wreck, or hammering their thumb, etc. Most people would say that's appropriate. Is it appropriate for him to say that at the pulpit on Sunday morning [other than, of course, any legitimate Hells in prayers/sermons/songs/whatever].
Those of you who are "Free speech for everybody anytime!"--how do you feel about the McCain Feingold Campaign Finance "Reform"?

"He wasn't at all joking from what I could tell. He seemed serious about it, since he was even asking me and the guy in front of me if we were Red Sox fans. He even had a friend there that was with him on it, so it could've been a joke, but I couldn't really tell."

good job contradicting yourself

well, he's not a priest. he sells video games. and if someone overheard him talking about his team, then so freakin what. you are a wuss if you can't handle something like that. once again, i applaud the clerk. bravvooooo!!!!!

Sigh....
You don't have a right to free speech while you are working if you are working for someone.
That 'free speech' argument is a bogus, feel-good, 'whos gonna argue?' red herring.
Let's say he feels the same way about Nintendo. he's not going to sell any GameCube games because he hates the Nintendo. Is that acceptable? Or again, he says 'I hate women, so I'm not selling games to women." He has every right to have that opinion and express it on his own time; he does not have the right to express it when he's working.

And you aren't even arguing the same thing. "if someone overheard him talking about his team" As in, he's talking to a coworker about it, or during a smoke break? Fine. But when he lets personal opinions affect his doing his job, or his treatment of customers, that is wrong, and no longer a 'free speech' issue, not that it ever was.

Good points all....but in the end this is dumb.

If he gets fired from his minimum wage job for this stupid shit, he's better for it.

You should have said, Yes I am Sox fan, what are you going to do? Sell me my damn game. OH no? *Calls up EB disctrict Manager*

FIRED!

um, yes you do... I don't think there is a carve out for "while you are working for someone" in the First Amendment. You might get fired for not doing your job to your employer's liking but that has nothing to do with free speech at all.

He most likely was kidding..but the people that applaud him for using his free speech are morons. That is not an example of using free speech.

I'm sorry, but the stupidity of your EB compared to my EB does not even come close. The people at mine should be fired for working in a video game store and not know crap about games.

Hmm..

Let's check out the actual First Amendment, shall we?

"Congress shall make no law ... abridging the freedom of speech, or of the press."

In other words. "Boss man can fire me for talking shit to customers, no problem."
Argue that the boss shouldn't have that much control over his employees if you want, but I really get sick of people saying 'Free Speech! First Amendment!' when they have no idea what they're talking about.
And there certainly are laws now as to why a person can or cannot be fired, but those have not been mentioned so far.
I think firing is too much for this 'offense', but the boss would be within his rights to do so.

Not as bad as when i worked at wilsons leather, helpping an old lady who was a die hard patriots fan(had a tatoo on her leg and all) get a suede patriots jacket(this was before they ever one a super bowl...you know the good ol days) and she mentions about how much she likes it, then she says something about how much the jets suck and the fans are idiots..im like ok lady you've been talking to one since you came in the store >.

I think everyone is thinking on this way too much. he said something dumb, if you were so offended then go back and do something about it instead of bringing it to the net. if your convictions were strong enough in the 1st place you should have called him on it, advised you WERE a sox fan and demand the game. Like the above person mentioned if you dont get what ya want, called the manager and watch how quick Mr. EB sox fan's resolve crumbles before his higher ups. You would have gotten your game and solved your problem in one fell swoop. This isnt a freedom of speech deal, he said something dumb. Everyone does. If he was called on it we would if he was dumb enough to follow thru. Now we will never know..... Great now I'm thinking on it... Damn it, it's like a bad 80's song thats stuck in my head.. Anyways I hope you get this resolved. Take care.

Should he get fired? Yes

weill he get fired? Seeing as it's EB probably not, in fact I wouldn't be surpriised if he's on the management fast track.
