MLB & Take 2 - What it means for you (and I)

Basically it means their is no way EA can make a baseball game. But, unlike EA's NFL deal, it still leaves the door open for competition(MLB 2006 from 989 & Nintendo's new baseball game). If MS wants to make a game, they can as well. Midway still gets the short end of the stick on this one unfortunately.

I think that is incorrect. I'm trying to verify this with my contacts but I'm pretty sure Take Two doesn't own VC. In fact, they lost the ESPN license (according to the OP's link).

T2 bought them from Sega last time I checked.

VC is the developer of the 2K sports series. They recently picked up the ESPN license and added it on.

Yep, Kush is a part of VC. Sega's whole sports developers went to Take-Two in the deal, this was posted a while ago.
 
I would be willing to bet that the console manuafacturers are not recluded from hiring an outside development house to produce an MLB game. In which case EA can easily pimp out their baseball dev team. It would be little different than Nintendo's relationship with Namco on Starfox Assault and othe recent GameCube titles.

No chance of EA trying to wiggle around this deal. Terms are exclusive with MLB and MLBPA that no 3rd party can make a baseball game, even with aid of the 1st parties. Why would Sony want to help EA anyway? They have their own baseball game, as does the big N now. Microsoft is another story...

And yes to clarify once again - Take 2 now owns Visual Concepts, all rights to the 2K series of games, and Kush. They no longer own the ESPN license starting in 2006, but there will still be games, except for the NFL of course, thanks to EA.

Ya see, there's this thing about licensing agreements called a non-performance clause. If Take Two's baseball games fail to do enough business there is almost certainly an option for one or the other party to end the agreement. EA's baseball developers are facing pink slips as it is. Packaging them as a devlopment contractor would allow EA to retain their services and potential screw Take Two. Microsoft already owns the High Heat brand from the auction of 3DO's IP but haven't any personnel inhouse to produce a new game. Most of their former sports staff are now at Take Two, by no small coincidence.

It's all comes down to whether EA wants to be vindictive, what Microsoft is willing to do to stay on EA's good side, and the exact wording and cause for abatemnt clauses within the contract. They already have a gaping loophole with the console makers. It's just a matter of high far it can be stretched.
 
This is good and all but what about PC gamers? EA was the only company that made a baseball game for the PC since 3do went out of business.

Midway keeps getting the cold shaft. Had Take 2 not done this though, EA would have found a way to squirm their way in with a baseball game. It'd be nice if Take 2/Midway could come together to form a new Slugfest game...
