Long story Short....

I bought Some DJ Equipment off ebay, I wasnt satisfied with it becuase of scratches and marks on the cd decks, also seems like the cross fader on the mixer might need some replacing.

All I asked the guy is if he was willing to Give me a refund upon me returning the items. He Says NO and that the money is GONE. Im Not trying to rip anyone off. He says its USPS's Fault and that I should take it up with the insurence.

What are the chances I will be getting some money back from USPS or this guy?

What are some rules on the USPS shipping? Do i need proof?
 
Did you use Paypal?

If so, dispute with them, and if they side with you they will pull the money from somewhere.

If you didn't use Paypal, and didn't get insurance, then you're just screwed, since the USPS won't do anything for you.

Not if it isn't in the paypal account they won't. They'll side with you, and not give you squat.
 
Was the item as promised in the auction? If not, was it damaged en route, or not? If it was sent to you damaged, take it up with ebay and paypal---that's auction fraud. If it was damaged in shipping, if you got insurance, take it up with the PO. If you didn't get insurance, and the item was either damaged in shipping or delivered as promised, you're dependent on the good graces of the seller, if he had no return policy.

I've heard stories of them pulling from bank accounts and credit cards if you get smart and empty out your Paypal.

They got sued for doing that and don't do it anymore, which is really a double-edged sword for the non-scammers of the world.
 
Oh and yes, Im a verified Paypel Member and Used a Credit Card and some Paypal Funds to Pay it. I showed Him Pictures and Videos of the Stuff He Sent me. He Keeps telling me to go to the post office and deal with them.

Im Not really trying to Rip Him off. Im Just willing to get my money back, and he gets his items back, In Fact Ill Lose 50 bucks for shipping the item Back and im not even saying anything about that.
 
i would just file Item Not Described. Since you paid part of it with your creidit card, if paypal denies your refund. I would do a chargeback.

Mostly true. If you file a claim for something that was damaged in transit, they will usually pay off, but you must give them the item.

No No No. I did this with a broke PS2 that was damaged during shipping. I never got the insurance payment for it and they kept the PS2.
 
okay, so i guess ill give the guy a couple more days and if we dont come up with something, then im going to file a chargeback... and when i file the chargeback, should I send him back the item upon recieving the money? Also, Im sure if i file a chargeback, hes going to leave me my first negative.
 
Well, as much as I hated doing it, I opened a Dispute. Paypal is saying it takes 20 days. Would i still have time to do a credit chargeback if this fails after 20 days?

This is what I put down on the details,

Hello, I ordered a complete DJ setup from seller. I recieved the items and right away tested it out. I had found Multiple Damages. I spoke to my local USPS station and they wouldnt resolve things even with insurence due to poor packaging and One of the electronics (mixer) couldnt have been damaged becuase crossfader is known to wear out. I offered to send back items but seller refused and is telling me to take it up with the post office. Seller tells me that items were only used 10+ hours, Although the items show significant wear and have photos to show. The damaged part is the Crossfader on the mixer, I have video evidence that the fader is needing replacing and this was not said in auction. Also The Scratches and loose parts were not mentioned in the auction. All I would like is a refund and will gladley return items and will pay half for the shipping to return the items

upgrade the dispute on paypal, it will give him 10 days to make some sort of decision. if the money is not in there though, they will do nothing really except freeze his account. whether you win the dispute or file a chargeback though, you will be responsible for 100 percent of shipping it back to him.
 
just email them your dispute #. I got fucked over on my sega cd they told me to scan a bill from a 3rd party place showing how much it would be to repair the item i got. Well i faxed them this information and paypal claims "they didnt get it". I had receipts from kinko's because i had to spend $2 to send the fax and those assholes said they never got it. So i got my lawyer involved and 30 days later i got my money to pay for it. After about 10 calls of bitching at paypal and about 5 threatening letters to the seller i was good. But way to much work for what happend and just to have a nice legit deal.
 
He never said there was multiple items wrong. Just cross fader. I told him to file a claim with post office. Items were packed exceptionally well and he never said they were not. Post office is giving him the run around and making me pay for their error. I belive on thing on the items does not work, but everything worked fine when I shipped it and used it 2 days beofre lisitng it with no problems. Items are worth over $1200 and he paid $700. He got a great deal. I would offer half of repair cost, but no returns. I already lost enough money on these items. He could get half of the repiar cost form me and still file a claim and make money. It is not fair to me. Thank you

ending communication with you and escalating to a claim, the seller is
asking PayPal to investigate the case and decide the outcome. As part of
our investigation, PayPal will review any communication you may have had
with the seller in the Resolution Center.

What Exactly does this mean?

I'm pretty sure you don't get a dime from PayPal until you provide them the DC/tracking # of your return shipment back to the seller - showing delivery of course. Don't send it back until PayPal finds in your favor on the dispute obviously. At that point they'll refund your money provided it's in his PayPal account. If he has no funds in his account they take him to a negative balance, but if he abandons the account (i.e. doesn't transfer funds in to restore the balance to $0) PayPal will be very sorry, but won't give you any money back.

That's my understanding of how the process works anyway. At that point you'd file a charge back with your credit card company and you should win that.

I'd just make sure your CC company allows charge backs on PayPal payments (some don't AFAIK) and what your time limit is for initiating a charge back claim. Just call the 800 # on the back of the card and ask.
