The philsophical mechanisms for this sort of surrender have been long in the making. The intellectually lazy leap from the idea that, without a cosmic referee to appeal to, no "truths" can ever be provably absolute, to the mistaken belief that because of that, my "version of truth" is no better than yours. It is this sort of philosophical basis, for those that even think that deep on the matter, that lays the groundwork for miscasting the inability to judge those "exotic" cultures as a sign of moral strength, rather than a weakness.
Of course, this is by no means a complete description of all of the intellectual memes that go into reasoning like this. Mormons wouldn't get the same treatment from the same courts. Part of it is undoubtedly a splash of innate elevation of the "exotic" cultures, some "white guilt" if you want to call it that as well...
Obligatory backpedaling, these are likely isolated incidents that will be overturned soon, God-willing, but these are ideological phenomena I have been witnessing for most of my adult life. To deny that they hold sway, over European countries at least, if not gaining ground here, is to cover your eyes and shout "LALALALALALALA."
