Wal-Mart Sued Over Evanescence CD Lyrics

That pisses me off to no end. Ive never been too keen on WM sellinh ONLY "cleaned" cd's, but when a single fuckING word gets through, the people go nuts. I hope somebody complains about the new Gwen Stefanie cd with the "im the shit" lyrics repeated 20 times in the 3rd song.

I can certainly understand people being upset about it, but lets face it - this sounds like an honest mistake. A bad word slipped through and no one noticed it: now I demand 15 bajillion dollars for the emotional damage that hearing it caused my daughter, who probably only hears it 14,000 times per day in school.

Walmart should say sorry, refund their money, and that should be it.

OMG TEH UCK-FAY!

Funny story. If your EB has the San Andreas sitting on the counter, on the back, point out to an employee that "Just Don't Give A fuck" by 2Pac is written with no censors on it. Watch them freak out. Good times.

If you hear the song, you can't really tell she says it. While I love Evanescence, it's a cover of the Korn song, and it's not a great cover, and it doesn't really sound like it at all.

And another thing, if a parent catches this, they should listen to the rest of the songs and be a respnosible parent instead of listening to the two catchy songs on TV and buying the CD. Evanescence is, at its heart, a goth rock band, and Amy screams "I WANT TO DIE!" in the background of "Tourniquet", almost kills herself in the video of "Everybody's Fool" (which, wait for it, wait for it.. isn't aired a lot at all), and basically keeps saying she wants to die.

So if the parents are worried about the F word, yet their kid listens to the other CD (which is almost profanity free), fallen, and the parent doesn't have a problem.. then the parent needs to pay more attention.

I never got the reasoning behind Wal-Mart selling only clean CD's. They sell old CD's with curse words in them, they sell games that are rated Mature, and they sell movies Rated R.

I thought it was going to be because Evenescence lyrics are shitty. But then again, I don't think Walmart is to blame for that.

Damn. If I said the word 'kazoodles' was a variant of fu( k, and word got out, people would start to be offended by it.

But if I just say 'Oh kazoodles, my shoe is untied!' without anyone knowing what it meant, do you think that they would be offended? Hell no. People are just stupid.

Then demand $74,000 in reparations for the emotional scarring which seeing that horrible word did to you.

i want to become a judge so when stupid people sue over stupid shit i can throw them in jail. for wasting the courts time and taxpayers money.

these people. jail.
that 80 yr old woman who sued mcdonalds over the hot coffee. jail
people suing fast food restaurants for making them fat. jail.

I mean, seriously. I'll break it down song by song if I have to.

On the Fallen CD..

"Going Under"

Now I will tell you what I've done for you
50 thousand tears I've cried
Screaming, deceiving, and bleeding for you
And you still won't hear me
Don't want your hand this time, I'll save myself
Maybe I'll wake up for once
Not tormented...Daily defeated by you
Just when I thought I'd reached the bottom

>>Sounds pretty morbid to me..

"Haunted"

watching me wanting me
i can feel you pull me down
saving me raping me
watching me

>>Raping her? Good job, parents.. way to monitor what your kids listen to.

"Tourniquet"

I tried to kill my pain
But only brought more
(So much more)
I lay dying
And I'm pouring crimson regret and betrayal
I'm dying, praying, bleeding and screaming
Am I too lost to be saved?
Am I too lost?

My God, my tourniquet
Return To Me Salvation
My God, my tourniquet
Return To Me Salvation

>>Chick cuts herself (or something else) and is near death, sounds like a song I'd let my kid listen to.

Basically, if the parents are suing over a fucking f-bomb, they should really take a look at themselves.. but that's what I love about Evanescence.. they're marketed as a christian rock band.. and the sad song gets played on the radio and other stations.. yet all of their songs are about depression, death and suicide.

When Simple Plan or whoever came out with that new song "Welcome To My Life", did you suddenly notice how 50,000 teenage girls suddenly became suicidal depressed people with messages of desperation in AIM away messages? Hahaha, I love how easily manipulative society is these days.

Whoa, that sounds bad.
Man...i thought it was bad on Walmart when they refused to carry John Stewarts America the Book...now i see it a little more their way
I think I need to buy that book.

BTW, i do alow swearing in my store, as long as there are no children around and its at a normal volume. There words. We dont care...but as always, please think of the children :)

When are they going to release a new cd? I liked their old cd a lot. I'm not into live music at all, especially when it's just stuff from the old cd so I have no interest that live set.

holy fuk that pisses the shit out of me, just cause 1 word slipped thru possibly hundreds of cds they carry, someones has to sue em. people like that piss me off so much, "omg my daughter listened to 1 f word which totals about $75k in damages". shes fuking 13 years old, she probally hears more in school than that one cd. i hope those parents get nothing but having to pay legal costs once this is over.

this almost makes me as mad as those parents suing mcdonalds over their fat kid getting diabetes or something because of eating too much. i mean wtf? its them and their fat kids fault for letting him eat that stuff.

PM me your AIM name.. they have five CD's of unreleased stuff, I'll send you whatever you want. I have EVERY song they've EVER done, even their CD that only had 50 copies pressed. Well, not every song. I'm missing one song called "Blood". I have demos as well, and even a demo of "Bring Me To Life" that completely excludes Ben.

Maybe I can be apart of their lawsuit. In the early 90's I was picking up every Ozzy cd I could get my hands on, and on the No Rest for the Wicked disc is a song called "Tattoed Dancer" which features the use of the word bitch. But I did hear that word, and wasn't warned. Maybe I can cash in along with these dipeshits too.

Speaking of oversensitivity...listen to this

Im posting in the forum on my highschools robotics team website...its on the off topic, and its a backwards story

so far the story is

ate spam. He hit the bat with a bat.

I put

Jesus ate spam. He hit the bat with a bat

Guess what happend? The ENTIRE thread got deleted because someone complained that they were offended. Can you believe that?

Letting just 1 word get pass the censors equal big payout for the parents? Thats just overblown, if the kids don't hear it from a cd, they'll hear it somewhere else. Only because they are a big corporation and that gives us the right to sue them for every little mistake they make (don't you just love america :) )

Oh yeah, and the girl is 13. Chances are, she cusses like a sailor at school, listens to rap at her friends house, and is a sexually active teen. One little fu (k isn't going to fu (k up her life anymore than she fu (ks her b/f on Saturdays.

Exactly, there's no such thing as a 13 year old who hasn't heard the word Fu-k before.

This is dumb, the kid is 13 years old. 13! She can go see a PG-13 movie that could have far worst. I bet the kid has heard it many times in school and bet she didnt react with "Oh, my virgin ears!" when she heard it on the cd. Whats the big deal anyway? Is her life gonna go in a downward spirial because she heard the word? Is she gonna become prostitute and live a life of drugs? NO! Even if it did, is $75,000 gonna make things all better? These parents need to stop blaming others and start blaming themselves.

This is what I hate about the world we live in today. People can sue for any old stupid reason and more often then not, they will get money out of it.

Give me a fuckin break! Your daughter is 13 years old...knowing the way schools are run these days, i'll put money on the fact that she's probably not even a virgin anymore. :p It's just 1 damn cuss word.
I'm sure you have copyright releases for all of that material also........
Just the "Fallen" CD, mainly because their earlier releases WEREN'T copyright protected. They were pressed and handed out on CD-R's. No bullshit.

I guess the whole point is that the parents weren't warned with an explicit lyrics sticker when they bought it.

Oh well, life sucks- stop trying to extort money from Walmart because you're an idiot. I'll bet these lawyers are the reason for this suit, they'll get 1/3 of any settlement from it.
I thought it was going to be because Evenescence lyrics are shitty. But then again, I don't think Walmart is to blame for that.
 :applause:

Seriously though, while I think the lawsuit is silly, whatever, take Wal-Mart's money. Bastards.

Wasn't some of their stuff provided for free on the 50000tears web page when they first came out, I have a bunch of tracks myself from there, Eternal and Even in Death are my favorites.

BTW, I thought it was cool that they covered the Korn song on the live album, but it's sad it caused that big an issue.

HAHAHAHAHA....Wal-Mart should be sued for selling that crap in the first place. When did middle-America lose its taste?

Top-10 worst "new" bands.
When did middle-America lose its taste?

When they started going to Wal-Mart to shop for music.

These whiny bitchy assholes should be shot in the forehead, plain and simple. Whiny money grubbing scum like this don't deserve to live.

However, M rated games and R rated movies require you to be 17 or older in order to purchase it. I think that's why.

I do plenty of swearing while I work, just under my breath so nobody can hear me :D

50000tears site? The only other evanescence site that I am aware of is a good fansite called evanwhisper.com.. what's the 50000tears site?

Actually, you don't HAVE to be 17 to buy movies and games. It's the distrubutors descretion, though it REALLY depends on the clerk. I bought Saving Private Ryan the day before last at Target, and I bought Psi-Ops at Best Buy by myself without questions a while ago.

Parenting in the last 20 years has totally gone downhill ... whoa your 13 year old might hear a f-bomb in a song ... I wonder how many times she hears that from her classmates?

A lot of people have become a bunch of sue-happy, lazy-ass, self-serving, over-sensitive and uneducated saps these days. Oh well :)

The site is no longer around (or at least I can't find it, domain is gone) they did have a good amount of unreleased media and information on the band when they first made it big. Sorry thats no help, but I know its hard to find most of the songs now, but you seem to be doing well with the rare stuff.

You have got to be kidding me. Suing Wal-Mart over hearing one cuss word in a CD they bought... I guess I should sue Wal-Mart since after all they are selling Pink Floyd's "The Final Cut" with no warning of the song "Not Now John" having the f-bomb dropped SIX times.
