The Watch Wheel with Wendy’s Game (“Game” or “Promotion”) is open and offered only to legal residents of the 50 United States (and the District of Columbia) or Canada (excluding Quebec) at least 18 years of age as of 4/11/2011. Employees, officers, directors and representatives of Wendy’s International, Inc. and its Franchisees (“Sponsor”), Strottman International (“Administrator”), Quadra Productions, Inc., Sony Pictures Television Inc., Sony Pictures Digital Inc., CBS Television Distribution, the show Wheel of Fortune (“Show”) and their respective parents, subsidiaries, affiliates, franchisees, all of their respective advertising, promotion, or fulfillment agencies, promotional partners, and entities involved in the development, implementation, or handling of the Promotion, service providers, prize suppliers, participating stations airing Show, and other persons associated with the Promotion (collectively, the “Promotion Entities”), as well as the immediate family (spouse, parents, siblings, children, step-parents, step-siblings, and step-children, regardless of where they live) and same household members of each such employee, officer, director, or representative (whether or not related) are not eligible to participate. VOID IN QUEBEC, U.S. TERRITORIES (INCLUDING GUAM AND PUERTO RICO) AND OTHER JURISDICTIONS OTHER THAN THOSE LISTED ABOVE AND WHERE PROHIBITED BY LAW.
Promotion Period: The Promotion begins on 4/11/11 and is scheduled to end on 5/15/11 (“Promotion Period”).
5. How to Play:
A. To Play In-store: You will receive one game piece with the purchase of any Wendy’s “Wheel of Fortune Kids’ Meal” during the Promotion Period, while supplies last. The game piece is packaged inside a black plastic bag along with a paper or plastic Show-themed toy. Open the plastic bag and remove the game piece that says “Save this game piece.” Watch the Show during Wendy’s Family Week Monday, May 23, 2011 – Friday, May 27, 2011 (“Wendy’s Family Week”). Compare the puzzle on your game piece to the Promotion Puzzle (also sometimes called the “Wendy’s Promotion Puzzle”) on the Show. If the puzzle on your game piece matches, exactly and in order, one of the five Promotion Puzzles, you are a winner, subject to verification. Check local listings for Show schedule, which may be changed or preempted without notice due to remote Show tapings and other changes to the production schedule, special announcements, or programs that may disrupt normal TV programming. In these cases, at the election of the Show, the Promotion may be played outside the usual dates and times, or not at all. Original game piece is required to redeem prize. For instructions to claim prize, see Section 7 below. On Saturday, May 28, 2011 at 6:00 AM PT after the airing of all five (5) Shows during Wendy’s Family Week, the Promotion Puzzles corresponding to all Shows will be displayed on www.wendyskids.com and www.wheeloffortune.com/wendyspuzzles until Tuesday, January 16, 2012 at 12:01 a.m. PT.
B. NO PURCHASE NECESSARY. To Play without Purchase by Mail: To receive a game piece without purchase, while supplies last, and a copy of these Official Rules, mail a self-addressed, stamped envelope with your name, address, and age to: ”Watch Wheel with Wendy’s Game”, c/o Eagle Warehouse, 823 E. Main Street, Henderson, TN USA 38340. Include parent/legal guardian’s name and daytime phone number if request is from a minor. VT residents and residents of Canada only may omit return postage. All requests must be postmarked by 5/16/2011 and received by 5/20/2011. One game piece per valid request. Limit one request per outer mailing envelope. No mechanical reproductions or facsimiles of requests will be accepted. All requests become the property of Sponsor.
Prizes/Odds: FIVE (5) GRAND PRIZES: One (1) trip for four (4) on a cruise for 6 days/7 nights to the Caribbean (Approximate Retail Value (“ARV”): $7,500.00. (Actual value depends on point of departure, airfare fluctuations and various other factors and winner will not receive the difference between actual value and ARV of prize.) (USD) each (total ARV: $37,500.00 (USD)). Winner will receive roundtrip coach air transportation from a commercial airport near winner's residence to Miami, Florida (port of departure/return of cruise) and a cabin for four (4) on ship (location of cabin being of Sponsor’s sole choosing), airport transfers in Miami to/from airport to port of departure/return of cruise and $500 (USD) Spending Money (winner to receive check approximately 2 weeks prior to departure date). Cruise must be taken within one (1) year of notification of winning or prize will be forfeited. Valid travel documents (such as, passport) are required. Prizes may not be sold or offered for sale. No cash or other substitution, exchange, assignment, or transfer of prize is permitted except by Sponsor, in its sole and absolute discretion, who reserves the right to substitute advertised prize with another prize of comparable value if advertised prize becomes unavailable for any reason. Any depictions of prize in Promotion material are for illustrative purposes only. If a prize winner elects to travel with fewer than three (3) guests, no substitute compensation will be awarded to such prize winner in lieu thereof and trip components will be awarded in amounts appropriate for the actual number of travelers only. Sponsor reserves right to structure prize travel (including, but not limited to airports used), in its sole discretion; winner and guests must travel on same itinerary as set by Sponsor. If winner lives within 100 miles of Miami, FL, as determined by Sponsor in its sole discretion, winner will receive ground transportation to/from Miami, FL in lieu of air travel and will not receive any compensation or substitute prize in conjunction therewith. Trip is subject to air travel and cruise ship availability, holiday and black-out dates and all other prize and travel restrictions and/or specific terms and conditions set forth by Sponsor; and, as such, winner understands and agrees that he/she may not receive his/her first choice of travel date for cruise. Once determined, no change, extension, or substitution of trip dates is permitted unless approved by Sponsor and any cancellation or change fees are the sole responsibility of such prize winner and his/her guests as applicable. Each winner is solely responsible for any applicable taxes, incidental and unspecified, costs, expenses or fees associated with acceptance and/or use of the prize. If prize winner is a U.S. resident, he/she will receive an IRS 1099 Tax Form for the fair market value of the prize. If prize winner is a Canadian resident, he/she may be responsible for payment of foreign withholding tax on the fair market value of the prize. Limit one (1) prize per person/household/address. Approximately 6,000,000 game pieces will be distributed; however, odds of winning a prize are approximately 1:1,200,000.
7. Redemption of Prize: To redeem a potentially winning game piece, mail (via certified mail, return receipt requested) original game piece (NOT a copy) along with your name, address, age, daytime and nighttime phone number, parent/legal guardian’s name and daytime phone number if potential winner is a minor, to Watch Wheel with Wendy’s Prize Claims, c/o Strottman International, 46 Corporate Park, Irvine, CA USA 92606. Copies or reproductions of game pieces will not be accepted for redemption but you are advised to keep a photocopy of your Potentially Winning Game piece for your records. Game pieces are void and will be rejected if not obtained through authorized, legitimate channels, or if they are in whole or in part illegible, forged, incomplete, or tampered with in any way. All prize claims must be received on or before January 31, 2012. If received after this date, prize claim is void. Winners must fully comply with the Official Rules. If winner is a minor in his/her jurisdiction of residence, prize will be awarded in the name of or to winner’s parent/legal guardian who must execute all documents and agree to all obligations and undertakings of winner both on behalf of himself/herself and winner, or prize may be forfeited and awarded to an alternate winner via second chance drawing. The potential winner (and his or her parent or legal guardian, if winner is a minor) of a prize must complete, sign and return an original unmodified affidavit of eligibility (or declaration of compliance, if the potential winner is a resident of Canada), a liability release, and where lawful, a publicity release, in a form designated by Sponsor within ten (10) days of receipt of those documents in order to claim his or her prize. If any documents or requests for validation are not completed and returned within ten (10) days of receipt, or if any notification or prize is returned as non-deliverable, or if winner is found to be ineligible or otherwise not in compliance with these Official Rules, the prize may be forfeited and awarded to an alternate winner. Each guest of winner (and his/her parent or legal guardian, if guest is a minor), must complete, sign and return a liability release and, where lawful, a publicity release, prior to issuance of travel documents. Each minor going on cruise trip (whether he/she is the winner or a guest) must be accompanied by a parent or legal guardian; and, parent/legal guardian will count toward the total of four (4) travelers. By returning a completed Affidavit/Release and Guest Release, such winner and guest, respectively, attest to the provisions stated therein including compliance with these Official Rules. If a Canadian entrant receives a potentially winning game piece (or is selected in the second chance drawing as discussed below) he/she must answer correctly within a specified time a four-function mathematical skill-testing question without the benefit of any mechanical calculating devices. The test will be administered by the Sponsor or Administrator at a pre-arranged mutually-convenient time, and only if the question is answered correctly in the allotted time period will the Canadian entrant become a potential prize winner. If the question is not correctly answered in the allotted time period, prize will be forfeited and will be awarded to an alternate winner.
