The auction in question was for several old, semi-worthless strategy guides...

Someone with 0 feedback won one of my auctions a couple days ago. Immediately prior to placig the winning bid, the bidder sent me a question-

i would like to know these are the games not just guids please tell me in detail through email.i am very new in ebay i realy didnot know how to shop on ebay just learning . so please send me mail.

This question was asked 2 minutes prior to the end of the auction! Neverminding the horrible english, my response was, "As shown in the picture as well as described in the title and description, this auction was for strategy guides, not games." To make matters more confusing, the bidder paid for the auction before I was able to respond to his question. Now that the package is ready to be shipped, I get another e-mail from the buyer as follows-

i have received your massage . i am really sorry but couldnot understand your description of the item from me i was very happy to buy games for my 6 years old son .i would like to get refund for this item .once againe really sorry.i will appreciate on your refund .i donot need those guides.we donot even have those games.so please refund.

I have made a 2nd chance offer to the next highest bidder (another 0 feedback :roll:). Assuming that doesn't go through, how should I proceed? Do I ship this out anyways, since I already have his money and say that his bid was a binding contract? Do I refund his money, make a mutual withdrawal (or whatever it is, so I can get my fees back), and relist? Stupid people annoy me and I really would like to just ship him the guides and say "sorry, bids are binding contracts. Try reading the descriptions and not bidding on things you don't know about."
 
I'd say fuck 'em. Binding contract. If they can't read the description they will never figure out the mutually withdraw.
 
you could say binding contract, but they could file a dispute, may be better to just deal with it and let it go, its messed up, but would be more messed up if they get it and then file a dispute. but its your call
 
Their fault (so ideally you'd just pocket the money and send it), but they'd probably pull an "item not as described" on you and leave you negative feedback to boot because the user is a moron. I'd just assume refund it because it's going to be more of a headache if they pull more shit on you and want to return it.

However, I would charge the person for the massage.
 
PayPal ALWAYS sides with the buyer no matter what. So just refund the money, get your listing fees back and try again.
 
Go to the auction in My Ebay, and click on sold. There is an option in the pull down about auction problem. Choose cancel and state your reason. If they agree then you get your fees back, if they ignore you for 7 days you can force a closing and get your fee back. Had the same thing happen to me

I'd have to disagree at the moment.
 
I definitely try and sell something that will bring me good money so i dont have to deal with too many ding dongs (although there are still some) on ebay. I guess with relatively worthless game guides you can find more of those "problems". Id just refund it, its probably already caused more irritation than its worth...
 
I think at this point I'm just going to ship it, tell the person I accidentally shipped it before I read their message, but that they're stuck with it anyways since the bid is a binding contract. If they go through the trouble of filing a dispute and actually win, I'll poop in a box and mail it to them after paypal takes the money back.

Okay, maybe I won't poop in the box, but I'm not going through the trouble of relisting when I'm moving in less than 2 weeks.

On topic, I would just refund him and have him do a mutual cancellation of the transaction (assuming that he can read and hits the accept button on the email from ebay). Sorry, for all of us who have sold stuff on ebay, we have all been there.

I agree with not sending the guides but ignorance cannot be a defense.
 
I went ahead and sent them and sent the user a message to the effect of, "ebay T&C's state that a bid is a binding contract and thus you are obligated to follow through on your purchase regardless of the fact that you have no use for the guides. Secondly, even if I wanted to circumvent ebay's policies, I can't since the guides have already been mailed. Sorry for the inconvenience." At this point, I figure one of two outcomes occurs.

(1) Buyer accepts the fact that they suck and the fiasco is over.
(2) Buyer somehow figures out how to file the appropriate type of dispute with paypal/ebay, wins and I issue a refund. I don't really care about the guides and it was only $15, so I'm not going to bitch and complain about it.
(3) Buyer tries to file dispute, but fails, leading back to option (1).


Regardless of the outcome, I figure making the buyer jump through the hoops will hopefully teach them to learn to use ebay before buying something else. We'll see what happens.

You forgot the option where the buyer leaves you a negative, just because they can.
 
To avoid this in the future make use of the options eBay gives you before selling an item. They give you loads of different choices when it comes to allowing users to bid on your item. You can prevent first time bidders, bidders with a certain number of infractions within a certain time period, or international bidders if you don't feel like going through the trouble to find out how to get them their item.

I already do. I have every single option they have on there checked off. Unfortunately, they do not have an option for first time bidders/0 feedback bidders/new members.

Also, since sending the guides and sending amessage to the buyer that they are stuck with them, I haven't heard anything back. I'm not counting myself in the clear just yet though...
