Have any of you ever gone to and EB or gamestop, find the game you want, then go to the counter and say you want it new, then have the clerk pull out a scratched cd and throw it in the case and say its new? I said that's not new. The clerk said yes it is, we just take the game out to put it out on display. I said let me see the disc. I look at it, and there are scratches on it! I told the clerk I dont want it. The clerks looks at me all funny and says why not. I go, first off it is scratched, second it is not new its open! Has this happened to any one else out there?
 
They can only sell them that way if people are willing to buy them that way. You did the right thing by refusing. If the disc is clean, and the deal is unmatchable, I will sometimes take a display copy (I did during the KB 10,15,20 sale, I only regret it a little), but definitely inspect the merchandise. If they look at you funny, they are the ones who are messed up, not you.

Some stores will take a little extra money off to unload a display copy, YMMV.
 
yea i never bought new games from eb ever since the first time i tried to. i brought the case to the counter and said i wanted this game new, i was expecting him to bring out a new sealed case when he just picks out this disc, and puts in the case. after about a minuite of arguing about it, i got out of there and really never went back to eb untill after i discovered CAG and the 4 for 1 deals. but pre orders by the way they do sell with the shrink wrapping so im happy.
 
Scratched, definitely not.
Opened, that's an interesting dilemma. If it's open, it's no longer 'new in package.' But it might be new. When you buy a new car, it's going to have maybe a couple hundred miles on it, and if it was off the lot, who knows how many people test drove it. A lot of game stores now take the games out for 'security.' Or they cram them in those hard plastic things, which A. are a pain and B. add overhead to the bottom line.
That shirt you just bought, someone might have bought it, tried it on, decided it didn't fit, and returned it.
But Guessed is right, as long as people buy them, they'll sell them.
I sometimes take display models/floor models of some things, especially if I benefit [the last gas grill I bought, it was display model--it was in like-new condition, and the price was the same, but it was already put together, which is probably worth at least 30 bucks of my time.] NEVER buy a tv, especially a projection or plasma tv, from the floor model, however.
 
If I'm paying a brand new game price, I expect my game to actually be brand new in the case with the factory plastic wrap and the tamper-proof seal in place. If I'm buying a "repackaged as new" game (previously tried out by various store employees at home, customer returns, etc.), I consider that item to be used and think that I should receive the used game price discount. Since I've discovered this deceiving practice, I've made it a point to refuse buying any repackaged items. I feel that it's dishonest and unfair of retail stores to sell used items to customers as new just to inflate their bottom line, so I now refuse to support such practices with my hard-earned money.
 
Silly EB, how dare them not commit fraud and submit inaccurate financial statements. If they took a new game back and then resold it as used they would be showing a $20-25 ($45-20 trade-in) gain when they should be really recognizing a $5 gain ($45 Selling price - 40 cost). It's not them trying to be cheap, but the customer that returns the item is saying that it is new or else they would not get the full credit. Based on that, they sell it again as new. That's really not an argument anymore, since 99% of opened copies now are for display and not returns. I just say if you don't want a display copy, just wait a couple of days and they usually get a sealed one in. Most EB's only keep 2-3 copies of older games in stock which means only one person has to buy one before they have to sell the display copy.
 
if that considered new they should honor their old return policy of letting you return games new games even if you opened them. The way they do it now is just BS
 
What is their new return policy? It used to be pretty open; then they changed it to One return/exchange for a different title, which I could deal with.
My EB's new stuff are generally ~5 bucks more across the board than anywhere else. I could deal with that, if I was getting a good return policy. But that's the only reason I see to buy new stuff there if the return policy is more restrictive.
 
The only reason the companies are still in business, is because people keep buying there. As I have said over, and over, and over again, there is no compelling reason for anyone to shop there, unless they are students, or just don't care about the condition of there games... but that is a LOT of people.

Well, that sucks. Since their prices can be beat by many places, that pretty much removes any reason to buy new stuff from them [with the occasionally exception of pre-order, bundle, or trade-in deals]. I do go there to browse the Pre-owned, but really a title has to be unavailable on the new shelf to be worth while buying used, since the price diff. is no more than five dollars.
 
It's nice to know that I am not the only one that feels this way. I was starting to think I was being a dick saying I no longer wanted the game! Ya if it is opened, It is not new! The hell with EB!
 
I wouldn't say hell with EB. I just wouldn't buy display copies. EB and Gamestop as corporate as they are now, are still some of the only places that take games and their fans seriously. I will continue to shop with EB and take advantage of all their trade-in promos and pre-owned sales.
 
the only time eb pulled that crap with me was for panzer dragoon saga. i took it only because i had been waiting for over four months for the game after it came out - and i had preordered it.
i hate eb.

I'd say you made the right decision.
 
i got mechassault from EB, and it was obviously repackaged in the different kind of wrap and was missing the white xbox sticker that lets you know if the game has been opened or not.

of course, i didnt notice this till I got home becauase the "oh so slick" clerk put the game in the bag before I got a chance to check it out. i returned it the next day and got a brand new one.

just gotta watch out with those guys.
 
If it's open, I don't buy it as new. The only time I've done so is when they gave me a discount. For example, during the KB clearance they had an open Bomberman Generation, a game I wanted, so I negotiated an extra discount because it was already opened. Full price for opened (to me, that's used) games = you get raped.
 
This exact same thing happened to me a few weeks ago, I wanted to get RE1 for the GC so I went to EB and asked for a NEW one, then he went and grabbed a display case and took 2 disks from the cabinent and gave it to me. I told him "I want a new one", then he said "It IS new, it's just that the case was for display and the game is kept here fresh and new". I asked him is there a sealed one in the back, but he said no. So I didn't buy the game for the 'new' price ($19.99) since to me it's really not new and that I can get it for the same price at other stores. But unfortunetly, I didn't find a new copy and any other stores, so I went back to that EB, and I saw a used copy of RE1 on the shelf for $17.99, so I decided to buy it because I really wanted it. I took the case to the cashier and he took the exact same copy from last time for me. So from now on I now won't buy from EB anymore.
