New/sealed game bought from the store. No disc inside?

I just bought Dino Crisis 3 for XBox today from Best Buy. I looked at the game after I got home and it seemed new and sealed, never been tampered with. I unwrapped it and the XBox side seal looked good and tight, not re-put on. Then I open the seal and there's no disc inside! The instruction manual is there and looks new, no fingerprints or anything but there's no disc.

What are my chances of going back to Best Buy and telling them I opened it and there was no disc and getting a refund (I bought the last copy)? My other solution is to call Capcom.

Has this ever happened to anyone else? I swear, I'm usually pretty good at spotting re-wraps and this one did not look like it at all.
 
I've heard of it happening before, but it certainly isnt common. Call the manager at Best Buy so the associates know that you're gonna be coming in. That way, you'll have a better chance of resolving everything.
 
I dont know how they will act but someone told me this happened to them at gamestop and they wouldn't give him another, they thought he was making it up.
 
thats really sad, i wonder if it was the manufacturers fault or someone who stole the disk, either way never hurts to try and exchange it, the most they can say is no.
 
Seems to be a rash of this sort of thing lately. This is the third time I've heard of this in about a month.
 
I'm not sure how you could discover there was no disc only after opening the case. Just a gentle shake of the case before you open it should let you know whether or not there's a disc inside. Anyhow, call BB and tell them your problem - the sooner the better. Also, whatever you do, don't lie to them. They might want some personal info, just in case you're a scammer and plan to have missing discs in the future (but you're not, so don't worry), but as long as you're honest, you shouldn't be hesitant to request your money back or an exchange. If BB can't or won't help you out, and you think it may have been a packaging error, by all means contact Capcom.
 
I agree, most of the time you can figure out whether or not there's a disc inside the case by feeling it's weight. Other times you can tell by just rotating the case or a gentle shake. If there is a disc inside, you can hear the disc inside. When in doubt, I would probably open the game in front of the cashier.
 
I've heard of this happening to people with CDs and DVDs. Call the manager and tell him first. As long as you show them a receipt and tell them what happened, you should be OK.

I've even heard of someone that ordered a CD from amazon.com and the case had TWO copies of the cd in it.
 
At Best Buy, they have the music blaring so loud and the plastic security cases rattle themselves so you can't really tell. I did shake it when I got home, it didn't rattle but it didn't feel too light to me either. Sometimes the discs fall out of their holders and get caught in between the booklet and holder part so it doesn't rattle when you shake it unless you shake it hard. I assumed it was just loose in the case, didn't want to shake it too hard in case it'd scratch the disc, but you know what happens now when you assume.
If I was trying to scam, I'd choose a game higher priced than $9.99. I'd be more than happy to just receive the plain old disc from them without anything else since I have the case and book. I truly believe that it was just a manufacturer error as the package looked good all around except the missing disc. I'll call BB, but I wonder if it wouldn't be better to call Capcom as I'm sure it was BB's last copy. I'd rather have the game than the $10. At least in this case, it's less about the money and more about the principle (and the game!). :D

to be honest, capcom will probably just show you back to BB's door. This unfortunatelt is one of those things where if you told no at BB, go to the next person up until you get your product. this has happened to me at gamestop (re-wrap this, mofo) both in the no disc AND saved games on a gba game (for some reason that REALLY ticked me off)
 
This happened to a guy with Ninja Gaiden here, the person took off the security seals carefully and replaced the cd with a blank one, and put in 3 pieces of paper to take the place of the manual.
 
when i got tool's anemia for xmas 1996? (or 1997, i don't remember) the cd inside was broken in half, but still together so it sounded whole. i just asked for a replacement and got no problem
 
id make sure you are clear that you want another disk. If they say theyre out ask if you can get oen from another location. Id leave the "money back" out if possible. That may help them figure out youre not scamming.

There was something in the news about something similar. People buying things and finding something different from what they were expecting. The news did mention that the problem should be reported to the company that made the game for a replacement.
 
my buddy works security at Target, people do this often. And just because there is a cd when you shake the case doesn't mean your safe. He tells me people often put AOL cds in there. Always open your games in the parking lot.
 
This happened to me once, and yes, it was just a manufacturer's error. Ironically, it was also a Capcom game (tho I'm sure that parts just coincidence, you gotta imagine w/ millions of games getting printed this happens to every company sooner or later). I got mine from Wal-Mart, opened it when I got in the car, and just went back in & showed them. I knew some of the ppl there and they knew I was honest, so I didn't get any flack. But if I had, they would have regretted accusing me of stealing.

And to the ppl saying you should have been able to tell before opening, come on. No one expects there to be no game in the case. I don't know about you guys, but I open so many DVD & game cases that when I get a new one, I'm not doing scientific tests on it before ripping it open to determine if what's supposed to be inside really is. :roll:
 
This never happened to me, but I did get the wrong game in a package once. I bought (what I thought was) Pinball of the Dead for GBA new and sealed from Toys r Us. I open it up, and it had Madden in it instead. I'm not even sure that those two games were made by the same company.
 
I recently bought Namco Museum for GBA at Target. Low and behold, there was no game in it. The shrink wrap was original and you could tell the game really was new and not tampered with. I went back to Target immediately after and they gave me a new copy and they said they would take $10 off my next video game purchase due to the inconvenience. It worked out pretty good since the game was only $5 to begin with. :)
 
To me this seems like it is probably a manufacturer's defect.

Think about it, if you are going to steal a game and then perfectly rewrap the case to complete your crime wouldn't you put a blank CD-R in the spot of the game you stole (a la Indianna Jones) to make it as legit as possible? (That way if you shook the case you'd feel/hear the disc in there.)

I guess if you have a really paranoid thief he might be worried the cops would eventually trace him (or link him to all his scams maybe) by the brand or lot # of the blank CD-Rs... But still seems like a packing problem to me.

I woulda called them up the same day you bought it (too late for that now I guess) But hopefully they'll do right by you. I often wait a good while before opening a game, so if this happened to me I could have had the game for a good 2 weeks+.

wow... this one sounds like somebody pulled a switch on you.

as for the op, i would probably talk to capcom first since it looked like it wasn't tampered with.

i don't think shaking the package will help b/c as others have stated, sometimes the original cd/dvd are replaced with another cd. i think there is another thread about this somewhere....
 
I have a friend who works at Best Buy and I'm told that this is actually a fairly recurring issue. The good news is that the manager will usually give you a refund or exchange, just don't wait more than a few days to do it.
 
I was at target browsing the value games couple months ago and saw an opened, Wolverine's revenge with no disc inside, sitting on the shelf.

Most places are getting pretty anal about the games. Target has to walk with you to the register or pay for it in the electronics section. I was in Blockbuster once and heard them talking about watching people when I walked in. I went to look at games to rent and an employee followed me and pretended to be looking at a DVD in the aisle accross from me, very obvious. I guess a lot of gamers are also thiefs.
 
Just out of curiousity, how old are you msdmoney? If you don't want to say that's cool.

I bet Blockbuster wouldn't do that to somebody mid 20s+, just teenagers.

Either way, what a pain in the ass to be assumed to be a crook when you walk in the door.
 
It happens and in general is the manufacturing plant's fault. So BB should be more than happy to give you a new one.

Recall a massive blunder with Sonic 2 Adventure for the DC, think 150K+ was shipped without a CD--. :0.
 
Why in the world are you worried about being accused as a thief?

Best Buy has clearly stolen from you. If I were you I would go to the store and kindly ask for a replacement. If they refuse then go into the games section, take the game, and leave. If they call the cops then you can explain that you paid for the game and they refused to deliver. Remember, they stole from you and they wouldn't think twice about taking the game if you stole from them.

And there are more than 1% of corporations that thieve. There is no reason why you should have to jump through hoops to get what is rightfully yours. You paid for it, you own it. Plain and simple.
 
Yeah, its definitely important to tell the store about what happened as soon as you can. This happened to me at Walmart twice. the first time, it was DDR Ultramix combo. There was no dancepad or game. Instead, there were books!. I returned it, and they opened another for me. Turns out that there were like 4 of them on the shelf like that. Definitely an internal scam. Second, I got a PS2 from them last Black Friday ($109 for online pack). Turns out someone put a phonebook in there with the bottom of a PS2 horizontal stand attached with the PS2 SN label. They let me exchange it when they got more in stock the next week. They said the scam percentage is so high because of the large number of college students around, and that they take it as a loss and don't investigate scams. I figure it was because of the number of a$$holes
 
Ive worked for a videogame store for a year and a half and I have yet to have anyone comeback with the no 'disc' thing. Ive has two that were cracked (both people came back the same day). I'm sure if a missing disc happening id be a little surprised, but if its within 2 days. and they DON'T ask for money back, id do it.

Was it a Dreamcast game? I ordered one from amazon and it arrived sealed and empty, just like described here. They were really great about mailing me another as soon as they restocked, so I really got a free CD case out of it.
 
Same thing happened to me.

I bought DOA for XBOX (sealed) at BB when it was 9.99. I opened it up a few weeks later and found a bunch of folded papers and a blank CD-R.

BB wouldn't let me exchange it, but they did give me refund.
 
i was always worried that somethign like this would happen to me, and i thought it never did though. i guess it does. that sucks man, i hope you get your game replaced. good luck with that.

When you as a business deals with walmart, they ask for a extra 10-15 percent of free stock for returns etc. This is why walmart has a such a return policy of no questions asked.
 
ive never bought a dvd, cd, or video game without the disc included....though i have bought a dvd with two discs included instead of one....

on another semi similar note....

i was looking for cubivore today at my eb....couldnt find it....but i bought rayman 3 for ps2 (last copy...floor copy)....and i didnt see the employee go in the little disc n instruction booklet drawer to get my last copy out before he taped the disc shut....so i thought he forgot about putting the game and instructions inside....as soon as i left...i checked....and it was inside....for some reason, my eb leaves some games with the disc inside out on the floor....

i had this problem... i found a Preowned cubivore once and i went to buy it and the guy got the disc, but no instructions, so i asked whre they were and he said they leave them in on the floor, so they must have got stolen. i told him to nevermind and went and bought a new copy on ebay for about the same price instead.
