Ebay buyer giving false info in order to return

Ok so I sold some shoes on ebay and CLEARLY stated No Returns, showed pics of the condition of the shoes ( and also RIGHT BEFORE I shipped them). Keep in mind these shoes were released on 2003 and are 7/10 condition used. I also sold another pair with no problem earlier that day.

I even posted on niketalk (shoe forum) about it and they all suspect the buyer wore them for a couple of days and then wanted to return them since he received the shoes on wednesday and didn't contact me until sunday morning. They also mentioned he paid such a low price ($110) for these, you can't expect them to be tip top condition. 

I offered the buyer 10% restocking fee and refund but he declined my offer so we went ahead with the ebay case. He stated that the shoes were "This item doesn't match the description in your listing." 

Since ebay didn't have an option to upload pictures, I uploaded a few pictures on a picture hosting site and gave ebay the links of all the pictures I posted AND the pictures I took before shipping them off.

When we escalated the case, and 2-3 hours later, EBAY made a decision to refund the buyer in full. Keep in mind they didn't even ask for any pictures from the buyer. I'm not even sure the buyer is even gonna send them back the same condition. 

What else can I do besides disputing the charge with my bank? My paypal is -$110 atm

You shouldn't have been such a dick about the return, you can state what ever you but when somebody opens a dispute on PayPal your pretty screwed most of the time. Hopefully he doesn't send you back a pair of old sandals, if you dispute the charge with your bank they are going to close your account.,

They have a big eBay rant thread in the Deal Shopping/Bragging Rights thread if you want others opinions but your not going to get much help that's going to make you feel like you won.

How was I such a dick about the return? I sold another pair of shoes that same day and had no problems at all. The fact that ebay doesn't even bother looking at pictures shows they don't give a s*** about their sellers.

 
He stated no refunds and then offer a 10% restocking fee, how is that being a dick? So the buy could eat up $11 and send the shoes back if he was actually a nice enough fellow and something was really wrong with the shoes. But instead just wanted all his money back and might even try to keep the shoes too if he was already shady enough to file a false claim. 

Honestly I don't think there is much you can do and luckily I have never ran into an asshole buyer yet, some asshole sellers but not buyers

Everytime I list something for sale on ebay I always worry this will be the one buyer that screws me over. I always take tons of pictures and state a condition that is probably below what it actually is so to avoid any mess. I always ship same or next day and always lose money on the shipping fee so hopefully I never encounter a scammer but it will happen someday eventually, no doubt.

 
eBay can't do anything with your pictures because there Is no proof whatsoever that the picture you have is what you sent. You could have taken those pictures and then sent a completely different item.

It's just a simple fact on eBay that if a buyer opens up an item not as described they will always win. If a buyer complains there is no point in telling him no returns, just deal with the fact that you will get returns and be happy you got the item back and the buyer didnt keep it and your money. Make sure you get your eBay fees back.

In my experience 50% of the time the buyer never gets around to returning them anyway.

I was basically told the same thing. I had the EXACT same thing happen to me. Customer was an idiot and decided she wanted a return even though I said no returns. eBay and Paypal both sided with her, so I deleted my eBay and Paypal accounts the next day. fuck them. I'm sick of eBay treating sellers like shit. Move to Amazon man. You can't sell anything there like on eBay, but they'll treat you like a real person. :)

You also can't refuse returns, regardless of what you put in the auction. Less disappointed sellers when people learn this.

I can see both sides of the spectrum, I'm a consumer and have never sold anything on eBay. You can post "No Returns" as much as you want but that's not the way the system works. Some sellers seem to forget they are providing a service to their customers, they tend to forget the service part and it becomes a whole lot of me, me, me, me.

I've been jerked around a lot on eBay by a lot of shitty sellers and all it's done is made me more cautious of who I buy from. I'm not going to say there shouldn't be more done for sellers but a lot them ruined years ago when they would relentlessly strong arm buyers with fear of retaliatory feedback to warn other buyers of sellers practices.

I didn't include that it's 7/10, that's what I rated it for myself.

The thing is, I posted about 8-9 pictures in different lighting, different angle....you name it. A picture says a thousand words.

but as a seller you also have to be respected and protect yourself from stupid buyers who do not know how to read or are too lazy to look thorough

 
Returns isn't what bothers me (I never had to do one), for me it's lazy stupid buyers. Recently payment is either late, never gets sent, or they don't read the description.

Are international buyers allowed to bid on auctions that are set up for no international shipping? I always set it up and even write it in the description yet it never fails that I get asked the question "Do you ship to _____?" Even when I tell people "no" they bid on it anyways. Then I have to relist it and it's just a pain. I only used eBay to sell stuff then use that money to buy something else. Relisting keeps me from the thing I desire.

Some of the questions asked in here and in the eBay rant thread should really be asked on the seller forums sections of eBay.

Things like "Why are international bidders bidding on my item... I put I don't ship outside the U.S. in my listing" is well... stupid. You have to set up blocks in your PayPal account to block international payments. Otherwise they are going to bid and they are going to get pissed off you aren't shipping to them.

You can't not accept a return. If you do the buyer is going to file a SNAD claim. So that stance you took just cost you a strike on your selling account as well as negative feedback or low DSR scores.

eBay stopped being a venue a long time ago... it is their sandbox and you play by their rules. They don't want people selling vintage items or used items anymore. While that was the type of stuff that allowed them to grow it is too much of a headache now. They want new items. Cheap items. That is why chinese sellers are doing so well on eBay.

Just learn from every situation like this and try and do your best to protect yourself. Hopefully you get the same item back and you live to relist it.

 
Thanks for the tips guys. Yeah there are careless idiots on there, there were countless times where I see a new user that doesn't end up paying for the item. Then I'd have to relist it and do everything over, it's not that we're assholes...it just sucks we can't really do much

It's not the paying. It's bidding and winning the auction. And I'm not stupid, I'm kinda smart.

Then you don't have your blocks set up correctly. You need to have blocks on both paypal and eBay. On eBay you set up buyer requirements and block all buyer's that lives in a country you don't ship to. Simple.

If they bypass that by using a eBay account registered in the U.S. you block international payments in PayPal. Simple.

Then there only option is to use a freight forward company (i.e. U.S. payment to U.S. address which will forward to their country).

It just gets old listening to people complain about eBay allowing returns when they clearly put "I do not accept returns in my listing" or international buyers winning their auction when they put "U.S. bidders only" in their listing as if they holds any weight.

I'm not trying to single you out but sometimes I think it'd be helpful if eBay required all sellers to take a 1 hour certification course yearly so that more sellers are aware of these type of things.

I mean you wouldn't believe the number of people that create bitch threads about eBay charging FVF on shipping or eBay not allowing sellers to leave negative feedback for buyers as if those were recent changes!

 
Yeah, eBay buyers suck and eBay tends to let them get away with their BS due to two reasons: they want their business and are afraid they will go elsewhere and they're greedy as hell and aren't about to refund a buyer with their own cash if they can get away with it so they'll screw over the seller even if the buyer is lying or a scammer. I've been on a selling spree lately getting rid of unwanted garage/basement items and have done pretty well but alas I've ran into my own scammer not too long ago. Thank god I only have a few more things to sell and then I don't have to worry about scamming liars.

 
I stopped selling on Ebay years ago for stuff like this.  Not only huge fees for selling, but Ebay ALWAYS sides with the buyer.  I don't think I've ever heard about a seller winning a case. 

It doesn't seem to matter either if you put stuff in your listings about "no returns, no exceptions".  Ebay will always initiate a dispute, and if not them, the buyer could always use Paypal to initiate a dispute on there.  (Which honestly Paypal has been much more fair in judging cases in my experience, which is why more dishonest people do it through Ebay)

Not sure what to say, at this point I would just make sure you get the shoes back.  If you want to go extreme, get a lawyer if the shoes don't get back to you or are in worse condition.  All and all, I've had a few cases in my past years selling on Ebay where people returned perfectly fine items for some bullshit reason and Ebay awarded them the refund much to my disgust.  Just cut your losses and move on.  Sorry OP, I know it sucks. 

 
@Vanacloud. I have no negative feedback, last 3 years and I'm only a casual seller. I sold things like ps3 games, wii games, PSP system, iPod touch, jordans and keyboards etc.



So I received the returned shoes, same condition as far as I can tell. I just hope he didn't do anything gross before he sent them back. Just pissed my time was wasted, my other shoes sold with no problems. 

Another annoying thing about ebay is, they are charging me $11 from the transaction 10% of the $110 I sold it for. I called and asked if their gonna refund it....what do you know....Mr. Anit Patel who could barely speak any english said their not gonna refund me the $11 ebay fee because it was escalated. I started to yell at him and explained that I was the one who wanted to escalated it because the buyer kept saying bullshit and I just wanted it to be over.

What pisses me off most is ebay didn't even bother to look at the evidence I showed them and they just AUTOMATICALLY sided with the buyer.

I used to buy/sell from amazon AND ebay, now I'm just switching to amazon and completely stay away from ebay unless it's something that's very rare find.

Glad to see this is resolved. Amazon selling different than ebay selling?

 
Amazon is a great place to sell (exposure) but they are waaaayyy more consumer-centric than eBay/Paypal.

And a great deal less tolerant of seller mistakes.

You can't have TOS more restrictive than theirs (30 day satisfaction guarantee for everyone on everything) and they often render decisions that side with the customer and won't require them to return an item like Paypal does.

I haven't experienced any of this, but I've read about on their seller forums.  Just do your homework and it's a great place to do business.

I realize this is somewhat different than your case because I assume you described the item accurately, but I just wanted to toss in a viewpoint from the buyer side.

I bought a PSP battery used from some guy on eBay pretty cheaply. He claims it works, etc. He also says "no returns."

Here's the kicker: when it arrives, the battery is swollen up from the gases being released by the battery and that it doesn't even fit. In short, this is not "used," it may barely qualify for "for parts and repairs." This is the very definition of "not as described." I request a refund and want to return the battery, but he claims "well, I said no returns." 

I worked something out with the seller in that I got a refund minus what it would have cost me to ship the small-bomb-waiting-to-happen back(postage is surprisingly pricey for people who don't have arrangements with USPS). He was probably a couple buck richer, and I'm a few bucks poorer and wiser for it.

At any rate, the thing that made me mad was the blanket hiding behind "I said no returns." Even retailers clearancing their stuff accept returns, when the item DON'T WORK.
