hey i just won a destiny taken king bundle and the sellar wants $0 in sales tax

item sale price 380

shipping 29.98

sales tax 40.59

and i live in New orleans seller is in chicago.  doesn't make any sense

if the person sells to the public in their city they may be force to charge sales tax (if they have a business)

could be worse could have massive amount of amazon credit and they deside to open up a wherehouse in your state.. Meaning you just lost 7% of all of your gift cards.

I'm not sure whether it varies by state, but I was taught that if your company has "nexus" in a state, you're required to collect sales tax in that state from people who make a purchase within that state - nexus meaning a certain type of physical presence, like having a warehouse in that state.

So, assuming they actually do have nexus in your state, they probably are required to charge you the sales tax.  Is the sales tax within eBay's sight, or did they e-mail you directly, asking you to send it to them directly?

Sellers who charge tax will have it noted in the listing.

If it is listed there, then there is not much you can do about it since it's clearly stated.

The listing does say that it charges tax, as far as why, I really don't know. I've never seen this before, I'm not saying the seller is doing it but I can guess. When a seller charges taxes does eBay make sure they get to where they are supposed to or is that in the sellers hand?

That's a question eBay would be best to answer, I think.

Regardless, if they're charging $40.59 for an order to LA and they're charging 9.9% tax, they need to not charge tax on shipping, as labor is non-taxable. Tax would be $37.62 for 9.9% of $380. $40.59 is 9.9% of tax on the $380 item price (auction above is showing a price of $360 not $380) + $29.98 shipping.

I'd tell the seller to correct the tax on the item amount and not the item + shipping amount, or report it to eBay. I think the seller should have been more up-front about charging sales tax so that he doesn't get situations like this. It's stated in the auction details, though doesn't jump out at you, as it should.

I wonder why they are charging more than actual sales tax?  My state is 6%, but they're charging 6.99%.

That, coupled with the charging sales tax on shipping, makes it sound like they're skimming.

I noticed that yesterday, my sales tax is 8% but the guy is charging 9.99% ?!?!? I don't want to straight out call the seller a crook but the guy sells mostly cheap knockoff looking clothes.

Edit: another red flag for me was the fact that he charges tax in Guam and Palua....

I'd contact ebay since he should have stated that he charges tax. Sounds like he is just trying to get more money for the item. I've bought stuff before on ebay where they people try saying they are going to charge me more for shipping, or the item didn't go for what they were expecting. They knew the risks of selling on ebay.

 
I wonder which states charge sales tax on shipping. Though it makes me wonder if it does violate USPS regulations or something. Then again some states do charge sales tax on groceries.
